A RESOLUTION OF THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS
WITHIN THE CITY COMMONLY KNOWN AS THE
SOUTH-WEST CORNER OF ELWOOD AVENUE AND
PORTAGE AVENUE, AN ECONOMIC REVITALIZATION
AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT.
WHEREAS, a petition for real property tax abatement
consideration has been filed with the Common Council of the
City of South Bend, requesting that the area commonly known as
the South-west corner of Elwood Avenue and Portage Avenue ,
South Bend, Indiana, and which is more particularly described
as follows:
A tract or parcel of land in the Northwest quarter of
Section 2, Township 37 North, Range 2 East, Portage
Township, St . Joseph County, South Bend, Indiana, to
wit:
A tract or parcel of land in the Northwest quarter
(1/4) of Section 2, Township 37 North, Range 2 East ,
described as beginning at a point on the South line of
Elwood Avenue , which point is Twenty (20) feet South
and Nine Hundred Seventy-five (975) feet East of the
Northwest corner of the Northwest Quarter (1/4) of
Section 2, Township 37 North , Range 2 East; running
thence South One Thousand One Hundred Eighty-four and
Seventeen Hundredths (1184. 17) feet more or less to
the Northerly line of the Chicago, Indiana Southern
Railroad Company's right-of-way; thence Northeasterly
along said Northerly line of said Chicago, Indiana
Southern Railroad Company's right-of-way One Thousand
Sixty-three and Seven Tenths (1063. 7) feet to the
Southwesterly line of Portage Avenue thence Northwest-
erly along said Southwesterly line of portage Avenue
Three Hundred Eighty-nine and Five Tenths (389.5) feet
to the South line of Elwood Avenue as this intersec-
tion existed prior to October 17, 1975, thence West
along the South line of Elwood Avenue as it existed
prior to October 17 , 1975 , Three Hundred Sixty-three
and Four Tenths (363. 4) feet to the point of beginning .
EXCEPTING THEREFROM the following described exception
parcels:
Exception Parcel 1:
Beginning in the Southwesterly line of Portage Avenue
in said City of South Bend , at a point South 37 de-
grees 48 minutes East 197.0 feet from the intersection
of the South line of Elwood Avenue with the Southwest-
erly line of said Portage Avenue, as this intersection
existed prior to October 17, 1975; running thence
South 37 degrees 48 minutes East along said Southwest-
erly line of said Portage Avenue , 152.0 feet to a
point 40.5 feet, more or less , measured at right
angles from the Northwesterly right-of-way line of the
Chicago , Indiana Southern Railroad; thence South 37
degrees 20 minutes west 103.6 feet on the long chord
of a curve to the left , which curve is parallel to and
at all points 40 .5 feet , more or less , distant from
the said Northwesterly right-of-way line of said
Chicago, Indiana Southern Railroad ; thence North 37
degrees 48 minutes West 178.65 feet; thence North 52
degrees 12 minutes East 100 feet to the point of
beginning.
Exception Parcel 2:
Beginning at the intersection of the Westerly line of
Portage Avenue and the South line of Elwood Avenue in
the City of South Bend, as this intersection existed
prior to October 17 , 1975, thence Southeasterly along
the Westerly line of Portage Avenue, One Hundred
Twelve (112) feet, thence angle Southwesterly Ninety
(90) degrees a distance of One Hundred Twenty-eight
(128) feet; thence Northerly parallel to Portage Ave-
nue line a distance of Sixty-one (61) feet; thence
Northeasterly approximately One Hundred Nineteen (119)
feet to a point in the South line of Elwood Avenue as
it existed prior to October 17 , 1975, Seventy and Four
Tenths (70.4) feet West of the place of beginning ;
thence East along the South line of Elwood Avenue , as
it existed prior to October 17 , 1975, Seventy and Four
Tenths (70.4) feet to the point of beginning .
Together with a perpetual easement of passage over and
across an adjoining parcel bounded by a line running
as follows:
Beginning at a point in the South line of Elwood Ave-
nue , as it existed prior to October 17, 1975, One Hun-
dred and Four Tenths (100.4) feet west of the inter-
section of said South line with the Westerly line of
Portage Avenue; as this intersection existed prior to
October 17 , 1975 ; thence East along said South line ,
as it existed prior to October 17 , 1975, Thirty (30)
feet; thence South Thirty-nine and Fifty-seven Hun-
dredths (39.5.7) feet; thence Northwesterly Forty-six
(46) feet, more or less, to the -point of beginning ,
except that part thereof conveyed to the City of South
Bend by deed Record 807, page 562 and assigned to said
City by Assignment of Easement etc. in Deed Record
807, pages 559 et seq.
Exception Parcel 3 :
A lot or parcel of land in the Northwest Quarter of
Section 2, Township 37 North, Range 2 East, in St.
Joseph County, Indiana, bounded by a line running as
follows, viz:
Beginning on the South line of Elwood Avenue, as it
existed prior to October 17 , 1975, 70. 4 feet West of
the intersection of the South line of Elwood Avenue
and the Southwesterly line of Portage Avenue , as it
existed prior to October 17 , 1975, thence South 14. 5
feet; thence West parallel to the South line of Elwood
Avenue, as it existed prior to October 17 , 1975, 29. 5
feet thence Northwesterly 81.95 feet to a point on the
South line of Elwood Avenue, as it existed prior to
October 17 , 1975, 110 .1 feet West of the place of
beginning; thence East along said South line of Elwood
Avenue , as it existed prior to October 17 , 1975, 110 .1
feet to the place of beginning, which exception is
contained in a deed to Civil City of South Bend for
widening of Elwood Avenue recorded in Deed Record 807,
page 562.
be designated as an Ecomomic Revitalization Area under the pro-
visions of Indiana Code 6-1 .1-12.1-1, et seq. ; and
WHEREAS, the Redevelopment Commission has concluded an
investigation and prepared a report with information sufficient
for the Common Council to determine that the area qualifies as
an Economic Revitalization Area under Indiana Code 6-1.1-
12.1-1, et seq. , and has further prepared maps and plats show-

ing the boundaries and such other information as required by
law of the area in question; and
WHEREAS, the Human Resources and Economic Development Committee
of the Common Council has reviewed said report and recommended
to the Common Council that the area qualifies as an Economic
Revitalization Area.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of
the City of South Bend, Indiana, as follows:
SECTION I. That the Common Council hereby accepts the
report and recommendation of the Human Resources and Economic
Development Committee that the area herein described be desig-
nated an Economic Revitalization Area and hereby adopts a resol-
ution designating this area as an Economic Revitalization Area
for purposes of real property tax abatement.
SECTION II. That this designation shall be limited to
five (5) calendar years from the date of the adoption of this
Resolution by the Common Council.
SECTION III. That the Common Council directs the City Clerk
to cause notice of the adoption of this resolution to be published,
said publication providing notice of the public hearing before
the Common Council on said declaration.
SECTION IV. This Resolution shall be in full force and
effect from and after its adoption by the Common Council and
approval by the Mayor.
