BOULEVARDS AND PUBLIC PLACES IN THE CITY OF SOUTH BEND, INDIANA. Such underground lamps shall be as followst- (*) (a) On Miami Street between Ewing Avenue and akai.ds Strata 3 - 12 foot Sheridan hollow spun concrete lighting standards with Octagonal Junior Lighting Units with Spurs and Medium Multiple Sockets, each equipped with 1 - 1000 lumen street lighting lamp or equivalent lamp. (k) Fellow Street Crossing: 4 - 10 foot Sheridan hollow spun concrete lighting standards with Octggonal Junior Tops with Spurs and with Refractors, each equipped with 1 - 2500 lumen street lighting lamp or equivalent lamp. -3- All property used in the performance of this contract hall be and remain the property of the Contractor. The Contractor shall at its cost, furnish all lamp enewals and light all lamps herein provided for a period terminating with._the termination ot_the General Q.ontract for Stree , lighting, which termination date is_ Janvary 1,I935, at noon. All the lamps which shall be provided and maintained y this Contractor shall be so operated that they will give the aximum amount of illumination obtainable. 2, Additional street lighting units referred to herein Is railway elevation underpass lights, shall be added from time o time upon written notice from the City, provided, however, that got more than two (2) additional lamps shall be ordered at any Itreet crossing, payment therefor shall be at the rate provided i'or in this contract , commencing on the day on which the lamps are o be in service. 3. All lamps herein provided for shall be burned from one-half hour after sunset until one-half hour before sunrise, very night and all night, burning approximately four thousand (4000) hours per annum. 4. The number of lamps furnished and lighted under this contract shall be the number provided for in Paragraph 1 .ereof and shall be located as shown on prints attached hereto and identified by the signatures of the Contractor and the Board of Public Works, 5. All outages shall be reported daily in writing by the proper officials of the City to the Contractor and the proper officials of the City may deduct from the total monthly amount which would have been paid ?or amy lamp so reported on any outage occurring, the sum bearing the ratio to such total -4- as the period of outage bears to the total time the lamp would nave been lighted in any month. 6. Street lighting units herein contracted for shall • be moved by the Contractor to such new locations as the City may by writing direct, 'subject to the following conditions: Such moving of lamps shall be completed within thirty (30 ) days after receipt by contractor of mitten notice from the City, Sundays, legal holidays and stormy days not to be included, provided that the number of such removals shall not emceed one per day and provided further that such removals shall not be required on Sundays, legal holidays and stormy days. Notice that the work of such removal of lamps has been completed shall be given by the Contractor to the City within ten days after completion of the work. The actual cost to the Contractor for making such relocations shall be paid by the City to the contractor within thirty (30) days after said notice has been given. 7. The City shall accept such lamps and the services herein specified during the life of this contract and pay as full compensation therefor at 'the rate and price set out in the aooepted bid to-wit: For underground street lighting units. K 42.00 per unit per annum, Payment for all lighting services to be made in equal monthly installments, each installment to be due and payable on or before the 20th of each month succeeding that in which the service is rendered, 8, The Contractor shall have the right with the consent of the Board of Public Works of the City, at any time during 1 the life of this contract to install, operate and maintain in the place of the lamps herein provided for, and under the same terms and conditions, other and more improved lamps in keeping with such advancement as may b.e made in the aft I of lighting, which lamps shall be of equivalent or greater illuminating power, .7. 1 9. In authorizing or granting a permit to any person, firm or corporation to repair or out into any street, alley, or sidewalk in which said street lighting units and lines and cables • supplying current thereto are located, the City shall require, as a condition to the granting of such permit, an agreement on the part of the applicant that such lines and cables and street lighting units will not be interferred with in any manner without notice to the Contractor. 10. 611 the covenants, expressions, terms, conditions, provisions and agreements herein shall extend to and be binding "upon," or inure to the benefit of, as the oase may be, each and every one of the successors or assigns of each of the parties hereto as if in every case so expressed. 11. This contract shall be in force and effect for period terminating with the termination of the General Contract fog Street lighting, which termination date is January -111935, at noon.
