Attest: ( /�et/ t/ City Clerk Attest: Allt / (` President of Common Council. - Presented by me to the Mayor of the City of South Bend, Indiana • December 4, 19 84 . �� //rte "` `°'✓ City Clerk I Approved and signed by me 22(1)1_12J . ft %C6VZ Mayor RESOLUTION NO. )a40-$.A A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE ISSUANCE OF A LICENSE FOR A RECYCLING OPERATION (SOMETHING OF VALUE, INC. ) WHEREAS, the Common Council of the City of South Bend recognizes the contributions that recycling operations make to the community; and the Council further realizes that such operations must be reasonably regulated in order to minimize any environmental or aesthetic nuisances which may be created by the operation of such facilities within the City; and WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operation of recycling operations; and WHEREAS, at the public meeting held on November 15, 1984, the Board of Zoning Appeals approved the location of a recycling operation at 1100 Prairie Avenue, South Bend, Indiana, provided that the materials received for recycling consist only of selected industrial waste, limited to paper, cardboard, wood, and some plastics; and WHEREAS, in accordance with said rules and regulations, inspec- tions of the recycling operation have been completed by the Department of Code Enforcement and the Fire Prevention Bureau; and WHEREAS, Section 4-51 (f ) of the South Bend Municipal Code requires that the Board receive favorable review of a proposed recycling operation by the Department of Code Enforcement and the Fire Prevention Bureau prior to making its recommendation to the Common Council for issuance of a recycling license; and WHEREAS, the reviews of the Department of Code Enforcement and the Fire Prevention Bureau were favorable subject to the correction of certain building and fire code violations as shown on attached Exhibits A and B; and WHEREAS, based on the review by the Department of Code Enforcement and Fire Prevention Bureau, the Board of Public Works recommended at its meeting held on December 3, 1984 that a license for the operation of a facility for the recycling of industrial waste as approved by the Board of Zoning Appeals at its meeting held on November 15, 1984, be issued to Something of Value, Inc. , 1100 Prairie Avenue, South Bend, Indiana, after approval of building plans, correction of all building code and fire code violations as shown on attached Exhibits A and B, compliance with all state and local occupancy requirements and receipt of an Occupancy Permit from the City of South Bend. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana as follows: SECTION I. That the license application for the operation of a facility for the recycling of industrial waste as approved by the Board of Zoning Appeals at its meeting held on November 15, 1984, be issued to SOMETHING OF VALUE, INC. , 1100 Prairie Avenue, South Bend, Indiana, after approval of building plans, correction of all building code 4nd fire code violations as shown on attached Exhibits A and B, compliance with all state and local occupancy requirements and receipt of an Occupancy Permit from the City of South Bend. SECTION II. This resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor.
