Presented by me to the Mayor of the City of South Bend, Indiana �`c .t .2 7 0 — City Clerk Approved and sinedby me adt / t 1927 Mayor -c911, ORDINANCE N0. a 754 ORDINANCE REGULATING AND LICENSING, CERTAIN OCCUPATIONS AND PROVIDING A PENALTY FOR TAE VIOLATION THEREOF BE IT ORDAINED by the Common Council of the City of -South Bend, Indiana. SECTION 1. That it shall be unlawful for any person, firm, or corporation, to exhibit or participate in exhibiting in the City of South Bend, Indiana, any Carnival or Street Fair or any other display or performance of the same general description for which a 1 fee or reward is charged or received, either directly or indirectly, without first having obtained and received a license for the same from the City Controller. SECTION & Any .person, firm, or corporation desiring to exhibit or participate in exhibiting a Street Fair or Carnival in said city shall, before beginning such exhibition, pay to the Treasurer of the • City a license fee of Three Hundred, ($300.00) Dollars for the first • day of such exhibition, and the further sum of One Hundred and Fifty ($150.00) Dollars for each additional day,th reafter. In addition to the license fee above provided for, such ' , firm, or corpora- tion shall pay said Treasurer the further sum of Fifty ($50.00 Dollars for each day, in advance, for each individual side show and amusement device included in or connected with such carnival or street fair. Upon ,the presentation to the Controller of the City, of the receipt received from the Treasurer for such payment or pay- ments, :said Controller shall issue a license to said applicant, which • license shall recite the time when and the place where such Street Fair or Carnival will be held, together with the number of side shows included in it, provided that applicants for license shall at all times be subject to the ordinances of the city and the laws of the State, and the Controller may, in his discretion, refuse to grant any such license when he has reasonable cause to believe that the giving of any proposed exhibition would be a violation of any such ordinance or law. Provided, however, that the terms of this ordinance shall not apply to Carnivals connected with and exhibiting upon the grounds used by a County Fair Association during the time any association shall be conducting a county fair in the said City. SECTION 3.4... No license granted under the provisions of this ordinance shall be transferrable. ,. SECTION A. All ordinances-in conflict herewith arebereby repealed. SECTION 5. Any person, firm, or corporation violating any of the provisions of this ordinance shall be fined in any sum not exceeding Three Hundred ($300.00) Dollars, and each day's violation shall con- stitute a. separate offense. - 1 - i SECTION, 6.
