BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, THAT: Section 1. Definitions. -- The words and phrases used in €`+a this ordinance are defined and for the purposes of this ordinance shall be construed as follows, except when otherwise expressly provided: The word "vehicle" shall mean every conveyance or device in or by which any person or property is or may be transported on the public highway, except such as are used exclusively on stationary rails- ;. ; • or tracks; for the purposes of this ordinance a baby carriage, tricycle or wheel-chair shall not be deemed a vehicle , but a bicycle or a mounted _ animal shall be comprehended in this definition.. "Driver", means any person propelling or operating any vehicle, or who is in charge of any vehicle for such purpose. II "Person" shall include every natural person, firm or cor- - poration. "Parking" shall consist of allowing a vehicle to stand in a street for a longer period of time than is necessary for the im- mediate and continuous loading or unloading of persons or materials. "Preferential or through street" shall mean any street or portion thereof to the approach of which vehicles shall come to a full stop before entering and on which street traffic shall have the right of way over the traffic crossing over or turning into such street. "Safety Zones" shall be understood as that portion of a street adjacent to street car tracks which is designated by pavement • markings or buttons, stanchions, platforms or official posts or signs for the exclusive use and protection of persons waiting for, boarding or alighting from street ears. "Property line" means the boundy line between the established i street and abutting private property. Section 2. Ordinance Regulations and Rules. -- The driver of every vehicle operated upon the streets within the limits of the City of South Bend, in addition to provisions of the State Laws, shall conform to and observe the following ordinance regulations and rules. Section 3. Automatic Traffic Signals. -- Whenever an automatic signal or device is now or hereafter stationed at any street intersection by the Board of Public Safety, for the control and direction of traffic, it shall be the duty of all persons driving or operating any vehicle to be governed by and obey the color signals of such device according to their meaning as follows: "Amber" means clearance of intersedtion, and no vehicle shall enter the intersection during any of the period that the amber signal is displayed. "Green" means clear right of way and proceed. "Red" means stop. Street cars shall obey automatic traffic signals as well as vehicles. Vehicles in making left turns, at automatic signal inter- sections, except where left turns are prohibited , shall keep?to the right of the center of the intersection, and shall make the turn without interfering with vehicles or cross traffic proceeding con- formable to the green signal. Section 4. Safety Zones. -- The Board of Public Safety shall establish safety zones, for the protection of street car passengers, at such intersections or established street car stops, as may be deemed necessary or proper, which shall be designated by pavement markings or buttons, stanpns, platforms, or official posts or signs. It shall e unlawful for any person to drive a vehicle through, or to the left of, a safety zone, whether occupied or unoccupied by pedestrians. Where safety zones are established, street cars. shall receive passengers from or discharge them into such zones only, unless in cases ' of excessive street car traffic other protection authorized by the -2- u Board of Pablic Safety is provided. Passengers shall enter and leave established safety zones from the crosswalk only. Section 5. No Parking Zones and Restrictions. -- No parking, or standing, of vehicles on any street shall be permitted at any time in the following locations, except in cases of emergency or delays in traffic movement, or by the direction of an officer or automatic signal. a. Within the boundaries of a street intersection, except when waiting to make a left turn -- where left turns are permitted. b. Not less than 15 feet from the extension of a property line at a street intersection. c. Between an established safety zone and the- adjacent curb or within 25 feet of the rear of such zone. d. Across the entranceway of any court, alley or driveway, or within 5 feet of either line thereof. e. In any alley, or in any court within the Vehicular Loop, longer than is necessary to continuously load or unload materials or passengers. f. Within 10 feet of a fire hydrant. g. Within 15 feet of any entrance to a fire station. 0 h. With the right :front and right rear wheels more than one . foot from the curb, where parallel parking only is permitted, or closer than four feet to other vehicles parked parallel. • i. In any public street parallel to any other vehicle parked at the curb on the same side of the street, that is, double . parking is hereby prohibited. /�yy Section 6. Right Turns at Qttersections. -- The driver of a vehicle intending to turn to the reht at any intersection shall approach such intersection on the right hand side of the street nearest the curb, and in turning shall keep as closely as practicable tothe curb. Section 7. Left Turns at ttntersections. -- The driver of a vehicle intending to turn to the left ' at an intersection shall approach such intersection near the center line of the street, and in turning • —3- - - ._ • shall pass to the right of the center of the intersection. • Section 8. No Left Turns at Certain Intersections. -- Left turns by vehicles are prohibited on Michigan Street. at the intersections of Jefferson Boulevard, Washington Avenue, and Colfax Avenue. Section 9. Marking Pavement for Turns. -- Where the street is of sufficient width the Board of Public Safety shall cause two lanes of . i traffic for turns to be designated by markers or signs upon the pavement at congested intersections or where safety zones are established. It shall be unlawful for any driver to fail to turn in accordance with such pavement markings and with any of the rules regarding right and left turns. Section 10. Discharging or Receiving Passengers at Congested Intersections. -- No vehicle shall be permitted to stop at any inter- j section where an automatic signal is stationed, or where a street car safety zone is established, or at any congested intersection, to dis- � charge or receive passengers, and no person shall get on or off any vehicle at such points, unless it is possible for such vehicle to draw close to the curb so as not to obstruct the flow of traffic; and any I such stopping for such purpose shall be for only such length of time as is necessary to discharge or receive passengers immediately, or only as incidental to waiting for a "Go" signal. No vehicle shall load or unload freight or merchandise at any such points. Section 11. By-pass Routes and "Vehicular Loop". -- By-pass routes around the central business section of the city are hereby established. That section of the city bounded by Madison, William, Monroe and St. Joseph Streets, and the St. Joseph River including said boundary streets shall be understood as the "Vehicular Loop" , and such boundary streets, as by-pass routes, shall become preferential or through streets as hereinafter provided. :o. Section 12. Preferential or Through Streets. -- The follow- ! ing streets or portions thereof, except at such intersections where automatic signals are stationed, are hereby designated as preferential or through streets, as defined in Section 1. • -4- Lafayette Boulevard, from the north line of Indiana Avenue to the south line of West Monroe Street, and from the north line • of Madison Street to the south line of Riverside Drive. Colfax Avenue, from the west line of Eddy Street to the east line of Michigan Street and from the west line of William Street to the east line of Walnut Street. Jefferson Boulevard, from the west line of St. Joseph Street to east city limits. Division Street, from the west line of William Street to west city limits. Lindsey Street, from the west line of Portage Avenue to the east line of Blaine Avenue. Madison Street, from the east line of North William Street to the west line of North Michigan Street. William Street, from the south line of West Madison Street to the north line of West Monroe Street. Monroe Street, from the east line of South William Street to the west line of South St. Joseph Street. St. Joseph Street , from the north line of East Monroe Street to the south line of Lincoln Way East. It is hereby provided that vehicles traveling east and west along Jefferson Boulevard, at the intersection of Jefferson Boulevard with St. Joseph Street, shall have precedence over vehicles traveling north and south along St. Joseph Street which shall come to a full stop before entering Jefferson Boulevard at such intersection. i�it� ______,—Section 13. Preferential Intersections. -- The Board of Public u� Safety shall designate any intersection deemed to be especially hazardous 1 as a stop intersection, by causing the same to be marked by appropriate signs which shall be understood to be a "preferential intersection" ac- cording to the meaning and requirements relating to preferential or through streets as defined in Section 1, and all drivers shall be . governed by and comply with the signs and regulations at any such es- tablished preferential intersection, provided, that the Common Council • may establish or re-establish the location of any preferential inter- , section by ordinance duly enacted. Preferential intersections are hereby established at the following points, according to the following regulation: Notre Dame Avenue shall be preferential at the intersection of South Bend Avenue with Notre Dame Avenue. Notre Dame Avenue shall be preferential at the intersection of Corby Street with Notre Dame Avenue. Indiana Avenue shall be preferential at the intersection of Fellow Street with Indiana Avenue. Section 14. All Streets Preferential as to Alleys. -- No person shall drive any vehicle from any alley, court or driveway into a public street without first bringing such vehicle to a full stop at the approaching boundary or property line of such street. After making such stop, the vehicle shall be driven into the street with proper I consideration for the safety of pedestrians and vehicles upon such street, all streets being preferential over all alleys, courts- and driveways-. Section 15. Parallel Parking -- Angle Parkin,. -- All vehicles shall be parked parallel with the curb upon all streets of the 'city; provided, that angle parking at 30 degrees with the curb shall be permissable on Michigan Street from Monroe Street to South Street, and from a point two hundred eighty feet south from the south • line of Bronson Street to Ohio Street on the east side of Michigan Street and to Garst Street on the west side of Michigan Street; provided further that the Board of Public Safety in cases of emergency or public necessity may temporarily provide, by proper pavement markings, for 30. degree angle parking on other streets or at other points outside of the Vehicular Loop, until such time as the Common Council shall change or establish by ordinance such temporary regulations; and provided further, _ I that where the curb is set back from the established curb line of any street where parallel parking only is permitted, vehicles may park at an angle when not so parked as to project over the sidewalk or into the street a greater distance than 7 feet from such established curb line. -6- Section 16. Parking, or Driving, Vehicles on Sidewalk or within Curb Line. -- It shall be unlawful to park, or drive, any vehicle upon any portion of any sidewalk, or pathway used by pedestrians, of any street or court, except in the necessary act of crossing at alleys, courts or driveways; and if a curb line is established, and a curb con- structed, no vehicle shall be parked or driven on any portion of the street lying between such curb and the property line; provided, however, that the provisions of this section as to parking shall not apply to bicycles, and shall not apply to the riding of bicycles on the sidewalks along unpaved streets when the surface of the street is muddy or sandy, but in no such case shall they be propelled without due care for the safety of pedestrians, and at a rate of speed reasonable under all circumstances. Section 17. Hour Parking on Certain Streets. -- Vehicles shall not be parked for a longer continuous period than sixty_minutes, between the hours of 8:00 A. M. and 6:30 P. M. from Monday to Friday inclusive, and between the hours of 8:00 A. M. and 9 :00 P. M. on Saturday of each week, (subject to the provisions of the next following y (subject g section regarding Waiting Zones) on any of the following streets: Michigan Street, from LaSalle Avenue to Division Street. St. Joseph Street, from Lincoln Way East to Wayne Street. Colfax Avenue, from Michigan Street to Lafayette Boulevard. Washington Avenue, from Michigan Street to Lafayette Boulevard. Jefferson Boulevard, from St. Joseph Street to Lafayette Blvd. Wayne Street, from St. Joseph Street to Main Street. Main Street, from LaSalle Avenue to Wayne Street. South Street, from Lafayette Boulevard to William Street. Section 18. Fifteen Minute Waiting Zones. -- To afford short time parking, fifteen minute waiting zones are hereby established, which the Board of Public Safety shall cause to be appropriately marked and designated by signs upon the curb or otherwise, along each portion of the stteets as described in the prededing section, approximately one- , fourth to one-third of the available parking space to be devoted to such I I purposes as the necessities demand, and no vehicles shall park in such -7- � - J waiting zones when so marked and designated by signs for a longer cons tinuous period than fifteen minutes, during the days, and hours thereof, applying to hour parking as stated in Section 17. • Section 19. Loading Zones. -- The Board of Public Safety shall cause zones along the curb to be designated, appropriately marked and designated by signs upon the curb or otherwise, for the loading and unloading of passengers or materials, at office building-=hhtel--and theater--entrances, or at public entrances or points where the general Convenience of the public require, or where unusual quantities of freight or merchandise are loaded or unloaded, the number of such zones, in order to conserve parking space, to be restricted to actual necessities or the public convenience. No parking, as defined in Section 1, shall be permitted in such loading zones, when appropriately . marked and designated by signs. Section 20. Prohibited Parking on Certain Streets. -- Parki--ng of vehicles is prohibited at all times on the streets and bridges, or any portions thereof, described as follows: Center Street, from Michigan Street to Main Street. Polk Street, from LaSalle Avenue to Division Street. LaSalle Avenue, from Main Street to the first alley west of Lafayette Boulevard. Florine Court. Wilber Street, from LaPorte Avenue to Lincoln Way West. LaPorte Avenue, west side, from Washington Avenue to Wilber Street. Sample Street, south tide, from Lafayette Boulevard to west end of Sample Street Bridge. ' Taylor Street, east side, from Washington Avenue to Lincoln Way West. Fellow Street, east side, from New York Central Tracks to Ewing Avenue. Franklin Street, east side , from Sample Street to Indiana •, Avenue. Eddy Street, east side, from Jefferson Boulevard to South Bend Avenue. Division Street, north side, from Taylor Street to Laurel Street. Scott Street, east side, from Colfax Avenue to Lincoln Way West. -8- �� J Olive Street, west side, from Huron Street to Grace Street. 'Putt Street, north side, from Michigan Street to eastern terminus of Tutt Street. Lafayette Boulevard, east side, from Bartlett Street to Riverside Drive. On any rifler bridge within the city, provided that parking shall be permitted on the north side of each the Colfax Avenue and the LaSalle Avenue bridges. All traffic on Leland Avenue and Riverside Drive from the . intersection with California Avenue to and including the turn northwest on Riverside Drive shall slow down, and the Board of -Jafety is directed to erect Caution Signs at such points. Section 21. Signs, Signals and Street Markings. -- The Board of Public Safety shall cause to be placed and maintained official signs, signals and street markings at places and points where necessary and practicable for the guidance, instruction and Regulation of drivers and pedestrians conformable to the provisions of this ordinance, and such signs, signals, directions and markings shall be observed and complied with. Vehicles shall be parked wholly within the pavement markings designating where and how the same shall be parked. Distinct colors for marking the curb shall be used to dis- tinguish severally between Loading Zones, Waiting Zones, and the No- Parking spaces specified in Section 5. No-parking zones and restrictions, as provided in Section 5, shall not be diminished as to territory embraced but may be enlarged by the Board of Public Safety if safety or traffic conditions require. Where a building is in process of construction, rebuilding or rep4,i.ring, such that occupancy of part of the travelled roadway thereby become necessary, and a pErmit so to do is granted, or in any case of emergency requiring that the safety of the highway and traffic upon it be protected, the Board of Public Safety shall cause No-parking cones or spaces to be marked off or properly designated by signs, and such { spaces thus properly marked or designated shall not be utilized for parking. Section 22. Unofficial Traffic Signs--Defacing Signs. -- It shall be unlawful for any person to erect or display any unauthorized -9- sign or device upon or in view of any street, which simulates any official sign or which directs or purports to direct the action of op- erators of vehicles generally or the movement of traffic, or to will- fully deface, mote or remove, injure or interfere with, any sign placed in compliance with the provisions of this ordinance or the directions of the Board of Public Safety pursuant to its provisions. Section 23. Police Supervision of Traffic and Parking. -- Officers of the Police Department, in the discharge of their duties, shall have authority to direct all traffic at all times and places by voice or other signal. The signals and orders of a police officer shall take precedence over any other form of signal or sign, and it shall be unlawful for any person to refuse or fail to comply with any order, signal or other direction of a police officer made for the dispatch and control of traffic. Whenever public safety, necessity or convenience requires, police officers may remove or direct the removal of vehicles from any location or position on any street or public place and it shall be un- lawful for any owner or driver to wilfully disobey any such order. geetion 24. Pedestrian Traffic. -- Except in cases of em- ergency, pedestrians should follow the course of using only the side- walks and crosswalks. The roadbeds of highways and streets are primarily intended for vehicles. Crossing the street at other points than at crosswalks is dangerous and also interferes with vehicular traffic . Pedestrians should give close attention to traffic control signals in crossing streets. Before stepping from the sidewalk to the roadbed pedestrians should look both ways for approaching vehicles. Section 25. Pedestrians on crosswalks have right of way. -- Vehicles making left or right turns shall yield the right of way to I _ pedestrians actually in crosswalks when they are crossing with the signals at traffic controlled intersections. Section 26. Pedestrians crossing the streets at other places. -- i Any- pedestrian crossing a street except at street intersection cross- walks shall yield the right of way to vehicles. -10- • Section 27. Driving to ,Left ontreet Car. -- It shall be unlawful to drive to the left of any moving or standing street ear headed in the same direction, except where street cars are operated upon rails to the extreme side of the travelled highway. Section 28. Additional rules for Vehicles at intersections. -- Vehicles approaching intersections, not under traffic signal control, where the view is obstructed shall slow down, and at all intersections every vehicle shall at all times be under the driver' s control. No vehicle shall pass another going in the same direction at any street intersection, nor shall any vehicle pass another vehicle going in the same direction on any curve where full view of the street ahead is obscured. Section 29. Slowly moving vehicles to keep to right. -- Slowly moving or heavily laden vehicles shall keep as near the right hand side of the travelled roadway as possible , allowing more rapid moving vehicles free passage to their left. Section 30. motor Vehicles following other Vehicles too closely-H The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent having due regard for the speed of such vehicles and the traffic upon and condition of the street. Section 31. That to do on approach of Police of Fire De- partment Vehicle. -- Upon the approach of any Police or fire Department vehicle or vehicles giving audible signal by bell, siren, or other signal device, the driver of every other vehicle shall immediately drive the same toaa position as near as possible and parallel to the right hand side of the street, clear of any street intersection, and remain in such position unless otherwise directed by a police or traffic officer or until the police og fire department vehicle or vehicles shall have passed. Section 32. Following Fire Department Vehicle. -- It shall be unlawful for the driver of any vehicle other than one on official business to follow any fire apparatus traveling in response to a fire alarm closer than 500 feet or to drive into or park such fehicle with- in the block where fire apparatus has stopped in answer to a fire alarm. Section 33. Left side of Vehicle to curb. -- It shall be • -11- unlawful to park any vehicle in a street with its left side to the curb , or to approach the curb in any such manner for parking or loading or unloading purposes. Section 34. Vehicles loading at right angles to the Curb. -- No vehicle shall be permitted to stand at right angles to the curb for loading or unloading purposes except under conditions where it is im- possible, or an extreme hardship, to do otherwise. Section 35. Making Complete Turn in Street. -- No vehicle shall make a complete or "U" turn in any street within the. Vehictlar . .Loop for the purpose of going in the opposite direction, either at in- tersections orTh-ktween intersections. No such turns shall be made in any other street in the city, if by so doing it interferes with other vehicles. Section 36. Vehicles for Advertising. -- No vehicle, while 1 being used exclusively for advertising purposes, shall be driven u*on any street within the Vehidular Loop. Section 37 . Loads extending to Rear. -- A vehicle when loaded with material projecting more than five feet beyond the rear of the vehicle shall be provided by a visible cloth or flag by day and a red light by night on the extreme rear end of such load. Section 38. Driving through Funeral or other Procession. -- It shall be unlawful for any person to drive any vehicle through or interfere with any civic, military or funeral procession. Section 39. Repairing Vehicles in Street. -- It shall be unlawful to repair any vehicle in any street except in cases of emergency, Section 40. Extra passenger on Motor Cycle or Bicycle. -- I No rider of a motor cycle or bicycle on the streets of South Bend shall carry any other person on such motor cycle or bicycle except upon a _ special seat provided to the rear of the operator or in a side-car. Section 41. Occupancy of Vehicle. -- No vehicle shall be driven upon the streets of South Bend with more than two persons in addition to the driver occupying the front seat , provided that this provision shall not apply to a child, under 12 years of age, seated upon the lap of another person in the front seat in such manner as not -12- J to hamper the driver in controlling such vehicle; nor shall any vehicle be driven with persons on the fenders, running board, or hood, or with any part of their bodies extending beyond the side or rear lines of the body of the vehicle. Section 42. Embracing while driving Vehicles. -- It shall be unlawful for any person to embrace any person while operating any vehicle on the streets of South Bend, or for any person to so operate a vehicle while being subjected to the embraces of any other person; and it shall be unlawful for any person to embrace any person so operating any vehicle. Section 43. Streets divided by Parkway. -- On all streets divided by parkways, walks, viaduct pillars or electric light standards, vehicles shall keep to the right of such division. Section 44. All night Parking,. -- It shall be unlawful for any person to park ariy vehicle continuously from two o 'clock A. M. until five o'clock A. M. on any day upon any paved street within the city. Section 45. Bus Loading Zones and Taxi Stands. -- For the • 1 convenience of the public, zones for the loading and unloading of passenger busses, and the temporary stationing thereof, and zones or stands for' taxi-cabs, are hereby established, which the Board of Safety shall cause to be appropriately marked and designated by signs upon the curb or otherwise, and no other vehicles shall be permitted to park in such zones or stands when so marked and designated. Section 46. Shrubs and plants in the street as obstructions to be removed. -- It shall be unlawful for any person to plant or 1I • permit to grow any shrub or plant at or near any street intersection between the property line and the curb which obstructs or tends to obstruct the view of operators of vehicles or of pedestrians (including children) , and in ho ease shall any shrub or plant be allowed to grow at any such point to a height exceeding two and one-half feet. All such shrubs or plants shall be trimmed or cut back by the owners or i I Occupants of abutting property to comply with the requirements of this -13- ordinance, or if such is not possible or practicable, then the same shall be entirely removed from such part of the street within 90 days after the passage and taking effect of this ordinance under the supervision of the Chief of Police. Section 47. School Zones. -- It shall be lairful for the Board of Public Safety to designate by appropriate signs points in the vicinity of public, private or parochial schools cautioning drivers of the pres- enoe of school children and to slow down their vehicles, and it shall be unlawful for drivers to refuse or neglect to obey such signs. Section 48. Zones of Quiet. -- The Board of Public Safety may declare any street or alley within two hundred feet of a hospital, infirmary, sanitarium, school, church or sick chamber to be Zones of Quiet, and when properly designated by signs by authority of the Board of Public Safety there shall be no ringing of bells, sounding of gongs or unnecessary noises within such zone. Section 49. Penalties for violatin . -- Every person convicted of a violation of any of the provisions, rules or regulations of this ordinance shall be punished by a fine of not more than Twenty-five Dollars; for any second or subsequent offense committed within one year after the first conviction, such person shall be punished by a fine of not less than Five Dollars nor more than Fifty Dollars, to which may be added imprisonment in the county jail for a period not exceeding Thirty days, and in the event of a fine being assessed such convicted person shall be confined in the county jail until such fine and the costs are paid or replevied. Section 50. Saving Clause. -- If any section or provision of this ordinance shall be construed or held as void, it shall not affect the validity of any other provision or section which if standing alone shall be held valid. Section 51. Repeal. -- All ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 52.
