Approved and signed by me December. 16th__ 193 City Clerk ORDINANCE NO.2 AN ORDINANCE AMENDING SECTION 6 OF ORDINANCE NO. 2948 REGULATING AND LICENSING PEDDLERS, HAWKERS AND OPERATCP.S OF OPEN AIR STANDS, AND REPEALING ORDINANCES IN CONFLICT THEREWITH ADOPTED ON THE 12th DAY OF OCTOBER, 1931. BE IT ORDAINED BY THE COMMON COUNCIL :OF.THE CITY OF SOUTH BEND, INDIANA: Section 1 That Section 6,of Ordinance No. 2948 adopted on the 12th day of October, 1931, be amended to read as follows: Section 6 - That the provision of this ordinance shall not apply to the sale of news- papers, nor to the sale of farm produce, vege- tables or fruits, when such farm produce, vege- tables or fruits are raised, grown and produced by,the person so selling same; provided, however, that all persons,who desire to sell farm produce, Vegetables or fruits of their own raising, shall before peddling the same, apply to the City Con- troller and male affidavit to the effect that the farm produce, vegetables or fruits which he desires to sell, is of his own raising, and if such person fails or refuses to make such affi- davit, then if he peddles, he shall be liable to the penalties of this ordinance. Nothing in this ordinance shall be con- strued to require United States War Veterans, who are authorized to peddle without a license in the State of Indiana, to obtain a license from the City of South Bend. Section 2 The penalty for the violation of this ordinance shall be subject and according to Section 10 of said Ordinance No. 2948, of which it is amendatory, to wit: A fine not exceeding Fifty Dollars ($50.00) for each day's violation.
