Mayor RESOLUTION NO. 1'730-0 A RESOLUTION OF THE SOUTH BEND COMMON COUNCIL ADOPTING A WRITTEN FISCAL PLAN ESTABLISHING A POLICY FOR THE PROVISION OF SERVICES TO AN ANNEXED AREA WHEREAS, Relative Real Estate Management Inc. has petitioned the Common Council to annex an area specifically described in Attachment "A ", incorporated herein; and WHEREAS, responsible planning and State law require adoption by the City of a fiscal plan and a definite policy for the provision of services to annexed areas; and WHEREAS, such a plan has been developed and presented to the Common Council. NOW, THEREFORE, BE IT RESOLVED by the Common Council of the City of South Bend, Indiana, that: Section I: The Common Council of the City of South Bend, Indiana, hereby approves and adopts the fiscal plan for the annexation of the area located in Penn Township near the intersection of Jackson and Grass Roads, more specifically described in Attachment "A ", which plan is attached hereto as Attachment "B" and made a part hereof, and hereby approves and adopts specific policies for implementation of the plan as set out therein. Section II: It is estimated that the implementation of the plan may require budgeting and appropriation of additional funds in the approximate amount of $50,000 per year to provide police protection to the annexation area. Section III: All services of a noncapital nature will be provided to the annexed area within one (1) year after the effective date of annexation in a manner equivalent in standard and scope to those services provided to areas within the corporate boundaries that have similar topography, patterns of land use, and population density. Section IV: Capital improvements will be provided by the developer within three (3) years of the effective date of annexation. Implementation of the plan will not require the appropriation of funds for capital improvements to the annexed area by the city of South Bend, Indiana. Section V: The annexation will not result in the elimination of jobs of employees of another governmental entity. Section IV: This resolution shall be in full force and effect after its adoption by the Common Council and approval by the Mayor. MY &YV lffl!�f.1zW 0)1 ;;WWIRl • i ��• • • i ••••�•a • �� � •� i • � is The following Fiscal Plan, developed through the cooperative efforts of the City of South Bend's Controller's Office, Department of Public Works, Police Department, Fire Department, Department of Neighborhood Code Enforcement, and the Department of Public Works, represents the City's policy for the annexation of the property located near the southeast corner of the intersection of Jackson and Grass Roads (hereinafter, "Annexation Area "). This annexation meets the statutory contiguity requirements. I. LOCATION Parcel I of the Annexation Area is located in North One -third of the West half of the Northwest Quarter of Section 33, Township 37, North, Range 3 East, Penn Township, St. Joseph County, Indiana near the intersection of Jackson and Grass Roads. Parcel II of the Annexation Area is located in the Southeast Quarter of Section 32, Township 37 North, Range 3 East, Indiana near the intersection of Johnson of both parcels are attached as Exhibit 1. attached as Exhibit 2. There are 26.81 a cre s 81.01 acres of land in Parcel II. II. EXISTING LAND USE Penn Township, St. Joseph County, Legal and Hickory Roads. Legal Descriptions A map of the Annexation Area is of land within the Parcel I and The Annexation Area is currently vacant land. Relative Real Estate Management Inc. proposes to develop the site for single - family residences. Parcel I will have no more than 134 lots and Parcel II will have no more than 405 lots. All surface drainage is to be handled through the use of retention basins located throughout the proposed subdivision in compliance with the City of South Bend Subdivision Standards. Relative Real Estate Management Inc. will provide all streets, street lighting, water facilities, sewers, and stormwater drainage facilities throughout the Annexation Area. A. Public Works No expenditure of funds by the City will be required to provide capital improvements due to the fact that Relative Real Estate Management, Inc. will be providing street construction, street lighting, sewer facilities, water facilities, and stormwater drainage facilities throughout the Annexation Area. The proposed streets represent less the one percent (1 %) of the City's current road system and can be easily maintained with existing personnel and equipment. The wastewater treatment and collection systems can provide service to the proposed area without any additional expenditures by the City. The water system is adequate and available for the Annexation Area. The City can also provide solid waste collection services to the Annexation Area without additional equipment or personnel. B. Police Protection The Annexation Area will be added to the existing patrol district known as Beat 15. Police services to be provided to the Annexation Area will include traffic patrol, preventive patrol, crime deterence, police reporting services, and emergency responses.by the Department. The street locations within the Annexation Area will permit adequate access for police patrols as well as offering resistance to criminal activity. No unusual problems are anticipated; however, the number of homes, the proximity areas of high activity and traffic flow will require the City of South Bend to budget and appropriate additional funds in the approximate amount of $50,000 per year to provide police protection to the Annexation Area. C. Fire Protection The South Bend Fire Department can provide reasonably comparable fire protection to the proposed annexed area. The Annexation Area is located approximately 3.8 miles from South Bend Fire Department Station #10 at 308 West Ireland Road. Additional Fire Department units would respond, including Engine #8, which is located approximately 3.8 miles at 2402 Twyckenham. Response times will be comparable to other areas near the Annexation Area which are also served by stations 8 and 10. The Fire Department is in the process of considering the relocation of Station 10 to a location more central to the area served. It is anticipated that the relocation will occur within the next three to five years. No additional cost to the City can be attributed to the annexation of this area at this time. D. Neighborhood Code Enforcement The Department of Neighborhood Code Enforcement can perform code enforcement activities without acquiring additional equipment or hiring of additional personnel. The Human Society of St. Joseph County currently provides animal control services on a County -wide basis. E. Public Parks There are adequate park facilities in the Southeast portion of the City which can be utilized by residents of the Annexation Area. Parks and facilities which are reasonably close to the Annexation Area are: Hamilton Park which has playground equipment, picnic tables and ball diamonds; Erskine Golf Course, which has an 18 hole course, O'Brien Park which has picnic facilities, lighted softball diamond, football field, playground equipment and about five (5) acres of woods; and Marshall Park, which has a tot lot, lighted tennis courts, ball diamonds, and a football field. No additional personnel or equipment will be needed to provide services to the Annexation Area. V. HIRING PLAN This annexation will not result in the elimination of jobs of employees of another governmental entity. EXHIBIT 41' PARCEL I.
