AN ORDINANCE RATIFYING A CONTRACT MADE BY AND
BETWEEN THE BOARD OF PUBLIC WORKS OF THE CITY
OF SOUTH BEND, INDIANA, AND THE NEW JERSEY,
INDIANA AND ILLINOIS RAILROAD COMPANY AND THE
T. Eh CASS OIL COMPANY, PERMITTING SAID COMPAN-
IES TO CONSTRUCT AND MAINTAIN A SIDE TRACK AC-
ROSS THE FIRST AILEY SOUTH OF THE RIGHT-OF-WAY
OF SAID RAILROAD CQMPANY BETWEEN MAGNOLIA AND
KOSCIUSZKO ST-?H1ETS IN THE CITY OF SOUTH BEND,
INDIANA.
Be it ordained by the Common Council of the City
of South Bend, Indiana, that:
SECTION 1.
A contract duly entered into on the 2Sth day
of March, 1927, by and between the municipal city of South
Bend, Indiana, by and through it's Board of Public Works
and the New Jersey, Indiana and Illinois Railroad Company
and the T. E. Cass Oil Company, for the construction and
maintenance of a side track across the first alley of the
right-of-way of said Railroad Company, between Magnolia and
Kosciuszko Streets in the said City of South Bend, a copy
of which contract is hereto attached and made a part hereof,
be and the some is hereby in all things ratified, confirmed
and approved.
SECTION 2. .
This Ordinance shall be in full force and effect
from and after it's passage.
