RESOLUTION NO.
A RESOLUTION OF THE COMMON COUNCIL
OF THE CITY OF SOUTH BEND, INDIANA,
COMMENDING THE ST. JOSEPH COUNTY COUNCIL
FOR ITS POSITION ON THE UTILIZATION OF
TOLL ROAD REVENUES AND SUPPORTING THAT POSITION
WHEREAS, the principle and interest upon bonds issued by the
State of Indiana or its Toll Road Finance Authority in the purpose of
financing construction of the Indiana Toll Road or funding the original
financing thereof or reimbursing costs incurred in connection therewith
have been fully paid and such bonds redeemed; and
WHEREAS, pursuant to I.C. 8-15-2-23, the Toll Road Finance
Authority of the State of Indiana is authorized to continue to levy and
collect tolls on the Indiana Toll Road for an indeterminate period
after full payment of such bonds and interest thereupon, and to utilize
the proceeds thereof for various specified purposes other than the
maintenance and operation of such Toll Road ; and
WHEREAS, such purposes include the funding of Toll Road
projects in portions of the State of Indiana other than those served by
such Indiana Toll Roads ; and
WHEREAS, the vast majority of persons utilizing such Indiana
Toll Road and paying tolls thereon reside within those counties of
Indiana wherein such Toll Road is located ; and
WHEREAS, the Common Council of the City of South Bend is of
the opinion that the proceeds of tolls paid by users of the Indiana
Toll Road should be utilized in those areas of the State wherein the
vast majority of such users reside, and that to utilize the proceeds of
such tolls in areas of the State other than those in which the vast
majority of such users reside would be an unfair and inequitable burden
upon such users and an unwarranted benefit to those residents of other
areas within the State wherein such proceeds may be applied ; and
WHEREAS, on January 7 , 1986 , the St. Joseph County Council
passed Resolution No. RO1-86 requesting that the Indiana Toll Road
Authority utilize proceeds from the collection of tolls on the Indiana
Toll Road for the maintenance and operation of such Toll Road or for
the maintenance, operation or construction of other public highways
within those counties of the State of Indiana wherein such Toll Road is
located and further requesting that the Indiana General Assembly adopt
legislation prohibiting the Toll Road Finance Authority from utilizing
the proceeds of the tolls collected on the Indiana Toll Road for any
other purpose.
NOW, THEREFORE, BE IT ORDAINED by the Common Council of the
City of South Bend , Indiana, as follows :
Section I . The St. Joseph County Council is hereby commended
for its leadership and foresight in adopting Resolution No. RO1-86
concerning the utilization of tolls collected on the Indiana Toll Road
by the Indiana Toll Road Finance Authority.
Section II. The Common Council of the City of South Bend
hereby joins the St. Joseph County Commissioners in requesting that the
Indiana Toll Road Finance Authority utilize proceeds from the
collection of tolls on the Indiana Toll Road for no purpose other
than:
a. The operation and maintenance of such Toll
Road ;
b. The financing of other road or such projects
within those counties of Indiana wherein such
Toll Road is located .
and that the Indiana General Assembly adopt legislation prohibiting
the Indiana Toll Finance Authority from utilizing the proceeds of tolls
collected on the Indiana Toll Road for any purpose other than:
a. The operation and maintenance of such
Toll Road ;
b. The financing of other road or such projects
within those counties of Indiana wherein such
Toll Road is located .
Section III. This Resolution shall be in full force and
effect from and after its adoption by the Common Council and its
approval by the Mayor.
