Ii07 -89 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND APPROVING THE ISSUANCE OF SCRAP METAL /JUNK DEALERS/ TRANSFER STATIONS LICENSES FOR THE CALENDAR YEAR 1989 WHEREAS, the Common Council of the City of South Bend recognizes the contributions that operations such as junk /scrap and recycling dealers make to the community; and the Council further realizes that such operations must be reasonably regulated in order to minimize any environmental or aesthetic nuisances which may be created by the operations of scrap /junk /and recycling dealers within the City; and WHEREAS, the Common Council of the City of South Bend has enacted reasonable rules and regulations with regard to the issuance of licenses and the operations of the scrap /junk /and recycling dealers; WHEREAS, in accordance with these rules and regulations, inspec- tions of the below listed scrap /junk /and recycling operations have been completed by the Department of Code Enforcement and the Fire Department Prevention Bureau, and it has been found that such premises are fit and proper for the maintenance and operation of such businesses; and WHEREAS, the Board of Public Works, at its meeting held on February 13, 1989, recommended the issuance of licenses for the below listed applicants in the City of South Bend by appropriate action of the Common Council. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the license applications for the following be approved based upon the satisfactory review of the properties by the Department of Code Enforcement and the Fire Department Prevention Bureau, inspections having been made in January /February, 1989, and subsequent favorable recommendation by the Board of Public Works: A -1 Auto Parts Boliden Metech, Inc. Kernan, Mayor Board of Public Works February 13, 1989 MEMBERS OF THE COMMON COUNCIL COUNCIL CHAMBERS 4th Floor, County -City Building South Bend, Indiana Dear Members of the Council: In accordance with the procedure for the renewal of license applications for scrap /junk /recycling operations, inspections of the premises of seventeen (17) dealers submitting renewal license applications were conducted by the Fire Prevention Bureau and the Department of Code Enforcement in January and February of 1989. The properties were inspected for fire code violations, environmental violations, proper maintenance of the premises and areas outside fenced -in areas, and the height and condition of surrounding fencing. The Board of Public Works, at its meeting held on February 13, 1989, adopted Resolution No. 5 -1989 recommending the approval of license renewals for 1989 for the seventeen (17) dealers as listed. We are, therefore, submitting to you the attached Resolution for consideration as the Board has found that the seventeen (17) scrap /junk /recycling dealers listed on the Resolution have met the technical requirements of the ordinance. smp Enc. DeClercq Katherine Humphreys RESOLUTION NO. 5 -1989 WHEREAS, scrap metal /junk dealers /transfer stations license renewal applications for the year 1989 have been received by the Board of Public Works; and WHEREAS, inspections of the properties have been completed by the Department of Code Enforcement and the Fire Prevention Bureau as required by Chapter 4, Article 4, Section 4 -51 of the Municipal Code; and WHEREAS, the Department of Code Enforcement and the Fire Prevention Bureau have found that such premises are fit and proper for the maintenance and operation of such businesses; and WHEREAS, Chapter 4, Article 4, Section 4 -51 of the Municipal Code requires adoption of a Resolution of the Board of Public Works recommending the renewal of the license applications. NOW, THEREFORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend, Indiana, that the license renewal applications for the following be recommended favorably based upon the satisfactory review of the properties by the Department of Code Enforcement and the Fire Prevention Bureau: A -1 Auto Parts Boliden Metech, Inc.
