City Clerk `1 19 � Mayor RESOLUTION NO. 1 ? 3 60- A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, INDIANA APPROVING AMENDMENTS TO THE CHARTER OF THE EMPLOYMENT & TRAINING SERVICES OF ST. JOSEPH COUNTY WHEREAS, the Employment & Training Services of St. Joseph County, formerly the St. Joseph County Job Training Program, was created in October of 1989 pursuant to Section 36 -1 -7 et. seq. of the Indiana Code; i.e. Interlocal Cooperation Act, to provide employment and training services in accord with the provisions of the Job Training Partnership Act of 1982, as amended, the Wagner - Peyser Act, as amended, and other applicable federal, state, and local laws to eligible residents within the geographical boundaries of St. Joseph County, including the cities of South Bend and Mishawaka; and WHEREAS, the Private Industry Council for St. Joseph County and the Private Industry Council for the Northern Indiana Job Alliance have unanimously agreed that a merger of the two service delivery areas will promote enhanced and expanded employment and training services to the residents of Elkhart, Kosciusko, Marshall and St. Joseph Counties; and WHEREAS, the Board of Commissioners for Elkhart County, Kosciusko County, Marshall County and St. Joseph County have agreed to join together as a single employment and training service delivery area and have petitioned the Governor of Indiana to redesignate the Northern Indiana Job Alliance, minus LaGrange County, and St. Joseph County as one service delivery area; and WHEREAS, the four counties involved in the merger form a common labor market area and conform to other state services districts (i.e. Indiana Rehabilitation Services, Department of Public Welfare, Indiana Vocational Technical College - Northcentral, Economic Planning Region Two, etc.); and WHEREAS, the Governor has approved this petition, and has directed the creation of a new Private Industry Council and the designation of a new grant recepient and administrative entity for JTPA and Wagner Peyser funds allocable to the new service delivery area, and has indicated his desire that said entities be in place and operation by July, 1991; and WHEREAS, the Employment & Training Services of St. Joseph County is the grant recipient and administrative entity for the St. Joseph County service delivery area, and it has been recommended by both Private Industry Councils that the Employment & Training Services of St. Joseph County become the grant recipient and administrative entity for the four county area; and WHEREAS, it has been determined by the Board of the Employment & Training Services of St. Joseph County that the above can best be accomplished by amending the Charter of the Employment & Training Services of St. Joseph County to change its name to the Workforce Development Services of Northern Indiana and to expand its responsibilities and functions to allow it to serve as grant recipient of Job Training Partnership Act, Wagner - Peyser, and other funds and to administer the same and to provide other services as deemed appropriate by the Board of the Employment & Training Services of St. Joseph County and to allow other general local units of government to join this Employment & Training Services upon the approval of their respective Common Council or County Council; and WHEREAS, equivalent resolutions will be approved by the Common Council of the Citv of Mishawaka and the County Council of St. Joseph County; NOW THEREFORE, BE IT RESOLVED THAT: Section I. The Common Council of the City of South Bend has considered and hereby approves the Amended Charter Agreement of the Workforce Development Services of St. Joseph County, a copy of said Agreement being attached hereto, changing its name to Workforce Development Services of Northern Indiana and expanding its functions to allow it to serve as ,grant recipient of Job Training Partnership Act, Wagner - Peyser, and other funds and to administer the same within Elkhart, Marshall, Koszciusko and St. Joseph Counties, to provide other services as deemed appropriate by the Board of Workforce Development Services of Northern Indiana, and to allow other general local units of government to join the Workforce Development Services upon the approval of their respective Common Council or County Council. Section II. The Common Council of the City of South Bend authorizes the Mayor of the City of South Bend to enter into an agreement, pursuant to Section 36 -1 -7 et seq. of the Indiana Code, i.e. Interlocal Cooperation Act, amending the Charter of the Employment & Training Services of St. Joseph County so as to comply with the mandates of Section 22- 4 -18 -1 et. seq. of the Indiana Code. Section III. This resolution shall be in full force and effect upon passage by the Common Council and approval by the Mayor of the City of South Bend.
