A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF SOUTH BEND, COMMONLY KNOWN AS 1701, 1801, 1818, AND 1819 SOUTH MAIN STREET, SOUTH BEND, INDIANA TO BE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT. WHEREAS, the Common Council of the City of South Bend has adopted a Declaratory Resolution designating certain areas within the City as Economic Revitalization Areas for the pur- pose of tax abatement consideration; and WHEREAS, a Declaratory Resolution designated the area commonly known as 1701, 1801, 1818 and 1819 South Main Street, South Bend, Indiana and more particularly described as follows: The following parcels of real estate located in St. Joseph County, Indiana: A parcel of land being a part of Perley Lumber Com- pany 's Addition and a part of the Southwest Quarter of Section 13 , Township 37 North, Range 2 East, City of South Bend, Portage Township, St. Joseph County, Indiana and being more particularly described as follows: Beginning at a point on the West right-of-way line of Main Street, said point being the Southeast corner of a parcel of land conveyed to Abner M. Mellander and Bernard F. Hacker by deed recorded in Deed Record 725, page 93 , in the office of the Recorder of St. Joseph County, Indiana; thence South 0°-05' -59" East along said West right-of-way line of Main Street, a distance of 108.29 feet; thence South 89°-51 ' 05" West , parallel with the South line of said Mellander/Hacker parcel, a distance of 170.60 feet to the East right-of-way line of the Consolidated Rail Corporation; thence North 0°-04 ' -06" East along said right-of-way, a distance of 108.29 feet to its intersection with the Westerly projection of the South line of said Mellander/ Hacker parcel of land; thence North 89°-51 ' -05" East, along said projection and said South line, a distance of 170.28 feet to the place of beginning containing 18 ,457 square feet, more or less. A parcel of land being a part of Creed ' s 2nd Addition and a part of the Southwest Quarter of Section 13 , Township 37 North, Range 2 East, City of South Bend, Portage Township, St. Joseph County, Indiana, and being more particularly described as follows: Beginning at a point on the West right-of-way line of Main Street, a distance of 94 . 25 feet South 0°-05' -59" East of said West right-of-way ' s intersection with the centerline of a 14 foot vacated alley lying between lots 6 and 7 in said Creed 's 2nd Addition; thence South 0°-05 ' -59" East along said West right-of-way line, a distance of 206.92 feet; thence North 89°-35 ' -02" West, a distance of 169 .63 feet to the East right-of-way line of the Consolidated Rail Cor- poration; thence North 0°-04 ' -06" East along said East right-of-way line, a distance of 206 .91 feet; thence South 89°-35 ' -02" East, a distance of 169 .02 feet to the place of beginning containing 35 ,036 square feet, more or less. A parcel of land being a part of Lot 9 and all of Lot 10 Perley Lumber Company addition and Lot 14 Stover and Witwer Addition and 14 ft. adjacent Vacated Alley, South Bend, Indiana and being more particularly described as follows: Beginning at the Southwest corner of said Lot 14 , thence North 0°-00 ' -00" East (Bearing Assumed) along the East right-of-way line of Main Street, a measured distance of 120 .32 feet; thence South 89°-49 ' -37" East parallel with the North line of said Lot 9, a measured distance of 165 .3 feet to the East line of said Lot 9; thence South 0°-00 ' -00" West along the East lines of said Lots 9 and 10 , a measured distance of 61.32 feet to the Southeast corner of said Lot 10 ; thence South 1°-13 ' -40" West, a measured distance of 14.0 feet to the Northeast corner of said Lot 14; thence South 0°-00 ' -00" West along the East line of said Lot 14 , a measured distance of 45 .0 feet to the Southeast corner of said Lot 14; thence North 89°-49 ' -37" West along the South line of said Lot 14 , a measured distance of 165 .0 feet to the place of beginning containing 0. 45 acres more or less. Lots Numbered Eleven (11) , through Eighteen (18) , both inclusive, as shown on the recorded Plat of Perley Lumber Company 's Addition to the City of South Bend , in St. Joseph County, Indiana, as recorded in Plat Book 8, page 166 , together with the North Half of the vacated alley lying South of and adjacent to Lot 11 in said Addition and together with the vacated alley lying West of and adjacent to said Lots 11 to 18 , both inclusive, in said Addition. Lot Numbered Fifteen (15) as shown on the recorded Plat of Stover and Witwer 's Addition to the Town of Myler , now within and a part of the City of South Bend, together with the South Half of the vacated alley lying North and adjacent to said Lot 15 in said Addition and together with the vacated alley lying West of and adjacent to said Lot 15 in said Addition. Subject to all real estate taxes, including without limitation, the taxes for the year 1983 due and pay- able in 1984 and all prior and subsequent taxes. as an Economic Revitalization Area; and WHEREAS, notice of the adoption of a Declaratory Reso- lution and the public hearing before the Council has been pub- lished pursuant to Indiana Code 6-1.1-12. 1-2-5 ; and WHEREAS, the Council held a public hearing for the purposes of hearing all remonstrances and objections from interested persons; and WHEREAS, the Council has determined that the qualifi- cations for an economic revitalization area have been met. NOW, THEREFORE , BE IT RESOLVED by the Common Council of the City of South Bend , Indiana, as follows: SECTION I . That the Common Council hereby confirms its Declaratory Resolution designating the area described herein as an Economic Revitalization Area for the purposes of tax abatement. Such designation is for real property tax abatement only and is limited to five (5) calendar years from the date of adoption of the Declaratory Resolution by the Com- mon Council. SECTION II.
