Presented by me to the Mayor of the City of South Bend, Indiana 0 Clerk Approved and signed by me 19j-1► ORDINANCE N0. 2 q 3 S' AN ORDINANCE RELATING TO 'M PROTECTION OF THE RIGHT OF WAY OF THE GRAND TRUNK WESTERN RAILROAD COBTPANY OVER CERTAIN STREETS IN THE CITY OF SOUTH BEND, INDIANa. WHEREAS, heretofore, there was duly enacted Ordinance No. 2736 of the City of South Bend, Indiana, entitled: "An Ordinance Relating to the Protection of the Right of Way of the Grand Trunk Western Railroad Company and the Kankakee Division of the New York Central Railroad Company over Certain Streets of the City of South Bend, Indiana. which Ordinance in part provided for the protection of the inter- sections of the Right of way of the Grand Trunk Western Railroad Company with Carroll Street, Columbia Street, Fellows Street, St. Joseph Street and Lincolnway East, all public streets in said City of South Bend, Indiana„ WHEREAS, since the enactment of said Ordinance, the course of the main line of said Grand Trunk Western Railroad Company has been changed from Greenlawn Avenue westward in said City of South Bend, so that the said main line now follows a new southwesterly course from said Greenlawn Avenue. WEffRF&R, that portion of the Right of way of said Grand Trunk Western Railroad Company which lies between Greenlawn Avenue and Michigan Street in said City of South Bend, Indiana, and which was at the time of the enactment of said Ordinance a part of the main line of said Railroad Company, has now become an industrial siding with very few switching movements thereover daily. WHEREAS, said Grand Trunk Western Railroad Company is now protecting the intersection of its Right of Way with said named streets with manually operated mechanical flashlights at Carroll Street, Columbia Street, Fellows Street and Lincoinway East between the hours of 6 A.M. and 6 P.M. each day, and by requiring all switching movements over each and all of said inter- sections by day or night, that are not headed by an engine,to be protected by a member of the crew stationed conspicuously on the crossings. WHEREAS, this Council is of the opinion that said flashlights, as placed and now operated, supplemented by the protection given by members of the train crews, afford sufficient protection to the public in its use of said crossings. THEREFORE, be it enacted by the Common Council of the City of South Bend, Indiam: SECTION I. Said Grand Trunk Western Railroad Company be, and it is hereby required to protect the intersection of its Rift of Way with the following public streets in the City of South Bend, Indiana, in manner and form as follows, to -wit: At. St. Joseph, Carroll, Columbia, Fellows Streets and Lincolnway East with flashlights manually operated between the hours of 6 A.M. and 6 P.M. of each days at the four streets last named and in addition t9 said flashlights operated as ecoresaids by requiring all switching movements at any hour of the day or night, over each and all of said crossings, that are not headed by an engine, be protected by a member of the crew stationed conspicuously on the crossing. SECTION II. That so much of said Ordinance No. 2736 as is inconsistent with the provisions of this Ordinance be, and the same is hereby repealed. SECTION III. That any violation of any of the provisions of this Ordinance shall be punished by a fine of not less than $50.00, and each violation shall constitute _per - rO Q , - : T4 ell �� I
