An Ordinance declaring the non - existence of a City Purchasing
Agent or City Purchasing Clerk and prohibiting the appointment of
any person to such non:- existent office or position.
',- Y=RFAS, no safeguards or precautions whatsoever to protect
the interests of the public are thrown about the operations and
powers of so important a position as that of City Purchasing
Agent or Purchasing Clerk due to the absence of any state law
creating such an office or position in-Second Class cities;
therefore
Be it Ordained by the Common Council of the City of South Bend,
Indiana:
Section 1. That the office of a so- called. City Purchasing
Agent or Purchasing Clerk for the City of South Bend, Indiana, be,
and the same is hereby declared
connection with any department,
South Bend, Indiana.
to be non - existent under or in
bureau or office of the City of
Section 2. That the appointment by an executive officer or
official, or by any department board of the City of any person to
serve as a City Purchasing Agent or Purchasing Clerk, or to serve
in any like capacity, shall be inoperative and of no effect, and
any officer or official making any such appointment or authorizing
or making payment of any city funds to any person:fo act in any
such capacity, shall be liable on their official bonds for any
and all moneys paid out by the city on account of such unlawful
appointment.
Section 3. This Ordinance shall be in full force and effect
from and after its jassage.
