AN ORDINANCE PROVIDING FOR AND AUTHORIZING AND DIRECT-
ING THE SALE OF CERTAIN REAL ESTATE HERETOFORE US-
ED FOR PARK PURPOSES
Be it ordained by the Common Council of the City of South
Bend, Indiana.
SECTION 1.
That, WHEREAS, the City of South Bend, Indiana, is the
owner of the following described real estate, situate in St. Joseph
County, Indiana.,
A parcel of land not over 200100 -feet in width in
the City of South Bend, St, Joseph County, Indiana, lying
between the west boundary line of Kreighbaum Park, so called,
and the West line of an alley paralleling and being distant
Westerly at right angles 166.20 feet from the Westerly line
of Lincoln Way East, so called, said parcel of land being
measured not to exceed 100.00 feet at right angles from each
side of a center line described as follows:
Beginning at a point on the Westerly line of Lincoln Way
East so called, which is distant Northerly 22.35 feet from
the Southeast corner of Lot K of Wenger and Kreightbaum Vistula
Avenue Addition; thence Westerly along a tangent line, mak ing
a Northwesterly angle of 89 -26t-00" with aforesaid Westerly -
line of Lincoln Way ast, a distance of 3.56 feet to the point

ly around said 6U-00*-00" curve to its intersection with above
mentioned West alley line, said point of intersection being •
the true point of beginning; thence continuing Westerly around
aforesaid 6°-00t-00" curve to a point on the above mentioned
Westerly line of Kreighbaum Park, which is distant Northerly
122.27 feet from. the intersection of said-Westerly line with
above mentioned tangent line. Said tangent line intersects
the center line of the New York Central Railroad Companyts
westbound main track 497.12 feet Easterly from the center line
of High Street.

Excepting therefrom an irregular shaped parcel of land F
described as beginning on the above described West alley line
and being distant Northerly 26.2 feet from the intersection of
the tangent of above described 6°-00"-00* curve with the afore-
said West alley line; thence Westerly along a straight course
at right angles to above described West alley line, a distance
of 75.00 feet to a point; thence Southerly long a straight
. course, making a Southeasterly angle of 102 -Olt-00" with last
described course, a distance of 95.5 feet to a point; thence
Easterly around a 5°-26*-00" curve to the left to a point on
aforementioned West alley line and which is distant Southerly
113.8 feet `from the above described point of beginning; thence
Northerly along aforesaid West alley line a distance of 115.8
feet to the point of beginning.
The net area of the above described parcel of land being
1.078 acres, more or less.

An irregular parcel of land in the N.W. 1 of
Section 18, Township 37niNorth, Range 3 East, in the
City of South Bend, St. Joseph County, Indiana, being
all of the tract of land lying between the center line
of North Shore Boulevard and the low water line of the
St. Joseph River, 200 feet in width, located 100 feet
on either side of the center line of the proposed new
right of way of the Grand Trunk Railway and measured
at right angles therefrom; said center line being located
and described as followss
Beginning on the Southerly line of Mishawaka
Avenue, as platted and laid out in the Northwest Quarter
(1/4) of Section 3ighteen i8), Township Thirty-seven
(37) North, Range Three (31 East, in the City od South
Bend, in said County, at a point Nine Hundred and 'Fifty-
I one Hundredths (900.51) feet from the intersection of
the east line of Eddy Street with the Southerly line of
Mishawaka Avenue, which point is One Hundred Fifty-five
and Fifty-one Hundredths (155.51) feet easterly from the
Northeast corner of hot Numbered Fourteen (14) in the Re-
plat of Beyer's Second Addition to the City of South Bend,
as recorded in Plat Book 12 at Page 24 of the records of
said county, all measurements to be made along the southerly
line of said Mishawaka Avenue„ thence South Fifty-three
(53) degrees eighteen (18) minutes west (making an angle of
seventy (70) degrees forty-six (46) minutes with the
southerly line of said Mishawaka Avenue) to the St. Joseph
River,
which real estate is owned by said City for park purposes; and
WHEREAS, the Board of Park Commissioners of said City
have, after due and proper deliberation, resolved that said real
estate should be sold and have duly requested this Council to pass
an Ordinahee authorizing and directing said Park Board to sell said
real estate as provided by law and has prepared and 'submitted this
Ordinance for the consideration of this Council, which sale or sales
of said tracts shall be made for not less than the fair cash value
as fixed by three (3) disinterested freeholders of said City, who
shall be appointed by the Judge of the St. Joseph Circuit Court of
St. Joseph County, Indiana.
SECTION 2.
That the proceeds of such sale, or sales, shall be credited
to the Department of Public Parks and expended in the improvement of
the remaining park lands in the City of South Bend, Indiana, or in
the purchase of other lands for park purposes for the said City of
South Bend, as the said Board of Park Commissioners may deem for the
best interests of said city.
SECTION 3.

That the Judge of the St. Joseph Circuit Court be
respectfully requested to appoint three disinterested freeholders
in the City of South Bend, Indiana, to act as Appraisers for the
real estate hereinabove described.
SECTION 4.
This Ordinance shall be in full force and effect from
and after its passage and approval, by the Mayor.
