All members were present with the exception of Valerie Schey who had been excused for a migraine. Present as well was the newly appointed member Ron Okoye. Oliver Davis called upon Larry Magliozzi, the Executive Director of the Area Plan Commission to make the presentation. With the help of a handout (attached) Larry explained that the intent of the bill was to simplify and strengthen the language in the Planned Unit Development (PUD) section of the Zoning Code. He said the bill would eliminate the need for special exceptions by more clearly delineating what was allowed by the Code. Larry went on to say a PUD district encourages the imaginative use of open space, promotes high standards in design and construction, and furthers the purposes of the Comprehensive Plan. Brief Council questions followed. Henry Davis asked if this change affected labor's status at all. Larry said not at all. Dr. Varner asked if the changes impacted further development of Eddy Commons. Larry said it actually facilitates development. On a motion by Derek Dieter seconded by Oliver Davis and supported by all the bill was forwarded favorably. the meeting at 4:04 PM Zoning & /Annkxatio� Committee PUD District Redraft Rev. 7/9 1. The language in the INTENT section has been simplified and strengthened: FROM THIS: The Planned Unit Development (PUD) District is designed and intended to: encourage creativity and innovation in the design of developments; provide for more efficient use of land; permit special consideration of property with outstanding natural or topographical features; facilitate use of the most appropriate construction techniques in the development of land; and, provide for any individual land use not otherwise specified elsewhere in this Ordinance. The PUD District encourages imaginative uses of open space, promotes high standards in design and construction, and furthers the purposes of the Comprehensive Plan. TO THIS: (1) Establish a compatible and efficient mix of land uses and open space; (2) Ensure compatibility with the Comprehensive Plan, surrounding developments and future development needs; (3) Establish a creative approach in building design through architectural compatibility with adjacent buildings, general neighborhood design or by creating a unique style; (4) Achieve flexibility and provide incentives for development that will sustain a wider range of choice in satisfying the changing needs of the community; and (5) Provide for any individual land or a combination of land uses not otherwise specified elsewhere in this Ordinance. ALSO: • The PUD District is not intended for the development of residential subdivisions or uses which are provided for as a matter of right within any district of this Ordinance. • The need for variances shall not be justification for applying for a PUD District, nor shall a PUD be requested in lieu of a Special Exception Use. 2. Removed the Area Requirement. 3. Added a requirement that the Concept Plan be filed at least two weeks prior to the filing of a PUD District ordinance. There is no set timetable in the current ordinance. 4. Re- structured submittal requirements for the Concept Plan, Preliminary Plan and Secondary Approval. 5. Preliminary Plan now has two components: i. The Ordinance which provides all of the development standards formatted as a "report "; ii. A site plan. 6.
