Val A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOWN AS 1145 PRAIRIE AVENUE AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF REAL PROPERTY TAX ABATEMENT WHEREAS, a petition for real property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 1145 Prairie Avenue, South Bend, Indiana, and which is more particu- larly described by a line drawn as follows : A parcel of land in the East Half (1/2) of the Northwest Quarter (1/4 ) of Section 14, Township 37 North, Range 2 East of the Second Principal Meridian in the City of South Bend, County of St. Joseph, State of Indiana, more particularly described as follows, viz : Commencing at the intersection of the South line of Garst Street with the Westerly line of Prairie Avenue; thence South 28°18 ' 06" West along and with the Westerly line of Prairie Avenue, a distance of 50. 99 feet to the Southeast corner of a 45 foot easement, said point being 45 feet South of the South line of Garst Street, by right angle measure- ment; thence North 89°46 ' 31" West along and with the South line of said easement, a dis- tance of 771. 42 feet to the point of begin- ning of this description; thence South 28°15 '41" West a distance of 998. 17 feet; thence South 61°46 ' 50" East a distance of 309. 05 feet; thence North 28°19 ' 18" East a distance of 349. 17 feet; thence North 61°55 ' 11" West a distance of 269. 20 feet; thence North 28°10 ' 14" East a distance of 587. 13 feet; thence North 89°46 ' 31" West a distance of 45.97 feet to the place of begin- ning. Parts of the West Half (1/2) of the Northeast Quarter (1/4 ) and the East Half ( 1/2 ) of the Northwest Quarter (1/4 ) of Section Fourteen (14 ) , Township Thirty-seven (37) North, Range Two (2 ) East of the Second Principal Meri- dian, more particularly described as commen- cing at a point on the West line of Prairie Avenue, 50. 99 feet southwesterly of the South line of Garst Street, as measured along said West line of Prairie Avenue thence North 89°47 ' 48" West along a line 45. 00 feet south of and parallel to the said South line of Garst Street, a distance of 464. 53 feet for a point of beginning; thence South 28°14 '42" West a distance of 708. 65 feet to a point; thence North 61°46 ' 08" West a distance of 229. 20 feet to a point; thence North 28°14 '36" East a distance of 586. 62 feet to a point; thence South 89°47 ' 43" East a distance -2- of 259. 71 feet to the point of beginning, be designated as an Economic Revitalization Area under the pro- visions of Indiana Code 6-1-1 . 1-12. 1-1, et seq. ; and WHEREAS, the Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6-1. 1-12. 1-1, et seq. , and has further prepared maps and plats showing the boun- daries and such other information as required by law of the area in question; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows : SECTION I . That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be desig- nated an Economic Revitalization Area and hereby adopts a resolu- tion designating this area as an Economic Revitalization Area for purposes of real property tax abatement. SECTION II . That this designation shall be limited to ten (10) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION III . That the Common Council directs the City Clerk to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hear- ing before the Common Council on said declaration. SECTION IV.
