For your consideration today is a proposal from Architecture Design Group (ADG) to extend its
design and construction coordination services through the completion of the American Trust facade
restoration project. The original basis of compensation, approved by the Commission on July 20,
2006, was 11 % of the cost of construction, not to exceed $70,000. The extension of the contract
commits additional hourly compensation not to exceed $7,000 to see us through the final two months
of the construction phase.
Our original terms contemplated only 12 months of engagement with ADG; however the National
Park Service review of plans that was required for the Rehabilitation Tax Credits lengthened the
pedevelopment phase considerably, and was atime-intensive portion of the project for ADG. To
their credit, the application was ultimately 100% successful, and once underway, ADG and Majority
Builders have kept this project moving as expediently as they could, with superior attention to
construction detail and under budget. You will be extremely proud of the end result, and of the
Commission's important role in this project.
I recommend approval of the contract extension with Architecture Design Group, and welcome any
questions you may have.

As a follow-up to our previous conversation about Architecture Design Group's (ADG)
request for Additional Services, I am submitting this letter.
Our initial proposal letter to you, dated June 16, 2006, preceded, and was made an
attachment to -our Agreement Between Owner and Architect, dated July 20, 2006. Article
11, paragraph 11.5 Additional Provisions, states that, "If the Basic Services covered by
this Agreement have not been completed within twelve (12) months of the date hereof,
through no fault of the Architect, extension of the Architect's services beyond that time
shall be compensated as provided in Sections 10.3.3 and 11.3.2."
Our last invoice, dated December 08, 2008, completed our agreed upon compensation,
although the Construction Phase of the Project is still incomplete. The agreed upon date
of construction Final Completion has been changed three times since the original date of
August 29, 2008; Most recently, Change Order No.S changed the date to Aprii 30, 2009.
Even though the Project was delayed nearly six months due to National Park Service
(NPS) review, ADG continued to work closely with the Indiana Department of Natural
Resources, and the NPS to satisfy their stringent requirements, and maintain the
Project's budget.
ADG is committed to the successful completion of the Project, and will continue to
provide the necessary on-going services and support to the City of South. Bend,
Michigan Street L.L.C., and Majority Builders, Inc.
We respectfully request that an additional fee, not-to-exceed seven thousand dollars
($7,000.00), be authorized for compensation through April 2009, and paid to ADG. The
fee for these Additional Services shall be computed on an hourly rate basis, as included
in our. original Agreement, and as follows:
