Councilmember Oliver Davis noting a quorum of his Zoning & Annexation Committee present called the
meeting to order.
Three bills were listed for consideration. The first was bill 15 -65. This was a request from Charles Hayes
for a special exception to allow a communications tower in an SF1 District. Chuck Bulot, head of the
Building Department made the initial presentation. He said the Board of Zoning Appeals (BZA) had given
the petition a unanimous favorable recommendation.
Ann Hayes, representing the petitioner described the tower's size, location as well as need for the
tower. She noted the nearby Portage Manor and County Commissioner Andy Kostielney supported the
project. With no questions from the public or Council, Valerie Schey moved for a favorable
recommendation. Henry Davis offered a second. All affirmed.
The second item bill 15 -66 asked for a special exception to allow a recreational use for a batting and
pitching facility in an LI District.
Chuck Bulot, head of the Building Department made the presentation noting that the BZA had given a
unanimous favorable recommendation to the petition.
Mike Branch, the principal investor, described the particulars of the proposed facility. In answer to
Valerie Schey's question about adequate parking, Mr. Branch said the 16 available slots was more than
enough.
With that Valerie made a motion to recommend favorably. Henry David seconded and everyone
supported.
The last bill 15 -67 was a special exception request to allow a child care facility in an SF2 District.
Chuck Bulot again made the presentation noting that the BZA by a vote of 5 to 1 sent the bill to Council
favorably subject to written commitments of no more than twelve children with none being older than 5
years old.
Emily Sandock, owner of the proposed Toddler House, said she was agreeable to the commitments also
saying the hours of operation would be 7:30 AM to 5:30 PM.
Both Valerie Schey and Karen White asked about the adequacy of parking and were satisfied with Emily
Sandock's answers.
Council Attorney Kathy Cekanski- Farrand reminded the Council of the written commitments.
Valerie Schey motioned for a favorable recommendation subject to adherence to the commitments.
Henry Davis seconded and all supported.
Mr. Oliver Davis adjourned the meeting at 4:05 PM.
