AN ORDINANCE AMENDING THE ZONING ORDINANCE FOR PROPERTY LOCATED AT 1921 GREENOCK, 1927 GREENOCK, 1931 GREENOCK, 1935 GREENOCK, COUNCILMANIC DISTRICT FIVE (5) IN THE CITY OF SOUTH BEND, INDIANA STATEMENT OF PURPOSE AND INTENT ZONING IS CURRENTLY DUPLEX BLT 1978 SZ 1782. I WOULD LIKE IT TO BE CHANGED TO DUPLEX NON -PUD. I OWN ALL 4 PROPERTIES NOW, SO THERE IS NO NEED FOR THESE PROPERTIES TO BE ZONED PUD ANYMORE. NOW THEREFORE BE IT ORDAINED by the Common Council of the City of South Bend, Indiana as follows: SECTION 1. Ordinance No. 9495 -04, is amended, which ordinance is commonly known as the Zoning Ordinance of the City of South Bend, Indiana, be and the same hereby is amended in order that the zoning classification of the following described real estate in the City of South Bend, St. Joseph County, State of Indiana: LOTS 27& 28 GARDEN QUARTER SEC A LOTS 29 & 30 GARDEN QUARTER SEC A LOTS 31 & 32 GARDEN QUARTER SEC A LOTS 33 & 34 GARDEN QUARTER SEC A be and the same is hereby established as DUPLEX NON -PUD SECTION II. Jefferson Boulevard South Bend, IN 46601 RE: Bill No. 39 -06 Tiffany Rezoning Dear Mr. Kuspa: Fax 574 235 -9813 I would like to take this opportunity to bring you up -to -date concerning the above referenced Bill, which was referred to us on July 10, 2006. As you are aware, State Statutes require the Area Plan Commission to conduct a public hearing within 60 days from the time that a rezoning request is referred to it. However, in this case the petitioner failed to identify the zoning district that he was requesting. Therefore, a public hearing could not be scheduled. The staff has been in contact with Mr. Tiffany several times concerning this matter. Mr. Tiffany recently advised the staff by telephone that he intends to withdraw this petition. We have asked him to send a letter to officially request a withdrawal. Once we receive this letter, we will forward a copy to the Council. If you have any questions, please feel free to contact me.
