A RESOLUTION ADOPTING A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA WHEREAS, Southfield, Inc. has petitioned the Common Council to annex an area specifically described in Attachment "A ", incorporated herein; and WHEREAS, responsible planning and State law require adoption by the City of a fiscal plan and a definite policy for the provision of services to annexed areas; and WHEREAS, such a plan has been developed and presented to the Common Council. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that: Section I: The Common Council of the City of South Bend, Indiana, hereby approves and adopts the fiscal plan for the annexation of the area located near the southeast corner of the intersection of Miami and Kern Roads, more specifically described in Attachment "A ", which plan is attached hereto and made a part hereof, and hereby approves and adopts specific policies for implementation of the plan as set out therein. Section II: Implementation of the plan does not require the budgeting and appropriation of additional funds. Section III: The annexation will not result in the elimination of jobs of employees of another governmental entity. Section IV: This resolution shall be in full force and effect after its adoption by the Common Council and approval by the Mayor. CITY OF SOUTH BEND, INDIANA FISCAL PLAN FOR THE ANNEXATION OF THE PROPERTY LOCATED NEAR THE SOUTHEAST CORNER OF THE INTERSECTION OF MIAMI AND KERN ROADS ;�Tt a OU The following Fiscal Plan, developed through the cooperative efforts of the City of South Bend's Controller's Office, Department of Public Works, Police Department, Fire Department, Department of Neighborhood Code Enforcement, and the Department of Public Works, represents the City's policy for the annexation of the property located near the southeast corner of the intersection of Miami and Kern Roads (hereinafter, "Annexation Area "). This annexation meets the statutory contiguity requirements. I. LOCATION The Annexation Area is located in the Northwest Quarter of Section 6, Township 36 North, Range 3 East, Center Township, St. Joseph County, Indiana near the southeast corner of the intersection of Miami and Kern Roads. A Legal Description of the Annexation Area is attached as Exhibit 1. A map of the Annexation Area is attached as Exhibit 2. There are 78.22 acres of land within the Annexation Area. II. EXISTING LAND USE The Annexation Area is currently vacant land. III. PROPOSED DEVELOPMENT Southfield, Inc. proposes to develop the site for 75 single - family residences, 108 duplex residences, and a multi - family facility for senior citizens which will have 280 private apartments and common areas for dining and other services. There will be 11,000 linear feet of dedicated roadway. The extension of Municipal facilities located immediately north of the project will service this subdivision. All surface drainage is to be handled through the use of retention basins located throughout the proposed subdivision in compliance with the City of South Bend Subdivision Standards. Southfield, Inc. will provide all streets, street lighting, water facilities, sewers, and stormwater drainage facilities throughout the Annexation Area. IV. PROVISION OF CITY SERVICES A. Public Works No expenditure of funds by the City will be required to provide capital improvements due to the fact that Southfield, Inc. will be providing street construction, street lighting, sewer facilities, water facilities, and stormwater drainage facilities throughout the Annexation Area. The proposed streets represent less the one percent (1%) of the City's current road system and can be easily maintained with existing personnel and equipment. The wastewater treatment and collection systems can provide service to the proposed area without any additional expenditures by the City. The water system is adequate and available for the Annexation Area. The City can also provide solid waste collection services to the Annexation Area without additional equipment or personnel. B. Police Protection The Annexation Area will be added to the existing patrol district known as Beat 15. Police services to be provided to the Annexation Area will include traffic patrol, preventive patrol, crime deterence, police reporting services, and emergency responses by the Department. The placement of the project and nature of the area bordering the complex will lend well to police services and will provide no unusual problems for the South Bend Police Department. The additional area will be patroled and serviced by the present complement of officers of the South Bend Police Department. Response times will be comparable to other areas of the City. No degradation of service to existing areas of the City will be experienced due to the nature of the development. The South Sector Captain, under the guidance of the Uniform Division Chief, will supervise the routine patrol of the new area. C. Fire Protection The Annexation Area is located approximately 2.0 miles from South Bend Fire Department Station #10 at 308 West Ireland Road. Additional Fire Department units would respond, including Engine #8, which is located approximately 2.0 miles at 2402 Tyckenham. Response times will be comparable to other areas of the City. No additional equipment will need to be purchased or personnel hired to service the Annexation Area. D. Neighborhood Code Enforcement The Department of Neighborhood Code Enforcement can perform code enforcement activities without acquiring additional equipment or hiring of additional personnel. The Humane Society of St. Joseph County currently provides animal control services on a County -wide basis.
