Mayor RESOLUTION NO. 1538-87 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING A PETITION FOR AN EXCESS LEVY OF THREE CENTS PER ONE HUNDRED DOLLARS OF ASSESSED VALUATION AS PERMITTED PURSUANT TO I .C. 6-1. 1-18.5-13. WHEREAS, the Common Council recognizes that I.C. 6-1.1-18. 5-13 , permits a civil taxing unit to increase its levy on property at a tax rate of three cents ( 0. 03 ) per one hundred dollars ( $100. 00) of assessed valuation; WHEREAS, the Council further recognizes that TRANSPO is facing a budget deficit due to a substantial decrease in federal operating assistance; WHEREAS, the additional funding would assist in balancing TRANSPO' s budget and would assist them in the retention of current services used by the youth, the disabled, and low income and senior citizens of our community who use TRANSPO as their only transportation to work, school, and medical services; WHEREAS, the initial step in the State law procedure is for the Common Council to adopt a resolution approving said increase with the second step being the local government tax control board approving it based upon providing adequate transportation services to the area. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. The Common Council of the City of South Bend, hereby approves a petition for an excess levy of three cents per one hundred dollars of assessed valuation as permitted pursuant to I.C. 6-1. 1-18.5-13 . SECTION II. This resolution shall be in full force and effect from and after its adoption by the common council and approval by the Mayor.
