11 ORDINANCE NO. 17 0
AN ORDINANCE AMENDING SECTION 12 OF ORDINANCE NO. 2331,
ADOPTED JUNE 25, 1923 AND KNOUT AS THE ZONING
ORDINANCE FOR THE CITY OF SOUTH BEND,
INDIANA.
BE IT ORDAINED by the Common Council of the City of
South Bend, Indiana.
SECTION 1.
That Section 12 of Ordinance No. 2331, commonly known
as the Zoning Ordinance for the City of South Bend, Indiana, be and
the same is hereby amended to read as follows, to wit:
SECTION 12
"CD Height and Area District.
In the "CH height and Area District the height of
buildings, the minimum dimensions of yards and setbacks, and
the minimum lot area per family shall be as follows:
HEIGHT: No building hereafter erected or struct-
urally altered shall exceed eighty-five (85) feet or seven (7)
stories.
REAR YARD: For buildings three (3) stories or less
, in height these shall be a rear yard having a depth of not
less than twenty-five (25) feet for interior lots, nor less
than fifteen (15) feet for corner lots. For buildings ex-
ceeding three (3) stories in height the depth of the rear yard
shall be increased three (3) feet for each additional story.
See Section 17, (g) and (h) .
SIDE YARD: For buildings three (3) stories or less in
height there shall be a side yard on each side of a building
of not less than five (5) feet in width, provided, however,
that on a lot having a width of less than forty (40) feet, as
shown by the last conveyance of record at the time of the passage
of this ordinance, there shall be a side yard on each side of a
building of not less than four (4) feet in width. For buildings
exceeding three (3),.stories in ehight the side yard shall in all
cases be increased six (6) inches for each additional story. A
side yard in no case Shall be less thanrthe minimum width herein
designated plus 6" for each 10' or fraction thereof of building
length over 60' when on the east, south or west side of the
building and not less than the minimum width plus 8" for each •
10+ or fraction thereof of building length over 60' when on the
north side of the building. See Section 17 (h) .
SETBACK: There shall be a setback line of not less
than twenty (20) feet, provided that, when twenty-five (25)
per centor more of all the property on one side of a street be-
tween two intersection streets at the time of the passage of

this ordinance has been built up with buildings haying a
minimum setback line of more, or less, than twenty (20) feet
from the street line, no building hereafter erected or
structurally altered sebtaLl project beyond the minimum set-
back line so established; provided that no building shall oe "
pequired to set back more than forty (40) feet in any case;
and, provided further that these setback restrictions shall
also apply to that rear portion Q a Corner lot which is
within forty (40) feet from the center of the front of any
forty (40) feat from the center of:`the •frbnt of any adjacent
lot zoned or.:usdd,for residence. purposes.
LOT AREA PERT FAMILY: Every building hereafter erected
or structurally altered shall provide a lot area of not less
than four hundred (400) square feet per family, provided
however, that this regulation shall not apply to hotels, or
apartment hotels..where no cooking is done in any individual
room or apartment.
SpgTION 2.
The=proviSionS of said lordinance- No. " 2331,-; relating
to penalties and enforceent thereof shall=apply-in -all,parti==

SECTION 3.
This Ordinance spell be in full force and effect from
