BE IT ORDAINED by the Common Council of the City of South Bend, Indiana: Section 1. That it shall be unlawful for any person, firm, partnership or corporation to engage in the business of plumbing contractor until such person, firm, partnership or corporation shall have first se- cured a license therefor in accordance with the provisions of this ordinance. Section 2. The Board of Health of said City of South Bend is hereby authorized and empowered to appoint an examining board consisting of one ( 1) duly licensed plumbing contractor, one ( 1) qualified and competent journeyman plumber and the plumbing inspector of said city. Said Board shall meet at least once each thirty (30) days or oftener if in the judgment of the Secretary of the Board of Health it is deemed advisable. Said- Examining Board shall hold office doting the pleasure of the Board of Health and until its successor is appointed and qualified. Section 3. Any person, firm, partnership or corporation desiring to secure a license as a plumbing contractor, commonly known as master plumber, shall make application therefor upon a form to be provided by the Board of Health; provided, however, that in case of a firm, partnership or corporation such application maybe made by a duly authorized and desig- nated agent of such firm, partnership or corporation. At the time of mak- ing such application said applicant shall pay to the Board of Health the :Aum of .Five ($5.00) Dollars as a fee for the examination. Thereafter at a time, and place designated by the Board of Health said applicant shall submit himself before the Examining Board herein provided for, and answer such questions as may be asked of him by said Board or any member thereof relative to the knowledge required by a plumbing contractor. If said applicant properly answers sufficient questions to qualify 1.011 in the judgment of said examining board to be a plumbing contractor, then said board shall report their findings in writing to the Board of Health. Any applicant who has failed to pass -1- a satisfactory examination may re-apply for another examination after the expiration of sixty (60) days by filing another application and pay- ing the prescribed fee. If any applicant should feel that he has been discriminated against by the examining board he may appeal their decision *ithin ten (10) days to the Board of Health, which Board may, in its discretion, arrange for a special' examination of said applicant. Section 4. Every applicant for a plumbing contractor' s license having passed a satisfactory examination hereunder shall receive from the Board of Health a certificate of recommendation to the Controller of said City for the issuance to said applicant of an annual license upon payment of the sum of Fifteen (15.00 ) Dollars to said City, but before such license is issued to said applicant he shall furnish a bond with surety to the approval of the Controller of said City in the penal sum of Two Thousand (4,000.00) Dollars, conditional to reimburse 'said City of South Bend for all damages caused by any act or omission of said plumbing contractor, or any of his agents, to any property which the city may own or for which it may be repponsible, and to hold said City of South Bend free and harmless from all claims for damages on account of the negligence or misfeasance of the plumber, and from all cost and expense growing out of the defense of such claims. Said bond is to be in force from the date of its acceptance and the issuance of license by said Controller for a term of one year, and both licenses and bond must be renewed annually, and no other bond shall be required of such plumber by any other department of the City, except for making excavations in the street. Section 5. That each member of the Examining Board excepting the City Plumbing inspector shall receive as compensation for services in connection with such examination the sum of 62. 50 for the examination of each applicant. Said sum to be payable same as other contractual ob- lifations of said City are now payable. The fee of 1;;;5.00 payed by the applicant at time of filing application for examination shall be deposited by the Board of Health same as other receipts by said Board are now dep- osited. Section6. The provisions of this ordinance as to examination shall not apply to any plumbing contractors, commonly known as master plumbers, now duly licensed and qualified under the provisions of any ordinance or plumbing code now in effect. -2- Section 7. Any applicant who shows satisfactory evidence to the Board of Health that he has a license in any other City of the State of Indiana as a plumbing contractor under and by virtue of the provisions of an ordinance pursuant to Chapter 209 of the 1929 Acts the the General Assembly of the State of Indiana, may be recommended by the Board of Health to the City Controller for the issuance of a license without an examination upon payment of the usual license fee and filing of bond as herein otherwise provided. Section 8. That Section 22 of Ordinance No. 1880 is hereby repealed. Section 9. Any person violating any of the provisions of this Ordinance shall be fined in any sum not less than Twenty-five Dollars ($25.00) and not exceeding One Hundred Dollars (0100.00) to which may be added imprisonment in the County Jail for not more than thirty (30) days.
