WHEREAS, a petition for personal property tax abate- ment consideration has been filed with the Common Council of the City of South Bend, requesting that the area commonly known as 701 South Chapin Street, South Bend, Indiana, and which is more particularly described as follows : Situate in St. Joseph County in the State of Indiana: That part of Bank Out Lots No. Seventy-six (76) , Seventy-seven (77) and Seventy-eight (78) of the Out Lots of the Town, now City of South Bend platted by the State Bank of Indiana, and of Bank Out Lots Ninety-one (91) , Ninety-two (92) , Ninety-three (93) , One Hundred Four (104) , One Hundred Five (105) and One Hundred Six (106) of the 2nd Plat of the Out Lots of the Town, now City of South Bend, platted by the State Bank of Indiana, bounded by the following described line: Beginning at a point on the East line of Arnold St. 669 . 54 feet North of the South line of said Bank Out Lot Ninety-three (93) ; thence Northeasterly at an angle to the right of 61°45 ' a distance of 52.48 feet; thence at an angle to the right of 20°14 ' a distance of 43 .28 feet; thence at an angle to the right of 8°20 ' a distance of 211. 68 feet; thence South on the West line of Chapin Street a distance of 966 . 96 feet to the North line of Dunham Street; thence West along the North line of Dunham Street a distance of 351. 78 feet to the East line of 3rd alley West of Chapin Street, thence North on the East line of said alley a distance of 129 .36 feet to the North line of the 1st alley North of Dunham Street, thence West along the North line of aforesaid alley a distance of 959 . 8 feet to the West line of McPherson Street, thence South along the West line of McPherson Street a distance of 766.55 feet to the North line of Sample Street, thence West along the North line of Sample Street a distance of 306 . 95 feet to the East line of Arnold Street, thence North along the East line of Arnold Street a distance of 1277.4 feet to the South line of Bank Out Lot Ninety-three (93) (and the South line of Ford Street) , thence East on the South line of Bank Out Lot Ninety-three (93) a distance of 225 .0 feet to a point, thence North on a line parallel with and 225 . 0 feet East of East line of Arnold Street a distance of 145 . 5 feet to the North line of the first alley South of Grace Street, thence West on the North line of the aforesaid alley a distance of 65 . 0 feet to a point; thence North on a line parallel with and 160 . 0 feet East of the East line of Arnold Street a distance of 115 .5 feet to the South line of Grace Street; thence East on the south line of Grace Street a distance of 89 .0 feet to a point; thence North on a line parallel with and 249 .0 feet East of the East line of Arnold Street a distance of 165. 5 feet to the North line of the alley North of Grace Street; thence West along the North line of the aforesaid alley a distance of 249 . 0 feet to the East line of Arnold Street; thence North along the East line of Arnold Street a distance of 243 . 0 feet to the point of beginning. Subject to an easement for an alley 10 feet wide the West line of which is 225.0 feet East of the East line of Arnold Street and extends from Grace Street to Ford Street, also an easement for intersection of the alley North of Grace Street with the alley East of Arnold Street. Also a part of Bank Out Lot No. Ninety-three (93) of the 2nd Plat of Out Lots of the Town, now City of South Bend platted by the State Bank of Indiana, described as follows : Commencing at the intersection of the North line of Grace Street and the East line of Arnold Street; thence North along the East line of Arnold Street a distance of 115 . 5 feet to the South line of alley North of Grace Street; thence East on the South line of aforeseaid alley a distance of 40 . 0 feet; thence South on a line parallel with and 40 . 0 feet East of the East line of Arnold Street a distance of 115. 5 feet to the North line of Grace Street; thence West along the North line of Grace Street a distance of 40.0 feet to the point of beginning. be designated as an Economic Revitalization Area under the pro- visions of Indiana Code 6-1. 1-12 . 1-1, et seq. ; and WHEREAS, the Redevelopment Commission has concluded an investigation and prepared a report with information sufficient for the Common Council to determine that the area qualifies as an Economic Revitalization Area under Indiana Code 6-1. 1-12. 1-1, et seq. , and has further prepared maps and plats showing the boundaries and such other information as required by law of the area in question; and -2- WHEREAS, the Human Resources and Economic Development Committee of the Common Council has reviewed said report and recommended to the Common Council that the area qualifies as an Economic Revitalization Area. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I . That the Common Council hereby accepts the report and recommendation of the Human Resources and Economic Development Committee that the area herein described be desig- nated an Economic Revitalization Area and hereby adopts a resolution designating this area as an Economic Revitalization Area for purposes of personal property tax abatement. SECTION II . That this designation shall be limited to five (5) calendar years from the date of the adoption of this Resolution by the Common Council. SECTION III . That the Common Council directs the City Clerk to cause notice of the adoption of this resolution to be published, said publication providing notice of the public hearing before the Common Council on said declaration. SECTION IV. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor.
