RESOLUTION NO. Q 7-8-a
A RESOLUTION OF THE COMMON COUNCIL AUTHORIZING
THE MAYOR TO EXECUTE DOCUMENTS NECESSARY TO
ENTER INTO AN URBAN DEVELOPMENT ACTION GRANT
AGREEMENT WITH THE UNITED STATES DEPARTMENT
OF HOUSING AND URBAN DEVELOPMENT
WHEREAS, the Mayor has submitted an application and
amendments thereto for an Urban Development Action Grant to the
United States Department of Urban Development for purposes of
acquiring public right-of-way, preparing a site and roadway through
soil stabilization, excavation, backfill, constructing, improving,
and signalization of access roadways, extending water and sewer
lines, relocating overhead electrical transmission lines, and direct
participation in the development of an ethanol plant in the City of
South Bend; and
WHEREAS, in order to enter into such a grant, should the
award be forthcoming from the Secretary of the United States Depart-
ment of Housing and Urban Development, it is necessary for the
Council to authorize the Mayor to enter into certain agreements and
execute certain documents required by the United States Department
of Housing and Urban Development ; and
WHEREAS, the Common Council of the City of South Bend
supports the development of industrial opportunity in the City,
including the activities addressed in the grant application;
NOW THEREFORE, BE IT RESOLVED by the Common Council of the
City of South Bend, Indiana, as follows :
SECTION 1. The Mayor has the authority to enter into
agreements and execute documents necessary to implement an Urban
Development Action Grant from the United States Department of Housing
and Urban Development to the City of South Bend for purposes relating
to facilitating the location in South Bend of an Ethanol Plant.
SECTION 2. This resolution shall be in full force and
effect upon passage by the Common Council and approval by the Mayor,
contingent upon notification to the City of South Bend that the Urban
Development Action Grant has been awarded to the City.
