A RESOLUTION CONFIRMING THE ADOPTION OF A DECLARATORY
RESOLUTION DESIGNATING CERTAIN AREAS WITHIN THE CITY OF
SOUTH BEND, INDIANA COMMONLY KNOWN AS
1702 WEST WASHINGTON STREET
TO BE AN ECONOMIC
REVITALIZATION AREA FOR PURPOSES OF A 5 YEAR
PERSONAL PROPERTY TAX ABATEMENT FOR
ADAMS ENGINEERING, INC.
WHEREAS, the Common Council of the City of South Bend,
Indiana has adopted a Declaratory Resolution designating
certain areas within the City as Economic Revitalization Areas
for the purpose of tax abatement consideration; and
WHEREAS, a Declaratory Resolution designated the area
commonly known as 1702 West Washington Street and which is more
particularly described as follows:
TRACT NO. 1. A part of the East Half of the Northeast
quarter of Section No. 10 in Township No. 37 North,
Range No. 2 East, described as follows, viz:
Beginning at a point 92.05 feet South of the South
line of Washington Avenue in the City of South Bend,
and 14.55 feet East of the West line of College Street
(produced South) in said City; thence East a distance
of 109.9 feet more or less to the Westerly line of the
right of way of the Chicago, Indiana and Southern
Railway at a point 92.05 feet South of the South line
of said Washington Avenue (produced East); thence
North 19 degrees 56 minutes West along the said
Westerly line of the right of way of the Chicago,
Indiana and Southern Railway a distance of 22.25 feet;
thence North 15 degrees 38 minutes West along the said
Westerly line of the right of way of the Chicago,
Indiana and Southern Railway a distance of 50 feet to
the Southerly line of Circle Avenue in said City;
thence Northwesterly along the Southerly line of
Circle Avenue to a point 14.55 feet East of the West
line of said College Street (produced South); thence
South to the place of beginning.
TRACT NO. 2. A part of the East Half of the Northeast
Quarter of Section No. 10, in Township No. 37 North,
Range No. 2 East, described as follows, viz:
Beginning at a point 92.05 feet South of the South
line of Washington Avenue in the City of South Bend,
and 13.84 feet East of the West line of College Street
(produced South) in said City; thence East along the
center line of a party wall and the center line
produced, a distance of 110.61 feet to the Westerly
line of the right of way of the Chicago, Indiana and
Southern Railway; thence South 19 degrees 56 minutes
East a distance of 28.35 feet; thence South 25 degrees
35 minutes East, a distance of 30.02 feet; thence West
along the North side of a brick wall and said North
side produced, a distance of 133.25 feet to a point
13.84 feet East of the West line of College Street
(produced South); thence North a distance of 53.20
feet to the place of beginning.
TRACT NO. 3. A lot or parcel of land in the City of
South Bend located in the East 1/2 of the Northeast
1/4 of Section Number 10, Township Number 37 North,
Range Number 2 East, bounded by a line running as
follows, viz:
Beginning at a point in the South line of West
Washington Avenue 7.58 feet West from a point where
the West line of College Street extended South would
intersect the South line of said West Washington
Avenue; thence South 208 feet; thence West 395.87
feet; thence North 208 feet to the South line of
Washington Avenue; thence East along the South line of
Washington Avenue a distance of 395.87 feet to the
place of beginning.
Also beginning at a point in the South line of West
Washington Avenue 7.58 feet West from a point where
the West line of College Street extended South would
intersect the South line of Washington Avenue and
being at the Northeast corner of the above described
tract; thence South along the East line of the above
described tract 293.6 feet to an iron stake; thence
East 19.69 feet, more or less, to the Southwest corner
of a tract of land conveyed to the South Bend
Wholesale Drug Company by deed recorded in Deed Record
333, page 336; thence North 293.6 feet, more or less,
to a point in the South line of West Washington Avenue
20 feet East of the place of beginning; thence West 20
feet to the place of beginning.
Subject to easements and restrictions of record.
as an Economic Revitalization Area; and
WHEREAS, notice of the adoption of a Declaratory Resolution
and the public hearing before the Council has been published
pursuant to Indiana Code 6 -1.1- 12.1 -2.5; and
WHEREAS, the Council held a public hearing for the purposes
of hearing all remonstrances and objections from interested
persons; and
WHEREAS, the Council has determined that the qualifications
for an economic revitalization area have been met.
NOW, THEREFORE, BE IT RESOLVED by the Common Council of the
City of South Bend, Indiana, as follows:
SECTION I. The Common Council hereby confirms its
Declaratory Resolution designating the area described herein as
an Economic Revitalization Area for the purposes of tax
abatement. Such designation is for personal property tax
abatement only and is limited to two (2) calendar years from
the date of adoption of the Declaratory Resolution by the
Common Council.
SECTION II. The Common Council hereby determines that the
property owner is qualified for and is granted personal
property tax deduction for a period of five (5) years.
SECTION III. This Resolution shall be in full force and
effect from and after its adoption by the Common Council and
approval by the Mayor.
