Mayor ORDINANCE NO. 0 2/(?t AN ORDINANCE AMENDING ORDINANCE NUMBER 2653 COMMONLY KNOWN AS THE "TRAFFIC ORDINANCE" Be it ordained by the Common Council of the City of South Bend, Indiana. SECTION 1. That Section 19 of said Ordinance Number 2653, enacted August 8, 1927, be re-enacted and amended, which section as amended and hereby re-enacted shall read as follows, to-wit: "SECTION 19.--The Board of Public Safety shall cause zones along the curb to be designated, appropriately marked and designated by signs upon the curb or otherwise, for the loading and unloading of passengers or ,materials, at office • building, hotel, and theater entrances, or at public entrances or points where the general convenience of the public requires, or where unusual quantities of freight or merchandise are load- ed or unloaded, the number of such zones, in order to conserve parking space, to be restricted to actual necessities or the public convenience. No parking, except temporarily for loading or unloading persons or materials, as defined in Section 1, shall be permitted in such loading zones, when appropriately marked and designated by signs; no parking, except temporarily for loading or unloading persons or materials, as defined in Section 1, shall be permitted in any public street parallel or adjacent to any other vehicle parked at the curb on the same side of the street, that is, double parking is hereby prohibit- ed; provided, however, that the loading or unloading of- materials from vehicles unattended by a competent and legal driver shall be permitted in the zones or positions designated in this sec- tion only from delivery trucks or from such vehicles as are plainly and outwardly designated or marked by appropriate signs as delivery vehicles; provided further that a vehicle attended by a competent and legal driver shall not be understood as park- ed when standing temporarily in the zones or positions designat- ed in this section 'for persons or materials intended to be load- ed or unloaded to or from said vehicle, but such driver shall move his vehicle immediately if interfering with the movement of any other vehicle or with general traffic; and provided further that no vehicle shall be permitted to stand or stop for any pur- pose at any point on or along any street parallel or adjacent to a vehicle parked between it and the curb within 30 feet of a pro- hibited zone at any street intersection. " • SECTION 2. That Section 18 of Ordinance Number 2653 as originally passed, be re-enacted and amended and which section as amended shall read as follows, to-wit: "For purposes of short time parking, 15 minutes parking or waiting zones may be established by the Board of Public Safety, which said Board shall cause to be appropriately mark- ed and designated by signs upon the curb or otherwise, at such points as .convenience or necessity may require, and no vehicle shall park in such waiting zones when so marked and designated for a longer continuous period than 15 minutes, during the days' and hours thereof, applying to hour parkin,. as stated in Section 17. " ±. SECTION 3. That the definition of "Parking" as stated in Section 1 under the heading "Definitions" in said Ordinance Number 2653 be amended to read as follows, to-wit: "Parking" shall mean the standing of a vehicle otherwise than temporarily for the purpose of loading 0)) aNi. unloading persons or materials, or in obedience of traffic regulations or traffic signs or signals. " SECTION 4. That Section 2 of Ordinance Number 2707, which re-enacted Subdivision "i" of Section 5 of Ordinance Number 2653 and related to double parking, is hereby repealed. SECTION 5. That Section 21 of Ordinance Number 2653 be and the same is hereby amended by adding to said Section 21 as another additional provision thereof, the following, to-wit: "The Board of Safety is hereby authorized to make and . enforce temporary regulations to cover emergencies, additional and special conditions until such time as the Council by Or- dinance shall provide or alter such emergency or additional regulations; provided, however, that proper marking or signs fle.CC) designate such emergency and additional regulations. " SECTION 6.. That all other provisions of said Ordinance Number 2653 and the amendments thereto including penalties; save and except as modified by this ordinance, shall remain in full force and effect.
