The Board of Public Safety met in the Public Agenda Session at 8:05 a.m. on Wednesday, Decemb 3. 2008 with President Donald Alford and Board Members Juanita Dempsey, Patrick D. Cottrel n Bruce J. BonDurant and Jack Reed present. Also present were Police Chief Darryl Boyki Assistant Fire Chief of Operations Jim Lopez and Board Attorney Thomas Bodnar. The meeting was held in the Board of Public Works Meeting Room, 13'h Floor County City Z� Building, South Bend, Indiana. REGULAR MEETING November 121, 2008, would be accepted with Mr. Cottrell's noted changes to the Public Agenda Session. APPROVE 2009 BOARD OF SAFETY MEETING SCHEDULE Upon a motion by Ms. Dempsey, seconded by Mr. BonDurant and carried.. the 2009 Board of Safety Meeting Schedule was approved as amended. The November 25, 2009 meeting date was changed to November 181, 2009. FIRE DEPARTMENT ADOPT RESOLUTION NO. 86-2008 - A RESOLUTION OF THE BOARD OF PUBLIC SAFET FET OF THE CITY OF SOUTH BEND, INDIANA., ESTABLISHING THE 2009 HOLIDA SCHEDULE FOR THE SOUTH BEND FIRE DEPARTMENT Upon a motion by Ms. Dempsey, seconded by Mr. BonDurant and carried, the following Resolutio was approved by the Board of Public Safety: RESOLUTION NO. 86-2008 A RESOLUTION OF THE BOARD OF PUBLIC SAFETY OF THE CITY OF SOUTH BEND, INDIANA ESTABLISHING THE 2009 HOLIDAY SCHEDULE FOR THE SOUTH BEND FIRE DEPARTMENT. WHEREAS, the Board of Public Safety oft e City of South Bend, Indiana, is empowered by law to establish rules and regulations for the South Bend Fire Department; and WHEREAS,, it is in the best interest of the City of South Bend that the Fire Department holidays be set with certainty. NOW, THEREFORE, BE IT RESOLVED, by the Board of Public Safety of the City of South Bend: SECTION 1. That all fire-fighters who work 24-hour shifts are not entitled o. off. SECTION 11. For all firefighters who work 24-hour shifts, Critical Duty Days are as set -forth in Article 25 of the Collective Bargaining Agreement for the years 2005-2008, which is in Z-) force in 2009 per Article 33 of the Agreement. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Safety of the City of South Bend: SECTION 1. That for all sworn police officers who are assigned to work their regular work schedule, 6 days on and ) -3 days off, there shall be no paid holidays. The following dates are designated as critical duty days: New Years Day Independence Day Thanksgiving-Day Christmas Eve Christmas Day New Years Eve Thursday, January 1, 2009 Saturday July 4, 2009 Thursday, November 26, 2009 Thursday, December 24, 2009 Friday, December 25, 2009 Thursday, December 31, 2009 For purposes of the Critical Duty Day stipend, the Critical Duty Day shall start at 6:00 a.m., and last 24 hours. SECTION 111. Officers assigned to the South Bend Community School Corporation shall follow the holiday schedule SET FORTH ABOVE. Officers so assigned shall be eligible for Critical Duty pay only if assigned tot eh Uniform Division and otherwise eligible. SECTION IV. To be eligible for a Critical Duty Day stipend, the Officer must either work the entire shift or have suffered an injury on the job which prevents working the entire shift. Any Officer who works recall on a Critical Duty Day, whether voluntary or required, shall receive in addition to overtime pay the normal Critical Duty Day stipend. Martin, Clerk Mr. Chuck Leone, City Attorney, presented the Board with the 2009 Working Agreement modifying certain provisions of the existing Agreement for the 2008 calendar year with the South Bend Fraternal Order of Police, South Bend Lodge No. 36. He stated that the two Letters of Understanding added to the agenda are related to the working agreement and address the revenue restraints anticipated in 2009. Mr. Leone noted that negotiations went well and resulted in a good working agreement for everyone. Upon a motion by Mr. Cottrell, seconded by Mr. Bon Durant and carried, the 2009 Working Agreement was approved. APPROVE LETTER OF UNDERSTANDING CONCERNING DEPARTMENT STRENGTH Upon a motion by Mr. Cottrell, seconded by Mr. BonDurant and carried, the Letter of Understandin Concerning Department Strength was approved. The Letter addresses the unprecedented financi uncertainties of the future and the possibility of personnel cutbacks in the future years. I Upon a motion by Mr. Cottrell, seconded by Mr. Bon Durant and carried, the Letter of Understanding Concerning Article 20 of the 2009 Working Agreement was approved. The Letter addresses the unprecedented financial uncertainties of the future and possible resulting modifications to the insurance benefits.
