RESOLUTION NO. 1, 0-Ry'
AN AMENDED RESOLUTION CONFIRMING THE ADOPTION
OF A DECLARATORY RESOLUTION DESIGNATING CERTAIN AREAS
WITHIN THE CITY OF SOUTH BEND , COMMONLY KNOWN AS
1147 PRAIRIE AVENUE TO BE AN ECONOMIC REVITALIZATION AREA
FOR PURPOSES OF PERSONALRROPERTY TAX
ABATEMENT.
WHEREAS, the Common Council of the City of South Bend
has adopted a Declaratory Resolution designating certain areas
within the City as Economic Revitalization Areas for the pur-
pose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area
commonly known as 1147 Prairie Avenue and more particularly
described by a line drawn as follows :
PARCEL I
A parcel of land being a part of the North Half of
Section 14 , Township 37 North, Range 2 East, in Port-
age Township, City of South Bend, St. Joseph County,
Indiana, and being more particularly described as fol-
lows, viz:
Beginning at the intersection of the South line of
Garst Street with the westerly line of Prairie Avenue
in said City; said intersection being the most north-
easterly corner of a parcel of land Quit-claimed to
Metal Resources Corporation by Penn Central Corpora-
tion in document numbered 8103153 in the Office of the
Recorder of St. Joseph County, Indiana; thence North
89°-46 ' -31" West, along the South line of Garst Street
and said South line projected, said line being a
northerly line of said Quit-claimed parcel, a distance
of 582 .58 feet to the East line of the Northwest Quar-
ter of said Section 14 ; thence North 89°-58 ' -10" West,
along a northerly line of said Quit-claimed parcel a
distance of 504 .59 feet to the most northeasterly cor-
ner of a parcel of land deeded to Metal Resources Cor-
poration by Albert Davidson in document numbered
8101507 in said Recorder 's Office; thence continuing
North 89°-58 '-10" West, along the northerly line of
said Davidson parcel a distance of 201.61 feet; thence
South 67°-39 ' -57" West, along the northwesterly line
of said Davidson parcel, a distance of 330 .91 feet;
thence South 0°-07 ' -28" West, along the westerly line
of said Davidson parcel, a distance of 1108 .76 feet to
a northerly corner of a parcel of land deeded to
Shirley R. Steinmetz, et al, in document numbered
7903987 in said Recorder ' s Office, said corner being
the point of tangency of a curve concave north-
westerly, said curve having a radius of 272.37 feet
and being subtended by a chord of 316 . 13 feet which
bears South 35°-35' -57" West, said curve being the
most westerly boundary of said Steinmetz parcel;
thence southwesterly, along said curve along an arc of
337 .27 feet; thence for the next six courses along the
southerly and easterly lines of said Steinmetz parcel,
North 76°-46 '-03" East, along a non-tangent line, a
distance of 175 .60 feet to a point of curve; thence
along a curve to the right, an arc distance of 170.42
feet, said curve having a radius of 523.66 feet and
being subtended by a chord of 169 .67 feet which bears
North 86°-05' -27" East; thence South 84°-35 '-l0" East,
a distance of 56 .24 feet to the West line of a tract
conveyed to South Bend Tribune Corp. by Warranty Deed
recorded in Deed Record 823 , p. 386 in said Recorder 's
Office; thence North 00-43 ' -50" East, along said West
line, a distance of 7 .30 feet; thence North
59°-05 ' -32" East along the northwesterly line of said
tract, a distance of 325 .48 feet to the most westerly
corner of a tract Quit-claimed to Indiana Bell Tele-
phone Co. , Inc. in Deed Record 665 p. 463; thence
North 28°-48 '-14" East, along the northwesterly line
of said Indiana Bell parcel, a distance of 228. 26
feet; thence North 61°-46 ' -50" West, a distance of
309 .05 feet, to a point which bears South 610-46 ' -50"
East, a distance of 28 .00 feet from the most southerly
corner of said Penn Central Quit-claim parcel
described in document numbered 8103153 ; thence North
28°-15 ' -41" East, parallel with a southeasterly line
of said parcel, a distance of 998. 17 feet, to a point
on a southerly line of said Penn Central parcel;
thence South 890-58 '-10" East, along said southerly
line, a distance of 212.73 feet; thence South
89°-46 ' -31" East, along a southerly line of said par-
cel, a distance of 558 .69 feet to said westerly line
of Prairie Avenue; thence North 28°-06 ' -58" East,
along said westerly line to the point of beginning,
containing 18 .21 acres, more or less.
EXCEPTING THEREFROM that part described as beginning
at the point of intersection of the Westerly
right-of-way line of Prairie Avenue with the South
right-of-way line of Garst Street in said City, said
intersection being the most northeasterly corner of a
parcel of land Quit-claimed to Metal Resources Corpo-
ration by Penn Central Corporation in document num-
bered 8103153 in the Office of the Recorder of St.
Joseph County, Indiana; thence South 28°06 ' 58" West,
along said Westerly right-of-way line of Prairie Ave-
nue, a distance of 50 .99 feet to a South line of said
Metal Resources parcel; thence North 89°46 '31" West,
along said South line a distance of 558 .69 feet;
thence North 89°58 ' 10" West, along said South line, a
distance of 212.73 feet; thence North 28°15 ' 41" East,
a distance of 51. 15 feet to a Northerly line of said
Quit-claimed parcel; thence South 89°58 '10" East,
along said Northerly line, a distance of 188 .67 feet
to the East line of the Northwest Quarter of said Sec-
tion 14 ; thence South 89°46 ' 31" East, along said South
right-of-way line of Garst Street and its projection,
a distance of 582. 58 feet to the place of beginning
containing 34 ,761 square feet (0 .80 Acres) more or
less, leaving 17 .41 acres, more or less, after said
exception.
PARCEL II
A parcel of land being a part of the North Half of
Section 14 , Township 37 North, Range 2 East, City of
South Bend , Portage Township, St. Joseph County,
Indiana, being more particularly described as follows :
Commencing at a point in the West line of Prairie Ave-
nue, 45 .00 feet South, by rectangular measurement,
from the South line of Garst Street in said City;
thence South 28°16 ' 39" West, along said West line of
Prairie Avenue, a distance of 945 .84 feet to the place
of beginning for this description; thence continuing
South 28°16 '39" West, along said West line of Prairie
Avenue, a distance of 90 .00 feet to the Northerly line
of a parcel of land conveyed to L & A Enterprises by
deed recorded as instrument number 8218566 in the
Office of the Recorder of St. Joseph County, Indiana;
thence North 61°44 ' 13" West, along said Northerly
line, a distance of 370.15 feet to the Westerly line
of said L & A Enterprises tract of land; thence South

28°19 ' 18" West, along said Westerly line, the Westerly
line of a parcel of land conveyed to L & A Enterprises
by deed recorded as instrument numbered 8218567 , a
distance of 240 .00 feet to an angle point ; thence
South 28°48 ' 14" West along the Westerly line of a par-
cel of land conveyed to Indiana Bell Telephone Com-
pany, Inc. by deed recorded in Book 665, Page 463 in
said Recorder 's Office, a distance of 85.35 feet;
thence North 61°46 '50" West, along a Northerly line of
a parcel of land conveyed to Metal Resources Corpora-
tion, a distance of 309 .05 feet; thence North
28°15 ' 41" East, along an Easterly line of a parcel of
land conveyed to Metal Resources Corporation, a dis-
tance of 415 .55 feet; thence South 61°44 ' 13" East
parallel with said Northerly line of said L & A Enter-
prises parcel, a distance of 680 .30 feet to the place
of beginning containing 162,063 square feet (3.72
Acres) more or less.
The total acreage of Parcel I and Parcel II is 21. 13
acres, more or less
as an Economic Revitalization Area; and WHEREAS, notice of the
adoption of a Declaratory Resolution and the public hearing
before the Council has been published pursuant to Indiana Code
6-1. 1-12. 1-2-5; and
WHEREAS, the Council held a public hearing for the
purposes of hearing all remonstrances and objections from
interested persons; and
WHEREAS, the Council has determined that the qualifi-
cations for an economic revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council
of the City of South Bend, Indiana, as follows:
SECTION I . That the Common Council hereby confirms
its Declaratory Resolution designating the area described
herein as an Economic Revitalization Area for the purposes of
tax abatement. Such designation is for personal property tax
abatement only and is limited to five (5) calendar years from
the date of adoption of the Declaratory Resolution by the Com-
mon Council.
SECTION II . This Resolution shall be in full force
and effect from and after its adoption by the Common Council
and approval by the Mayor .
