Providing for the establishing of a Dog Pound and for the
ion of dogs, bitohes,and other animals of the canine

upon faFlure of the oum er to redeem the same;and:
appropriating Twenty -five Hundred Dollars ($2500) from the
General Fund of the City of South Bend and the Board of Publie
safety for the salary of a Dog Pound Master,and for the equip-
ment and operation of said pound;and providing a penalty forthe
violation of this ordinance and repealing all ordinances in
conflict herewith.

BE IT ORDAINED BY M COMON COUNCIL
OF THE CITY OF SOMM BEND
AS FOLLOWS:
Section 1. That it shall be the duty of every person owning
any dog within the corporate limits of the City of South Bend,
Indiana,over the age of three months,and desiring to permit said
dog to run at large,to register said animal with the Board of
Public Safety of the City of South Bend,Indiana;and it shall be
the duty of the said official to record in a book kept for that
purpose the name and address of the owner of said dog, a bfief
description of said animal and the registration number assigned to
said animal; provided thajn dog registered in the o,Y-
fice of the Board of Public dSafety after said animal shell
fib been inoculated by a licensed veterinarian with an approved
and recognized anti - rabies sev m,and a certificate certifying to
such inoculation shall be presented to the clerk of said Board
signed by such licensed veterinarian showing that said animal has
been inoculatedto a mop s p
The Clerk of said Board of Public Safety shall
nigh the owner of such animal at the time of registration with a
registration reoeipt, and with a metal tag bearing a serial num-
ber which shall be attached to said animal's oollar;which shall
indicate the registration year for which said license has been
issued. The license and registration fee shah. be
For each dog, One Dollar.($1 00) per year.

Provided that the said Board shall charge in addition to the above
sum the sum of twenty -five cents (851() for eadh duplicate metal t
issued as hereinbefore provided.
Said metal tag shall have stamped thereon a number corres-
ponding to the registration number of the dog so lioensed,as
shown on said record book. For each registration year the tag sh a
be of a different shape. Said license and tag shall not be trans-
ferable to any other animal than the one registered.
Dogs shall be licensed before the fifteenth day of Tuly of
each year, and said license shall be valid for the twelve months
following such date,which is defined as the registration year;
provided that dogs becoming of the age of three meths after
Tuly 1st of each year,or which shall be brought into the city by
their owner after said date,shall be licensed within thirty (30)
days after becoming three months old, or after being brought into
the city,whioh license shall be valid until the fifteent� day ct
Tuly next succeeding.
Section 8. No dog shall be allowed to run at large within t
city limits of the City of South Bend,Indiana,or be away from the
premises of the owner of such dog unless such dog shall be kept at
so
all times on leash or„ muzzled that it is impossible for such dog
to bite a human being ;provided,however,that It shall be lawful for
any dog to run at large or be away from the premises of the owner
without being on leash or muzzled, as aforesaid, if such dog has
II registered and inoculated or immunized against rabies in the man-
ner hereinafter provided and is not manifestly vicious or diseas
provided,further,however, that female dogs shall not be permitted
to run at large while in heat;
Section 3. There shall be a public pound in or near the Cit
of South Bend to be located from time to time in suohplace or
places as may be designated by the Board of Public Safety of this
city. Said public pound shall be km wn as a Dog Pound and shall b
under the supervision of said Board of Public Safety. Said Board
of Public Safety is hereby authorized to appoint a Pound Master
who may be a veterinarian in private praotiee,and to fix his

salary,and to pay in addition to the salary.to the Pound Master th
necessary cost of maintaining said pound over and above the r eeeip
from the operation of the same,and there is hereby appropriated to
the Board of Public Safety for the purposes aforesaid,out of any
moneys on hand not specifically appropriated, the sum of Twenty -fiv
Hundred Dollars ($2500).
Section 4. The owner of any dog immunized against rabies
shall procure a written certificate of vaeoination,on forms to be
approved by the secretary of the Board of Public Safety,.whioh cer-
tifioate shall give an accurate description of the dog,the dato of
Immunization, the name and address of the owner of the dog;which
certificate shall be signed by the veterinarysiministering the
vaccine*
Section b. A fee of not more than Two Dollars ($2.00)
be paid for the immunization against rabies of each dog so vaocina ed,
which shall include the issuance of such certificate of immunize -
tion;provided,however,that if any veterinarian in private practice
shall charge more than said sum for his services,the owner of said
dog may procure the immunization of said dog by applying to the s d
Board of Public Safety which shall provides, veterinarian who will
render said service for said fee.
Section 8. All vaccine for immunizing dogs against rabies
shall be a recognized antirabies serum approved by the Board of
Health of the city of South Bend and it shall be unlawful for
serum not so approved a,44 recognized to be used.
Section 7. Any dog running at large in the city of South
Bend,Ind$na,not properly immunized and provided with collar to
which is attached the metal tag as aforesaid,or any dog not so
muzzled so that it is impossible for him to bite a human being,
shall be taken up by the police and impounded in said dog pound.
Section 8; The Pound Master shall safely keep and care
any dog so impounded for a period of three (3) days and during
said period of time shall see that said animal is humanely t
and properly fed and watered. At any time within said period the
owner of said dog upon proof of ownership satisfactory to the

Master shall be entitled to have said dog redeemed upon paying to
the Pound Master a fee of One Dollar ($1000), with an additional
charge of twenty -five cents (250) per day for each day or part th
of that said dog has been in said pound.
Section 9. Upon failure of the owner of any impounded dog
within said period of three days to redeem said dog from the pound;
as provided aforesaid,such dog shall at the end of said period of
three days be humanely destroyed by said Pound Master;protided,
however,that in place of destroying said dog the same may be re-
leased by the Pound Master to any person desiring to procure the
same who shall Jiay the impounding fees aforesaid and who shall
immunize and register said dog as aforesaid;provided,further,that
in ease any dog shall be impounded which in the judgment of the
Pound Master is a valuable dog, of the value of Twenty -five Dol-
lars ($25) or more, the Pound Master may continue to keep said dog
for an additional period of one (1) week,and shall advertise the
sale of said animal by one newspaper notice in a newspaper publisho
in the City of South Bend,Indiana,describing said dog and designat-
ing the time of sale,at which time said Pound Master may proceed toI
sell said dog at public outcry for the higest and best bid in east
for said animal and upon the bidder paging the bid price and the
impounding fees aforesaid and causing said animal to be immunized,
and registered, as aforesaid,in case of the sale of valuable dogs,
the Pound Master shall be entitled to retain over and above the
amount otherwise paid hi 'fifty per eent.(50 %) of the sale price
of said dog as his Poe.
Section.10. The Pound Master shall keep a faithful record
of his receipts and disbursement and a record of the cost of main -
taining said pound and providing food and drink for impounded ani-
male, and shall account monthly to the Board of Public Safety for
any/surplus in his hande;provided,however,that said Pound Master
may have in his possession as petty cash the sum of One Hundred
Dollars ($100) for the purpose of buying food and drink for impoux
ed animals. At least annually the Pound Master shall make a writ-
ten report of his doings to said Board of Safety.

Section 11. The word "owner" as used 'herein shall mean any
person who owns,keeps or harbors any dog other than puppies not
more than three weeks old,and other than dog breeders,holding Rear
Licenses,as provided by the statutes of the State of Indiana.
Section 12. It shall be unlawful for any owner to wilfully
and negligently allow any dog so owned by him to run at large
within the city limits of the City of South Bend unless said dog
shall be immunized against rabies and tagged,as provided above,or
unless said dog shall be so muzzled as to render it impossible to
bite a human being.
Section 13. Nothing set forth herein shallhave the force and
effect of releaving the owner of any dog from complying with all
statutes of the State of Indiana pertaining to dogs,or relieve the
owner from liability for damages inflicted by said dog to the per
-son or property of other persons.
Section 14. No dog immunized against rabies,as a£oresaid,and
provided with a metal tag as aforesaid,or muzzled,as aforesaid,
shall be killed by the police officers of the City of South Bend,
while running at large unless said dog is manifestly vicious or
suffering from rabies,
Section 15, It shall be the ;duty of every person owning a
dog which has been attacked or bitten.by a dog or other animal
showing symptoms of rabies,to immediately notify the Board of
Health of such fact and upon demand of said Board of Health shall
surrender said dog to said Board of Health for quarantine and ea-
amination.
Section 160 Any person who violates any of the provisions of
this ordinance shall upon conviction thereof be fined any sum no
less than Ten Dollars (10) nor more than One Hundred Dollars ($I O).
Section 12. All ordinances and parts of ordinances in conni t
herewith are hereby repealed in so far as they conflict with the
