Dear Honorable Members:
Please accept the attached petition and ordinance as our firm's
w rMen request, on behalf of the current owner, northeast
Neighborhood R evitalization organization, Inc, and the contingent
owner, Weiss Domes, Inc., to vacate the following described public
rights-of-way: 1) a 14 foot Wide alley being the first east - crest alley
lying south of Kalorarno Street between T rnoak Street and the first
north -south alley east of North t. Louis Boulevard. Please refer to the
attached drawings for the area to be vacated.
The reason We are submitting this vacation request is utilize the north 7
feet of the vacated alley in order to develop to homes to the north.
The additional 7 feet will give Weiss Homes the needed width for the
construction of two homes. Without the a ldifional 7 feet, only one
home could be constructed due to the current narrow lot Widths.
The City Board of Public Works is expected to consider and approve
both the vacation request at either their December rneetilq
dependent upon various city department reviews or at their January
12th r eetin .

Pursuant to Indiana Code Section 36-7-3-12, the Common Council is charged with
the authority to hear a li petitions to vacate public gays o public places within the City.
The following Ordinance vacates the above described public property.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITE' OF SOUTH BEND, INDIANA, as follows:
SECTION 1. The Common Council of the City of South Bend having held a Public

reg ulations and complianec has created a need for fees related to processing of these documents.
All document ent fee increases are based on 2008 year -end average hourly overhead costs for
one -hotir and two-hour processing times.

STAT of PURPOSE AND INT
The purpose and intent of the change of zoning is to bring the property in better
compliance with the uses and zoning of the surrounding property, and to allow
commercial use of property a allowed by the classification of office District.
It is now SF1 zoning, but is no longer suited to that classification due to area
development.
W THEREFORE BE IT ORDAINED by the Common Council of the City

The Morris Performing Arts Center Improvement Fund Fund N o. 416)
was established for the purpose of renovating, remodeling, or otherwi
improving the facilities at the Morris Performing Arts Center. The Morri
Performing Arts Center desires to make certain capital improvements to r a in In
the facilities in good d corking order for the benefit of all patrons and clients. Th
proposed capital expenditure is for $25,000.00 for service, repair a nd
replacement of th hot grater heater and 10 gallon storage tank In the
mechanical room of the Morris Performing Arts Center.
NOW, THEREFOR BE IT ORDAIN-ED BY THE COMMON COUNCIL

This ordinance amends the South Bend Municipal Code a t Chapter 2, Article 1
by addinga ne w Section - 1.70.13. This establishcs the statutory fund contemplated by
1C -36-7-14-39(g) for the deposit and disbursement of Tax Financing dollar
attributable to excess P roperty tax proceeds derived f r om parcels located the A
Economic Development Area that are also located in the Urban Enterprise Zone.

SECTION I. Chapter 2 , Article 14 of the South B end Municipal Code is hereby
amended to add a new Section - 170.13 to read in its entirety as follows:
See. 2 - 170.13 Airport Ec onomic Development Ares. /Urban Enterprise Zone Special
Zone Fund.
( a) The Airp E conomic Development Area/Urban Enterprise Zone
Sp ecial Zone Fund (9,454) is established w ithin the City of South Bend to
receive p tax proceeds derived - from parcels located in the Airport
E conomic Development Area that are also located in the Urban Enterprise
Zone as rovided and permitted by Indiana law 1.C. 36-7-14-39(g)).

All ums of money collected and deposited in this Fund shall
