Presented by me to the Mayor of the City of South Bend, Indiana 192 t' 4l City Clerk or Approved and signed by me G — 192 r a �"�"�``"�`� Mayor O • ORDINANCE NO. 1d AN ORDINANCE PROVIDING FOR AND AUTHORIZING AND DIRECT- ING THE SALE OF CERTAIN REAL ESTATE HERETOFORE USED FOR PARK PURPOSES Be it ordained by the Common Council of the City of South Bend, Indiana. SECTION 1. That, WHEREAS, the City of South Bend, Indiana, is the owner of the following described real estate, situate in St. Joseph County, Indiana, to-wit: A tract or parcel of land situated in the South- east Quarter of the Southeast Quarter of Section 12, Town- ship 37 North, in Range 2 East of the Second Principal Meridian in the City of South Bend, Indiana, bounded by a line running as follows, viz: Beginning at a point one hundred and seventeen and three-tenths feet (117. 31) south, measured on the section line, and ten feet (10') west of the Southeasterly corner of Lot 20 in August Beyer's First Addition to South Bend, Indiana, and running thence South parallel with and ten feet (lot) west of the east line of said Section 12, one hundred and twenty feet (120') ; thence West at right angles to said section line one hundred sixty feet (1601) ; thence north one hundred and twenty feet (1201) ; thence east one hundred and sixty (160) feet to the place of beginning, which said real estate is owned by said City for park purposes; and WHEREAS, the Board of Park Commissioners of said City have, after due and proper deliberation, resolved that said real estate should be sold and have duly requested this Council to pass an Ordinance authorizing and directing said Park Board to sell said real estate as other real estate is sold, belonging to said City, and has prepared and submitted this Ordinance for the consideration of this Council, which sale or sales of said real estate shall be made for not less than the fair cash value as fixed by three dis- interested freeholders of the said City, which freeholders shall be appointed by the Judge of the St. Joseph Circuit Court of St. Joseph County, Indiana. SECTION 2. That the proceeds of such sale shall be credited to the Department of Public Parks and expended by the Board of Park Commissioners as by law provided. SECTION 3. That the Judge of the St. Joseph Circuit court be respect- fully requested to appoint three (3) disinterested freeholders of the City of South Bend, Indiana, to act as appraisers of the real estate above described. - 1 - • • • • SECTION 4.
