Martin, Clerk REGULAR MEETING DECEMBER 8, 2015 The Regular Meeting of the Board of Public Works was convened at 9:38 a.m. on December 8. 2015, by Board. President Gary A. Gilot, with Board Members David Relos, Elizabeth Maradik, James Mueller, and Therese Dorau present. Also present was Board Attorney Michael Schmidt. APPROVE MINUTES OF PREVIOUS MEETINGS Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the Minutes of the Agenda Review Sessions, Regular Meetings and Claims Meetings of the Board held on November 5 and November 19, 2015; November 10 and November 24, 2015; and November 17 and December 1, 2015, were approved. OPENING AND AWARD OF BIDS —SALE OF ABANDONED VE141CLFS This was the date set for receiving and opening. of sealed bids for the above referenced vehicles. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- County News, which. were found to be sufficient. Mr. Gilot stated it came to the Board's attention prior to the meeting that some of the vehicles listed in the sale may have been vandalized and had broken windows. He asked what Code and Legal would prefer to do, proceed with the opening of bids or delay it until after the bidders had been notified. Ms. Kathy Eli, Code Enforcement, stated they would have to wait until next year if they delayed it due to the need to advertise. Attorney Michael Schmidt stated the Board should proceed with the opening and award to the highest bidders and notify them of the issue and allow them to rescind their bid after the condition of the vehicles is determined. After review of the bids, Ms. Kathy Eli, Code Enforcement, recommended the award of the vehicles to the highest, first received (in case of a tie) bidders as indicated in bold above. Upon a motion by Mr. Gilot, seconded by Ms. Maradik and carried, the recommendation of awards was approved. OPENING OF QUOTATIONS WASTEWATER TREATMENT PLANT HEADWORKS BUILDING BOILER REPLACEMENT (UTILITIES ENVIRONMENTAL SERVICES SEWAGE WORKS CAPITAL) Mr. Gilot advised that this was the date set for the receiving and opening of sealed Quotations for the above referenced project. The following Quotations were opened and read: HERRMAN & GOETZ 225 S. Lafayette Blvd. South Bend, IN 46601 Quotation was submitted by Larry Cripe. QUOTATONN; $43,649.00 DYNAMIC MECHANICAL SERVICES 1606 Chestnut Street REGULAR MEETING DECEMBER 8 2015 427 Mishawaka, IN 46545 Quotation was submitted by Kevin Conery QUOTATION: $46,093.00 IDEAL CONSOLIDATED. INC. 806 W. Sample St. South Bend, IN 46601 Quotation was submitted by Fred Mohler. QUOTATION: $50,700.00 Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the above Quotations were referred to Wastewater for review and recommendation. After review, Mr. Jacob Klosinski, Wastewater, recommended the quotation be awarded to the lowest responsive and responsible quoter, Herrman & Goetz, in the amount of S43,649.00. Upon a motion by Mr. Relos, seconded by Ms. Maradik, the recommendation of award was approved. OPENING OF QUOTATIONS — WASTEWATER TREATMENT PLANT 100 KW DIESEL INDUSTRIAL TOWABLE GENERATOR (UTILITIES ENVIRONMENTAL SERVICES SEWAGE WORKS CAPITAL) Mr. Gilot advised that this was the date set for the receiving and opening of sealed Quotations for the above referenced project. Ms. Linda Martin, Clerk of the Board, stated there were no quotes received for this. OPENING OF QUOTATIONS — WASTEWATER. TREATMENT PLANT 60 KW DIESEL INDUSTRIAL TOWABLE GENERATOR (UTILITIES. ENVIRONMENTAL SERVICES SEWAGE WORKS CAPITAL) Mr. Gilot advised that this was the date set for the receiving and opening of sealed Quotations for the above referenced project. Ms. Linda Martin, Clerk of the Board, stated there were no quotes received for this. Mr. Gilot stated since no quotes were received for either generator quote, they were free to go to the open market. OPENING OF PROPOSALS — FUEL MANAGEMENT SYSTEM FOR CENTRAL SERVICES (CAPITAL IMPROVEMENTS) Mr. Gilot advised that this was the date set for the receiving and opening of sealed Proposals for the above referenced project. Mr. Gilot stated the proposals will be reviewed and scored based on a matrix system, by a team made up of City representatives. He read the names of the Following vendors submitting proposals into the record: TRAK ENGINEERING. INC. 2901 Crescent Dr. Tallahassee, FL 32301 Proposal was submitted by Katherine Blyth. B & K EQUIPMENT 2939 175r" Street Lansing, iL 60438 Proposal was submitted by Dale Huizenga Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the above proposals were referred to Central Services and their review team for tabulation and recommendation. RESCIND BID AWARD AND RE -AWARD BID —MASONRY RESTORATION AT CENTURY CENTER - PROJECT NO 115-01 SR (HOTEL/MOTEL TAX) Mr. Michael Carey, Engineering, advised the Board that on October 13, 2015, bids were received and opened for the above referenced project. After reviewing those bids, Mr. Carey recommended that the Board award the contract to the lowest responsive and responsible bidder REGULAR MEETING DFCF.MBER 8 2015 428 C&S Masonry Restoration in the amount of S 139,000.00 for the Base Bid Phase I, Phase B, and the Alternate Bid Phase I. Mr. Carey explained that the bids contained additional unit price work that was not awarded due to budget constraints. Ile asked that the Board rescind the award of Phase II in the amount of $41,000.00 and award 40,773 square feet of Items Nos. 2 and 3, and 845 Linear Feet for Item No. 4 for $148,537.32 bringing the new total award to $246,537.32. Mr. Carey noted that C&S Masonry is still the lowest responsive bidder. Therefore, Mr. Relos made a motion that the recommendation be accepted and the bid be rescinded and awarded as outlined above. Ms. Maradik seconded the motion, which carried. AWARD QUOTATION — TWYCKENHAM TRAFFIC CALMING — PROJECT NO. 115-092 (2015 NEIGHBORHOOD TRAFFIC CALMING) Ms. Blair Bennett, Engineering, advised the Board that on December 3, 2015, quotations were received and opened for the above referenced project. After reviewing those quotations, Ms. Bennett recommended that the Board award the contract to the lowest responsive and responsible bidder, Martell Electric, LLC, 4601 Cleveland Rd., South Bend, Indiana, in the amount of $14,692.00. Therefore, Ms. Maradik made a motion that the recommendation be accepted and the quotation be awarded as outlined above. Mr. Relos seconded the motion, which carried. AWARD QUOTATION — TRAFFIC SIGNAL IMPROVEMENTS — PROJECT NO. 115-131 (TRAFFIC SIGNAL REPAIRS & MAINTENACE) Mr. Roger Nawrot, Engineering, advised the Boardthat on December 3, 2015, quotations were received and opened for the above referenced project. After reviewing those quotations, Mr. Nawrot recommended that the Board award the contract to the lowest responsive and responsible bidder, Pemberton Davis Electric, Inc., 916 E. McKinley Ave., Mishawaka, Indiana, in unit prices not to exceed $47,176.00. Therefore, Mr. Relos made a motion that the recommendation be accepted and the quotation be awarded as outlined above. Ms. Maradik seconded the motion, which carried. APPROVE CHANGE ORDER. NO. 2 — CENTURY CENTER SOUTH ENTRY IMPROVEMENTS —PROJECT NO. 115-014 (HOTEL/MOTEL TAX) _ Mr. Gilot advised that Mr. Toy Villa, Engineering. has submitted Change Order No. 2 on behalf of Ziolkowski Construction, Inc., 4050 Ralph Jones Drive, South Bend, Indiana 46628, indicating the Contract amount be increased by $799.00 for a new Contract sum, including this Change Order, in the amount of $78,162.00. Upon a motion made by Ms. Maradik, seconded by Mr. Relos and carried, the Change Order was approved. APPROVE CHANGE ORDER NO 2 (FINAL) AND PROJECT COMPLETION AFFIDAVIT — HILL STREET IMPROVEMENTS PHASE II — PROJECT NO 113-024A (REDA TIF) Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted Change Order No. 2 (Final) on behalf of Rieth-Riley Construction Co., Inc., 25200 SR 23, South Bend, Indiana 46614, indicating the contract amount be decreased by $2,289.00 for a new contract sum, including this Change Order, of $121,813.50. Additionally submitted was the Project Completion Affidavit indicating this new final cost of $121,813.50. Upon a motion made by Ms. Maradik, seconded by Mr. Relos and carried, Change Order No. 2 (Final) and the Project Completion Affidavit were approved. APPROVE CHANGE ORDER NO 2 (FINAL) AND PROJECT COMPLETION AFFIDAVIT_ — 2015 CURB AND SIDEWALK PROGRAM, DNISION B —PROJECT NO 115-069B (MVH) Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted Change Order No. 2 (Final) on behalf of Selge Construction Co., Inc., 2833 South 11' St., Niles, Michigan 49120, indicating the contract amount be increased by $4,039.91 for a new contract sum, including this Change Order, of $257,718.06. Additionally submitted was the Project Completion Affidavit indicating this new final cost of $257,718.06. Upon a motion made by Ms. Maradik, seconded by Mr. Relos and carried, Change Order No. 2 (Final) and the Project Completion Affidavit were approved. APPROVE PROJECT COMPLETION AFFIDAVIT — 2015 PARKING GARAGE DECK COATING (WAYNE ST) - PROJECT NO. 115-074B (PARKING GARAGE FIJND) Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted the Project Completion Affidavit on behalf of RAM Construction Services, Inc., 13800 Eckles Road, Livonia, MI 48150, for the above referenced project, indicating a final cost of $500,284.44. Upon a motion made by REGULAR MEETING DECEMBER 8, 2015 429 Mr. Relos, seconded by Ms. Maradik and carried, the Project Completion Affidavit was approved. APPROVE PROJECT COMPLETION AFFIDAVIT — 2015 PARKING GARAGE DECK COATING (LF,IGHT(YN GARAGE) PROJECT NO It 5-074A (RWDA TIF) Mr. Griot advised that Mr. Toy Villa, Engineering, has submitted the Project Completion Affidavit on behalf of RAM Construction Services, Inc., 13800 Eckles Road, Livonia, MI 48150, for the above referenced project, indicating a final cost of $261,962.50. Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the Project Completion Affidavit was approved. APPROVE PROJECT COMPLETION AFFIDAVIT — DEMOLITION OF VACANT & ABANDONED HOUSES DIVISION E - PROJECT NO 115-047 (LOSS RECOVERY) Mr. Gilot advised that Mr. Toy Villa, Engineering, has submitted the Project Completion Affidavit on behalf of Ritschard Bros., Inc., 1204 W Sample St., South Bend, N 46619, for the above referenced project, indicating a final cost of $307,562.00. Upon. a motion made by Mr. Roles, seconded by Ms. Maradik and carried, the Project Completion Affidavit was approved. APPROVE PROJECT COMPLETION AFFIDAVIT — EAST GATE LIFT STATION REPLACEMENT - PROJECT NO. 114-054 (EIWIRONMENTAL SERVICES WASTEWATER CAPITAL ACCOUNT) Mr. Gilot advised that Mr. Jacob Klosinski, Environmental Services, has submitted the Project Completion Affidavit on behalf of Selge Construction Co., 2833 S I I" St., Niles, MI 49120, for the above referenced project, indicating a final cost of $574,411.70. Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the Project Completion Affidavit was approved. APPROVAL OF REQUEST TO ADVERTISE FOR TILE RECEIPT OF BIDS — EQUIPMENT PURCIIASE FOR THE ADVANCED CENTERS FOR CANCER CARE — PROJECT NO. 115- 035 (RWDATIF) In a memorandum to the Board, Michael Carey, Engineering, requested permission to advertise for the receipt of bids for the above referenced project. Therefore, upon a motion made by Ms. Maradik, seconded by Mr. Relos and carried, the above request was approved. ADOPT RESOLUTION NO. 76-2015 — A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS APPROVING THE TRA➢E-IN OF CITY -OWNED PROPERTY ON PROPERTY OF SIMILAR NATURE Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTION NO.76-2015 A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS APPROVING THE TRADE-IN OF CITY -OWNED PROPERTY ON PROPERTY OF SIMILAR NATURE WHEREAS, it has been determined by the Board of Public Works of the City of South Bend that the following described property is unfit for the purpose for which it was intended and should be traded -in for property of a similar nature: SW583 2009 FREIGHTLINER TRASH TRUCK SW562 2009 FREIGHTLI-NER TRASH TRUCK SW572 2009 FREIGHTLINER TRASH TRUCK WHEREAS, I.C. 36-1-11-9 authorizes the Board of Public Works to trade in or exchange City -owned property for partial or full reduction in the purchase price of property of similar nature. Martin, Clerk ADOPT RESOLUTION NO. 77-2015 — A RESOLUTION OF THE SOUTH BEND BOARD OF PUBLIC WORKS APPROVING THE TRADE-IN OF CITY -OWNED PROPERTY ON PROPERTY OF SIMILAR NATURE Upon a motion made by Mr. Reins, seconded by Ms. Maradik and carried, the following Resolution was adopted by the Board of Public Works: RESOLUTTON NO.77-2015 A RESOLUTION OFT HE SOUTH BEND BOARD OF PUBLIC WORKS APPROVING THE TRADE-IN OF CITY -OWNED PROPERTY ON PROPERTY OF SE%BLAR NATURE WHEREAS, it has been determined by the Board of Public Works of the City of South Bend that the following described property is unfit for the purpose for which it was intended and should be traded -in for property of a similar nature: 2001 CHEVY PAINT MACHINE TRUCK, MODEL W4500 WHEREAS, I.C. 36-1-11-9 authorizes the Board of Public Works to trade in or exchange City -owned property for partial or full reduction in the purchase price of property of similar nature. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF PUBLIC WORKS OF THE CITY OF SOUTH BEND, AS FOLLOWS: 1. APPROVE CLAIMS Mr. Relos stated that a request to pay the following claims in the amounts indicated has been received by the Board; each claim is fully supported by an invoice; the person receiving the goods or services has approved the claims; and the claims have been filed with the City Fiscal Officer and certified for accuracy. Ms. Maradik seconded the motion, which carried. PRIVILEGE OF THE FLOOR Mr. Murray Miller, Local No. 645 questioned the City's policy on assessing liquidated damages, comparing two companies and the discrepancies. Mr. Eric Horvath, Director of Public Works, stated the City looks at what the contract says for each project and if there are allowance for weather, we'll give them those allowances. He noted all projects are treated the same explaining the City looks at the calendar and determines which days they couldn't legitimately work and make adjustments. Mr. Miller stated he had heard the inspector was out sick on one project and couldn't answer their questions. Mr. Horvath noted the inspector shouldn't affect their ability to get work done, they have a timeline and specs and plans to work off of. Mr. Miller stated there were other companies working on the days that were approved for L.D. Doesa. Mr. Horvath stated he was happy to sit down with the representatives and take a further look. He noted there is certain work that can't be done in inclement weather, not necessarily all work. IIe stated Notre Dame will write weather protection into their specifications assuring an aggressive schedule regardless of the weather. Mr. Miller stated he was talking about a project across the street where workers continued to work in the weather. Mr. Gilot asked if that was the digester project. Mr. Miller confirmed it was. Mr. Gilot noted that was inside work. Mr. Horvath stated the City needs to justify liquidated damages before taking them to the Board for payment. He reiterated that he is available to meet with the union members and discuss. Mr. Miller thanked him and said they would contact him.
