A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS MATERIAL
INCIDENT RESPONSE SERVICES BETWEEN THE CITY OF SOUTH BEND
AND THE INDIANA DEPARTMENT OF HIGHWAYS
WHEREAS, the Common Council of the City of South Bend recognizes the
existence of the South Bend Fire Department Hazardous Materials Incident
Response Team consisting of trained personnel and equipment for response
to HAZMAT incidents ; and
WHEREAS, because of an increase in vehicular traffic transporting
hazardous materials on the Toll Road, the Indiana Department of Highways
wishes to obtain the services of the South Bend Fire Department Hazardous
Materials Incident Response Team for response, assessment and control of
hazardous materials (HAZMAT) incidents occurring within its jurisdiction;
and
WHEREAS, I. C. 36-1-7-1 et. seq. permits governmental entities to
exercise powers jointly by entering into a written agreement.
WHEREAS, the Board of Public Safety on January 8, 1985 , has reviewed
this request of the Indiana Department of Highways and recommends that the
Common Council enter into an Agreement for Hazardous Materials Incident
Response Services with the Indiana Department of Highways, Toll Road
Division.
NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of
South Bend, Indiana, as follows :
SECTION I. That the Common Council of the City of South Bend enter
into an Agreement with the Indiana Department of Highways for Hazardous
Materials Incident Response Services and the President of the Common
Council be authorized to execute the appropriate Agreement necessary to
carry out the request of the Indiana Department of Highways and intent of
this resolution.
SECTION II. This Resolution shall be in full force and effect from
and after its adoption by the Common Council and approval by the Mayor.
