Gilot, with Board Members David Relos, Elizabeth Maradik, and Therese Dorau present. Board Member James Mueller was absent. Also present was Attorney Michael Schmidt. Board of Public Works Clerk, Linda Martin, presented the Board with a proposed agenda of items presented by the public and by City Staff. OPENING OF BIDS — COLFAX AVENUE AND HILT STREET IMPROVEMENTS (REDA TIE) This was the date set for receiving and opening of sealed bids for the above referenced project. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- County News, which were found to be sufficient. The following bids were opened and publicly read: — RIETH-RILEY CONSTRUCTION CO. INC. 25200 State Road 23 South Bend, IN 46614 Bid was signed by: Todd A. Gose Contractor's Non -Collusion Affidavit, Non -Debarment Affidavit, Certification Regarding Investment with Iran, Employment Eligibility Verification, Non -Discrimination Commitment for Contractors and Certification of Use of United States Steel Products or Foundry Products was submitted. Five percent 5% Bid Bond was submitted. OPENING OF QUOTATIONS — TRAFFIC SIGNAi, IMPROVEMENTS — PROJECT NO 115-131 (REPAIRS & MAINTENANCE SERVICES/TRAFFIC SIGNAL MAINTENANCE) Mr. Gilot advised that this was the date set for the receiving and opening of sealed Quotations for the above referenced project. OPENING OF QUOTATIONS — TWYCKENHAM TRAFFIC CALMING — PROJECT NO 115-092 (2015 NEIGHBORHOOD TRAFFIC CALMING PROGR AM) Mr. Gilot advised that this was the date set for the receiving and opening of sealed Quotations for the above referenced project. The following Quotations were opened and read: MICHIANA CONTRACTING, INC. 7843 Lilac Road PO Box 46563 Plymouth, IN 46563 Quotation was submitted by Donald W. Wendel QUOTATION: $18,400.00 MARTELL ELECTRIC, LLC 4601 Cleveland Rd. South Bend, IN 46628 Quotation was submitted by John A. Martell QUOTATION: S14,692.00 Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the above Quotations were referred to Engineering for review and recommendation. Board members discussed the following item(s) from the agenda. AGENDA REVIEW SESSION DECEMBER 3, 2015 422 - Opening of Quotes — 100kW and 60kAJ Generators Mr. Jacob Klosinski, Environmental Services, stated these generators are for the lift stations in the event of power outages. Ile noted it helps to have two in case multiple lift stations are out at the same time. Mr. Klosinski stated he is quoting the dit%rent capacity generators separately for budgeting constraints. He noted they will see what the quotes come in at and determine which ones they can afford. Mr. Gilot questioned if there are limitations on noise levels in the specifications. Mr. Klosinski confirmed there are, adding there is no way to completely quiet them, but there are some limitations. Rescind Bid Award and Re -award Bid — Masonry Restoration at the Century Center — Mr. Mike Carey, Engineering, stated when this project was first advertised, the award was for Phase I and the alternate and Phase II. He noted the additional unit pricing work in the specs was not awarded. He is now asking to rescind Phase 11, and award the unit pricing. Mr. Carey confirmed it was to the same vendor, the bid order was not affected. Mr. Gilot questioned if they had already proceeded work. Mr. Carey stated they had not, they are still working on Phase I. - Traffic Control Devices Ms. Theresa Harrison, Engineering, stated the request for a handicapped accessible parking sign at 2629 Fredrickson was given an unfavorable recommendation because there is a flat driveway with alley access available. She noted that the front door has steps, making it less accessible for a handicapped individual. She presented a picture of the residence to the Board. Mr. Gilot stated she might ask the Street Department for the alley to be graded, noting it appears there is a large puddle in the alley which may be the reason they don't want to use the alley for access. - Special Purchases — Street Light Poles Attorney Schmidt stated it is his recommendation that these get quoted separately. He noted the Traffic and Lighting Department is confident these are sole source equipment supplied by one vendor. He stated there is no reason it can't be confirmed that these are sole source by requesting quotes. Mr. George King, Purchasing, stated he would work with the department on soliciting quotes, adding they would break them down by areas of town. He noted the dollar amounts would not require Board action and requested they be removed from the agenda. PRIVILEGE OF THE FLOOR _ Mr. George King, Purchasing, stated he wanted to make the Board aware of an issue he has been dealing with regarding the MBE/WBF. good faith efforts. He informed the Board he has been contacted by B&J Excavation with complaints that no contractor has contacted them in two (2) years to work as a subcontractor. "They questioned whether the City is confirming good faith efforts are being followed by the prime contractors before awarding. He noted City Ordinance calls for inclusion of MBElWBE workers, and bidders must complete the Forms showing good faith efforts. Mr. King stated he found that B&J, however, is not registered with the State of Indiana as a MBEJWBE certified business. The Board agreed they don't qualify as a MBE/WBE business unless they we registered. Mr_ King noted it is important the City confirm the bidders are following the requirement of the forms before making an award recommendation, as Attorney Schmidt always reminds everyone when reading the bids into the record. Martin, Clerk REGULAR MEETING DECEMBER 8, 2015 The Regular Meeting of the Board of Public Works was convened at 9:38 a.m, on December 8, 2015, by Board President Gary A. Gilot, with Board Members David Relos, Elizabeth Maradik, James Mueller, and Therese Doran present. Also present was Board Attorney Michael Schmidt. APPROVE MINUTES OF PREVIOUS MEETINGS Upon a motion made by Mr. Relos, seconded by Ms. Maradik and carried, the Minutes of the Agenda Review Sessions, Regular Meetings and Claims Meetings of the Board held on November 5 and November 19, 2015; November 10 and November 24, 2015; and November 17 and December 1, 2015, were approved. OPENING AND AWARD OF BIDS — SALE OF ABANDONED VEHICLES This was the date set for receiving and opening of sealed bids for the above referenced vehicles. The Clerk tendered proofs of publication of Notice in the South Bend Tribune and the Tri- County News, which were found to be sufficient. Mr. Gilot stated it came to the Board's attention prior to the meeting that some of the vehicles listed in the sale may have been vandalized and had broken windows. He asked what Code and Legal would prefer to do, proceed with the opening of bids or delay it until after the bidders had been notified. Ms. Kathy Eli, Code Enforcement, stated they would have to wait until next year if they delayed it due to the need to advertise. Attorney Michael Schmidt stated the Board should proceed with the opening and award to the highest bidders and notify them of the issue and allow them to rescind their bid after the condition of the vehicles is determined.
