SF Presented by me to the Mayor of the City of South Bend, Indiana October 29 , 19 85 y.L¢_.k_ i\----.— / N__ce,_.___ City Clerk Approved and signed by me 04, a 5 19 & S. 7, Ai- Mayor RESOLUTION NO. 13(,?, A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND DESIGNATING CERTAIN AREAS WITHIN THE CITY COMMONLY KNOW AS AIRPORT INDUSTRIAL PARK, PHASE III LOT 5-1 AN ECONOMIC REVITALIZATION AREA FOR PURPOSES OF PERSONAL PROPERTY TAX ABATEMENT. WHEREAS a petition for personal property tax abatement consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as Airport Industrial Park-Phase III Lot 5-1 , , South Bend, Indiana and which is more particularly described by a line drawn as follows : A part of the Southeast Quarter of Section 28, Township 38 North, Range 2 East, St. Joseph County, Indiana , described as follows: Commencing at the northeast corner of said quarter section; thence South 89°58 '56" West a distance of 1582 ,51 feet along the north line of said quarter section to the point of beginning; thence South 0° 21 ' 33" West a distance of 375. 00 feet; thence South 89°58"56" West a distance of 709 .63 feet; thence North 0° 00'47" East a distance of 375 .00 feet to the south boundary of Boland Drive ; thence North 89° 58'56" East a distance of 711 .90 feet along said south boundary to the point of beginning and containing 6.119 acres, more or less. The above tract of land is subject to a drainage course right-of- way described as follows : A part of the Southeast Quarter of Section 28, Township 38 North, Range 2 East, St. Joseph County, Indiana described as follows: Beginning on the north line of said quarter section South 89 degrees 58 minutes 56 seconds West 2194,41 feet from the northeast corner of said quarter section; thence South 0 degrees 00 minutes 47 seconds west 375 . 00 feet; thence South 89 degrees 58 minutes 56 seconds West 80.00 feet; thence North 0 degrees 00 minutes 47 seconds East 375.00 feet to the north line of said quarter section; thence North 89 degrees 58 minutes 56 seconds East 80.00 feet to the point of beginning and containing 0.689 acres, more or less . The above tract of land is encumbered by the following easements : 1 . An easement 20 feet in width off the entire most westerly side in favor of Chicago South Shore and South Bend Railroad. 2 . An easement 50 feet in width off the entire north side in favor of Indiana & Michigan Electric Company be designated as an Economic Revitalization Area under the provisions of Indiana Code 6-1 .1-12 .1-1 , et seq. ; and 2'_ WHEREAS, the Redevelopment Commission has concluded an in- vestigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6-1 .1-12 .1-1 , et seq. , and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in question; and WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area . NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana as follows : SECTION I. That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be designated an Economic Revitalization Area and hereby adopts a resolution designa- ting this area as an Economic Revitalization Area for purposes of personal property tax abatement. SECTION II. That this designation shall be limited to five (5) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION III. That the Common Council directs the City Clerk to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. SECTION IV.
