SECTION 1. It shall be unlawful for any person, firm or corporation to give, conduct, keep, allow and /or maintain any form of entertain- ment, amusement and /or exhibition at, in or in connection with any restaurant, public eating place and /or club.within the City of South Bend, without first having obtained a license therefor from the Con - troller of the City of South Bend. This section shall not apply to the use of a radio and /or phonograph in such place, or places, unless there be dancing to the music furnished by such instruments. SECTION 2_ It shall be unlawful for any person, firm or corporation to give, conduct, keep, allow and/or maintain any form of entertain- ment, amusement and /or exhibition at, in or in connection with any restaurant, public eating place and/or Club where beer and /or in- toxicating liquors are sold for consumption on the premises in the City of South Bend, without first having obtained a license therefor from the Controller of the City of South Bend. This section shall not apply to the use of a radio and/or phonograph in such place, or places, unless there be dancing to the music furnished by such in- struments. SECTION 3. It shall be unlawful for any person, firm or corporation to give, conduct, keep, allow and /or maintain any form of entertain- ment, amusement and /or exhibition at, in or in connection with any restaurant, public eating place and/or club, where intoxicating liquors are sold for consumption on the premises, at any point beyond, but within four (4), miles of the limits of the City of South Bend, without first having obtained a license therefor from the Controller of the City of South Bend, Indiana. This section shall not apply to any point within the corporate limits of another municipal corpora- tion. This section shall also not apply to the use of a radio and /or phonograph in such place, or places, unless there be dancing to the music furnished by such instruments. SECTION 4. Any person, firm or corporation desiring to give, con- duct, keep, allow and/or maintain any form of entertainment, amuse- ment and /or exhibitions at, in, or in connection with any restaurant, public eating place and/or club as in Sections 1 and 2 of this Ordinance provided shall first file his, their or its application for a license therefor with the Controller of the City of South Bend, Indiana, which application shall state his, their or its name, the proposed place of business, the character and nature of the thing, or things, to be done and /or the entertainment, amusement and /or exhibition proposed to be given and with said application shall deposit a receipt from the City Treasurer, which receipt shall show that the applicant has paid to such Treasurer the sum hereinafter fixed to be paid for such license. The Controller may refuse to grant any such license when he has reasonable cause to believe that the things proposed to be done thereunder will be in violation of this Ordinance and /or any Ordinance of this City, or law of the State of Indiana. 1 - SECTION 5. No entertainment, amusement and /or exhibition shall be given, conducted, kept, allowed or maintained in the places so licensed between the hours of One OtClock A.M., and Two O +Clock P.M., of any day, except on New Year's Eve. SECTION 6. No person who is not twenty -one (21) years of age or over shall be allowed to be in any place so licensed at which beer and /or intoxicating liquor are served. SECTION 7 All women served at a place so licensed shall be served at tables and not otherwise. SECTION 8. No person, firm or corporation to whom any license may have been granted under this Ordinance shall give, con- duct, keep, allow or maintain in the place so licensed any form of entertainment, amusement and /or exhibition which is indecent and /or immoral. Said license may be revoked for any violation of this Section and the licensee shall be subject also to the penalty hereinafter provided. Any such license may be revoked for any violation of the laws of the State of Indiana committed in the place so licensed. SECTION 9. The license ?e herein provided for shall be Dollars ( 2.' ) per annum. SECTION 10. The license issued un the provisions of this Ordinance shall -•Q� transferable. The licensee hereunder lidej§gor s 1 be responsible and held account- able for all t &"�gt ainment, amusement and /or :exhibi- tions which �y --b'e given, conducted, kept, allowed and /or maintained in the places so licensed or connected there- with. SECTION 11. This Ordinance is in addition t> all other Ordinances regulating and licensing theaters, shows, eating places and occupations and not in repeal or derogation thereof. SECTION 12. The Board of Safety by and through its Department of Public Safety is hereby charged with a strict and im- partial enforcement of all of the provisions of this Ordinance. SECTION 13. If any section, part of section, or part of this Ordinance should be declared illegal it shall not effect the validity or force of any other section, part of section or part of this Ordinance. SECTION 14.4 Any person, firm or corporation violating any provision of this Ordinance shall be fined in any sum not exceed- ing Three Hundred ($300.00) Dollars to which may be add- ed imprisonment in the County Jail for a period not ex- ceeding sixty (60) days and each day's violation shall constitute a separate offense.
