AN ORDINANCE APPROPRIATING FORTY-FIVE HUN 2ED DOLLP,RS
FROM THE GENERAL FUND FOR SURVEY PRELIMINARY TO
ERECTION OF SEWAGE DISPOSAL PLANT
BE IT ORDATNE By the Common Council of the City of South
Bend, Indiana, THAT WHEREAS it is deemed necessary to procure .
lands, rights of way, materials and personal property for the

purpose of establishing and erecting a sewage disposal plant for
said city; and .
WHEREAS the demands of the public :health in and about said
city require that a sewage disposal plant or some similar system
of intercepting and disposing of sewage now entering the St. Jos-
:

eph River be provided; and . •
WHEREAS an emergency exists to get under way as aoon as prac-
ticable general plans and estimates for the' erection or establish-
went of such a system as provided by the Act of the General
Assembly of Indiana, for the year 1927 (page 675) in order to re-
move and eliminate noxious conditions affecting the health.and wel
fare of the inhabitants of said city and surrounding territory: .
THERE LS HEREBY appropriated, set aside and placed at the
disposal of the Board of Public works of said city, out of the
general fund of said pity,' not otherwise appropriated,_ the sum of ,,,
Forty-five Hundred Dollars mwlserewith to employ he necessary en-

gineers, surveyors; and assistance, aiparatas, blue-prints, aura;
and material necessary to effect and earry. on :a thorough survey ,
report and investigation into the question of the feasibility, to cation, coat, means and general outline of a sewage-disposal
plant, including the means and cost of lands , rights of way ,,
'materials and personal property needful to accomplish the erection
of the same, which said sum shall be available and drawn upon in
the discretion of said Board of Public Works.
The consideration of said Ordinance and the appropriation there-
in specified shall be heard by said Council on Monday evening,
J broh 14, 1930, at 7: 30 o' clock pm. in the Council Chambers of
the City Hall, in the City or South Send , Indiana , and the clerk
is directed to publish notice in conformity with law that said
ordinance will come up for action as aforesaid and that ten or
more taxpayers, after said apprppriation has been finally de-
termined upon, may appeal to the state Board of Tax Commissioners
for further and final action thereon by filing a petition there-
for with the County Auditor not later than ten days after the
final determination by the Council.
