ORDINANCE No. 9905-09 Passed by the Common Council of the Ciry of South Bend, Indiana February 23, 2009 Attest: Attest: Ciry Clerk President of Common Council Presented by me to the Mayor of the City of Soutli Bend, Indiana February 24, 2009 Ciry Clerk Approved and signed by me February 2 5 ; 20 ~_ Mayer ORDINANCE NO. ` ~ ©~ '' 05 AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, APPROPRIATING $59,850.00 PLUS ADDITIONAL NOMINAL INTEREST FROM GENERAL GRANT FUND (#250) FOR ART IN PUBLIC PLACES, AND CLOSING FUND #250 STATEMENT OF PURPOSE AND INTENT General Grant Fund #250 was established through a private contribution from the Goheen Trust which restricted the funds to the creation and support of Art in Public Places in South Bend. This ordinance appropriates all monies remaining in the Fund, i.e. $59,562.00 plus expected interest of about $290.00 through 2009, for the intended Goheen Trust purpose of creating and supporting art in public places, i.e., additional art work in the Jon Hunt Plaza, and a public exhibition of sculpture by South Bend native George Rickey through the Community Foundation. This appropriation will exhaust Fund #250 which should then be closed. NOW, THEREFORE, BE IT ORDAINED by the Common Council of the City of South Bend, Indiana, as follows: Section I. The sum of $59,850.00 plus any additional nominal interest is hereby appropriated from General Grant Fund #250 for art in public places including additional art work in the Jon Hunt Plaza and a public sculpture exhibition in downtown South Bend through the Community Foundation. Section II. Upon completion of the appropriation authorized in Section I, General Grant Fund #250 shall be closed. Section III. This Ordinance shall be in full force and effect from and after its passage by the Common Council and approval by the Mayor. GIBNEY EXECUTIVE DIRECTOR January 27, 2009 South Bend Common Council Fourth Floor Council Chambers 400 County-City Building South Bend, IN 46601 Dear Council Member: The attached bill for your consideration and approval will appropriate $59,850.00 from the General Grant Fund (fund # 250) to carry out the purpose of the original grant from the Goheen Trust, namely to create and support Art in Public Spaces in the City. These funds were originally granted for various public art uses, but $59,850 remains. The intended uses include approximately $9,850 in additional art work in Jon Hunt Plaza in front of the Morris Performing Arts Theatre and $50,000 to the Community Foundation in support of the year-long exhibit of South Bend native George Rickey's sculpture on the sidewalks of downtown. Rickey is an internationally known kinetic sculptor whose work combines the technical expertise of an engineer with an artist's vision to celebrate fluidity and movement. The exhibit is an extremely exciting event for our community and was conceived through the collaboration of the South Bend Museum of Art, the Snite Museum of Art, the Community Foundation, and the City of South Bend. We look forward to your approval of this ordinance. Please note, these funds cannot be used for general government purposes, only to support art in public places.
