WHEREAS , the South Bend Scrap and Processing Division desires
to continue to operate the Prairie Avenue scrap yard within One
Thousand ( 1 , 000) feet of , but not closer than Five Hundred (500)
feet of , said Zoning Use Districts .
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of South Bend, Indiana, as follows :
SECTION I . That the license applications for the following be
approved based upon the satisfactory review of the properties by the
Department of Code Enforcement and the Fire Department Prevention
Bureau, inspections having been made in April , 1987 , and subsequent
favorable recommendation by the Board of Public Works :
South Bend Scrap and Processing Div. 3113 S . Gertrude
of Sturgis Iron & Metal Co . , Inc .
South Bend Scrap and Processing Div. 1305 Prairie Ave .
of Sturgis Iron & Metal Co . , Inc .
SECTION II . That the operation of the scrap yard at the
Prairie Street property shall be subject to the following
conditions :
(a) That no shredders shall be allowed to operate at
this location.
(b) That no sheerer in excess of 1 , 100 tons shall be
allowed to operate at this location.
(c) That permanent underground containers of suitable
material be housed on this location for all oils ,
solvents , and other fluids drained at this facility.
SECTION III . That the One Thousand ( 1 ,000) foot distance
restriction set forth in Section 4-51(d) (2) of the South Bend
Municipal Code is hereby waived as to the property located at 1305
Prairie Avenue in order to permit the operation of a scrap yard
within One Thousand (1 , 000) feet of , but no closer than Five Hundred
(500) feet of, the Zoning Use Districts set forth in Section
4-51(d) (2) of the South Bend Municipal Code.
SECTION IV. No licenses shall be issued by the City Controller
for the above properties until after the sale of the properties by
Metal Resources Corporation to Sturgis Iron and Metal Co . , Inc. ,
which is to occur on or about May 15 , 1987 .
SECTION V. This Resolution shall be in full force and effect
from and after its adoption by the Common Council and approval by
the Mayor.

A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND
APPROVING THE ISSUANCE OF SCRAP METAL/JUNK DEALERS/
TRANSFER STATION LICENSES FOR THE CALENDAR YEAR 1987
WHEREAS, the Common Council of the City of South Bend
recognizes the contributions that operations such as junk/scrap and
recycling dealers make to the community; and the Council further
realizes that such operations must be reasonably regulated in order
to minimize any environmental or aesthetic nuisances which may be
created by the operations of scrap/junk/and recycling dealers within
the City; and
WHEREAS , the Common Council of the City of South Bend has
enacted reasonable rules and regulations with regard to the issuance
of licenses and the operations of the scrap/junk/and recycling
dealers ;
WHEREAS , in accordance with these rules and regulations ,
inspections of the below listed scrap/junk/and recycling operations
have been completed by the Department of Code Enforcement and the
Fire Department Prevention Bureau, and it has been found that such
premises are fit and proper for the maintenance and operation of
such businesses ; and
WHEREAS , the Board of Public Works , at its meeting held on
April 28 , 1987 , recommended the issuance of licenses for the below
listed applicants in the City of South Bend by appropriate action of
the Common Council.
WHEREAS , the below-listed properties have been licensed by the
City of South Bend as scrap yards for the past several years , both
prior to and since 1980 ; and
WHEREAS , on September 15 , 1980 , the Council passed Resolution
No. 819-80 placing the following conditions upon the use of the
Prairie Street property:
(a) That no shredders shall be allowed to operate at
this location.
(b) That no sheerer in excess of 1 , 100 tons shall be
allowed to operate at this location.
(c) That permanent underground containers of suitable
material be housed on this location for all oils ,
solvents , and other fluids drained at this facility.
WHEREAS , a portion of the property located at 1305 Prairie
Avenue is within One Thousand ( 1, 000) feet of certain Zoning Use
Districts and the use of that portion of the property as a scrap
yard is subject to a waiver by the Council pursuant to Section
4-51(d) (2) of the South Bend Municipal Code; and
WHEREAS, on April 24 , 1984 , at the request of the Licensee of
the Prairie Street property, this Council passed Resolution No.
1136-84 waiving the One Thousand ( 1 ,000) foot restriction on said
property in order to allow the operation of a scrap yard within One
Thousand ( 1 , 000) feet of, but not closer than Five Hundred (500)
feet of, the Zoning Use Districts listed in Section 4-51(d) (2) of
the South Bend Municipal Code; and
