HomeMy WebLinkAboutAuthorizing the Mayor to Submit an Application for a Grant - 821 Portage AvenueRESOLUTION 3706-07 Passed by the Common Council of the City of South Bend, Indiana February 12, 20 07 Attest: City Clerk President of Common Council Presented by me to the Mayor of the City of South Bend, Indiana February 13, 20 07 Approved and signed by me February 13 20~~ City Clerk ~Y~' RESOLUTION NO. ~ ~°~~6~ A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA, AUTHORIZING THE MAYOR TO SUBMIT AN APPLICATION TO THE INDIANA DEVELOPMENT FINANCE AUTHORITY FOR A GRANT FROM THE PETROLEUM REMEDIATION GRANT INCENTIVE PROGRAM FOR 821 PORTAGE AVENUE WHEREAS, the Indiana Development Finance Authority is administering the Petroleum Remediation Grant Incentive program for remediating petroleum contamination at brownfield sites; and WHEREAS, the maximum grant amount is $250,000 and is to be used for a single project; and WHEREAS, an environmental assessment of 821 Portage Avenue has determined that there are multiple underground storage tanks and has determined that the removal of the underground storage tanks and potential environmental remediation will be needed for future development of this site; and WHEREAS, the City of South Bend would like to apply for funds from the Petroleum Remediation Grant Incentive program to pay for the removal of the underground storage tanks and for cleanup of contamination caused by petroleum products at 821 Portage Avenue; and WHEREAS, the Mayor is the Chief Executive Officer of the City and is the appropriate applicant for the grant from the Petroleum Remediation Grant Incentive program. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Mayor of the City of South Bend, Indiana, is hereby authorized to submit a grant application in the maximum amount of $250,000 to the Indiana Development Finance Authority for a grant from the Petroleum Remediation Grant Incentive program and to execute all documents related to the Petroleum Remediation Grant Incentive. SECTION II. That the Mayor of the City of South Bend, Indiana, shall file with the Common Council a complete copy of the Petroleum Remediation Grant Incentive application to be submitted to the Indiana Development Finance Authority. SECTION III. That for every activity, project, or program to be funded under this resolution, the Mayor shall submit to the Common Council an appropriation ordinance prior to expenditure of any funds received from the Indiana Development Finance Authority. SECTION IV. That the City of South Bend, Department of Community and Economic Development is hereby designated as the agency and office administering, on behalf of the City of South Bend, the Petroleum Remediation Grant Incentive awarded under this application. SECTION V. KENDALL EXECUTIVE DIRECTOR January 31, 2007 To Whom It May Concern: The Department of Community and Economic Development (CED) is requesting the adoption of the following resolution which gives authority for the CED to apply for farads from the Petroleum Remediation Grant Incentive (PGRI) program, which is administered by the Indiana Development Finance Authority. These funds would be used to remove underground storage tanks and associated remediation for the property located at 821 Portage Avenue. The PGRI guidelines require that a political subdivision apply far the grant. However, eligible projects include those done in partnership with the private property owner. In 2004, the current owner of this property was selected to participate in the City of South Bend's USTFields Pilot Grant Progranl and began going through a process to have the tanks removed, which included having a Phase I Environmental Site Assessment completed. This property was selected to participate in the pilot grant program after citizen participation steering committees were asked to identify sites which were thought to have potential but would not likely be redeveloped due to the perception of the presence of contamination. From the list of twenty-five identified properties, CED selected four properties to participate in the program based on redevelopment potential, potential responsible party status.. ownership and willingness of owners to participate. The property was placed third in line for removal of tanks and the two higher priority locations ultimately utilized all the available fiends. As such, the tanks at 821 Portage Ave. were never removed. The property owner is still interested iIl removing the tanks from this location in hopes of redeveloping the site. By pursuing this grant to remediate private property, the City would be acting in public interest. This site was identified by the public as a key property on Portage Ave. which might not be developed due to the perception to contamination. Also, CED has recognized the redevelopment potential of the site resulting in its selection to participate in the pilot grant program: According to the completed Phase I Assessment, this fornler gas station went out of business in 1984, remaining vacant ever since, except for in 2000 when a commercial COMMUNITY DEVELOPMENT ECONOMIC DEVELOPMENT FINANCIAL & PROGRAM PAMELA C. Portage Ave. is considered one of the main corridors that bring people into Downtown South Bend, and as such many people see this vacant former gas station on a daily basis, `contributing to the negative image of the surrounding area for more than 20 years. This property was located across Portage Ave. from an underutilized and dilapidated commercial structure, until 2006, when the City of South Bend purchased and demolished the commercial buildings. It is anticipated that this land will be developed as single family housing, however being located across from 821 Portage Ave, in its current state, does not strengthen the potential for the development of the area. Even though this would be an investment on private property, the removal of the underground storage tanks will help facilitate the private development of this property, which will have a positive impact on the future development across the street and will ultimately improve the overall image of Portage Avenue and the surrounding neighborhood.
