WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 2301-2303 Bendix Drive South Bend, Indiana, and which is more particularly described by a line drawn as follows : LEGAL DESCRIPTION A part of the South east Quarter of Section 28, Township 38 North, Range 2 East, German Township, St . Joseph County, Indiana described as follows : Commencing at the southeast corner of said Section; thence North 90 degrees 00 minutes 00 seconds West 470 feet along the south line of said section; thence North 0 degrees 00 minutes 00 seconds West 40 feet to a point on the north boundary of Lathrop Street, said point being the point of beginning of this description: thence North 0 degrees 00 minutes 00 seconds West 749 . 36 feet ; thence Southeasterly 540 .34 feet along an arc to the right having a radius of 506.47 feet and subtended by a long chord having a bearing of South 56 degrees 32 minutes 00 seconds East and a length of 515. 09 feet to the West boundary of Bendix Drive; thence South 0 degrees 02 minutes 06 seconds East 435. 34 feet along said boundary; thence South 44 degrees 54 minutes 22 seconds West 42 .43 feet to the north boundary of Lathrop Street; thence North 90 degrees 00 minutes 00 seconds West 400 . 00 feet along said north boundary to the point of beginning and containing 6.545 acres , more or less . The above described tract of land is subject to a perpetual ease- ment 40 feet in width off the entire northeast side in favor of Chicago South Shore and South Bend Railroad. Also, a perpetual easement 10 feet in width lying adjacent to and south of the above described 40 foot wide easement in favor of Indiana Bell Telephone Company. The bearing of the south line of the southeast quarter of Section 28 is assumed North 90 degrees 00 minutes 00 seconds West . be designated as an Economic Revitalization Area under the provisions of Indiana Code 6-1.1-12 .1-1, et seq. ; and WHEREAS, the Redevelopment Commission has concluded an investi- gation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitaliza- tion Area under Indiana Code 6-1. 1-12 .1-1, et seq. , and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in question; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows : SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Commit- tee that the area herein described be designated an Economic Revitali- zation Area and hereby adopts a resolution designating this area as an Economic Revitalization Area for purposes of real property tax abate- ment. SECTION II. That this designation shall be limited to five ( 5 ) calendar years from the date of the adoption of this resolution by the Common Council. SECTION III. That the Common Council directs the City Clerk to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. SECTION IV. Columbia, Suite 230 219-234-2073 South Bend, Indiana 46601 August 21, 1984 The South Bend Common Council County-City Building South Bend, IN 46601 Re: Application for Tax Abatement for 2301-2303 Bendix Drive Dear Members of the Council: By this letter, we respectfully submit application for 10 year tax abatement on real estate to be purchased by this applicant more commonly known as 2301-2303 Bendix Drive. This property is located in the Airport Industrial Park which has been declared a designated tax abatement impact area. The proposed improvements to be constructed will consist of two structures with a gross square footage of approximately 60, 000 square feet of industrial office and warehousing space. The project is expected to cost an estimated $1, 900, 000 with approximately $1, 700, 000 funded with Economic Development Bonds . The anchor tenant for the project will be Clark Equipment Corporation. As I 'm sure you are aware, Clark has recently announced plans to move a great number of jobs into our City and the proposed development is yet another step in this direction. Tax abate- ment is a benefit which will accrual directly to the tenant and will make continued moves such as this by Clark increasingly more likely due to cost justification. When completed and totally occupied, this project is expected to generate 32 new permanent jobs representing a new annual payroll of approximately $451, 000 . It will, of course in addition, create a number of temporary jobs through the construction of the buildings .
