2009 South Bend Common Council
The January 26, 2009 meeting of the Public Works and Property Vacation Committee of the South Bend
Common Council was called to order by its Chairperson, Council Member David Varner at 3:30 p.m. in
the Council's Informal Meeting Room.
Persons in attendance included Council Members Rouse, Henry Davis, Jr., Varner, White, Dieter,
LaFountain, and Puzzello, Public Works Director Gary Gilot, City Engineer Carl Littrell, ,Michael
Danch, Bill Schalliol, Martha Lewis, Mrs. Kopola, IU South Bend Intern Jeremy Toschlog, Jamie Loo of
the South Bend Tribune and Kathleen Cekanski-Farrand, Council Attorney.
Dr. Varner noted that the Committee members include Council Members Henry Davis, Jr., Tom
LaFountain, Timothy Rouse and himself.
Bill No. 03-09 Request to Vacate an Alley & Portion of a Street ROW Involving Main Street,
Western Avenue, Michigan Street and Monroe Street:
Dr. Varner called for a presentation on Bill No. 03-09 requesting a vacation of an alley and portion of a
street right of way involving Main Street, Western Avenue, Michigan Street and Monroe Street.
Michael J. Danch, President of Danch, Harner & Associates, Inc. with offices located at 1643 Commerce
Drive, South Bend, Indiana 46628 made the formal presentation. He noted that the Petitioners who
include the City of South Bend, the Redevelopment Department, the Western Avenue Properties LLC,
Diaz Regelio, Luis Sotelo and Marie Luisa are seeking a vacation of two (2) 14' alleys and a portion of
Michigan Street located near the Bankruptcy Courthouse. The vacation would allow the property owners
to reconfigure the existing lots. Mr. Danch added that Homeland Security is in the process of increasing
security guidelines and this would permit that to also go forward.
Council Member White noted that the Board of Public Works sent the request to the Council with a
favorable recommendation.
There was no one in the public to speak in favor or in opposition to the Bill.
Council Member Rouse made a motion, seconded by Council Member LaFountain that Bill No. 03-09 be
recommended favorably to Council. The motion passed.
There being no further business to come before the Committee, Dr. Varner adjourned the meeting at 3:37
p.m.
