Presented by me to the Mayor of the City of South Bend, Indiana Approved and signed by 0 MW City Clerk AN ORDINANCE NO. 9 BE IT ORDAINED by the Common Council of the City of South Bend, Indiana. SECTION L. - That it shall be unlawful for any person, persons, firm or corporation, to advertise, operate, maintain, promote andj or aid in advertising, operating, promoting or maintaining or to participate in any mental or physical endurance contest, in the nature of a marathon, walkathon, skatathon or any other such en- durance contest of a like or a similar nature. Nothing in this or- dinance shall apply to the continuance of the ordinary amateur or professional athletic events or contests or high school, college, or inter - collegiate sports. SECTION 2" -It shall be unlawfy] for any person, firm or corpora - tion to lease, rent and /or sub -let any room, hall or building to be used for any of the exhibitions, -in Section One of this Ordinance forbidden. SECTION 3. - That any person, car; persons, firm or corporation par- ticipating in or promoting anyrsuch contest and /or violating any of the provisions of this ordinance upon conviction thereof, shall be fined not less than Fifty Dollars ($50.00) nor more than Two Hundred Dollars ($200.00), to which may be added imprisonment in the County Jail for a period of not to exceed thirty (30) days. Each day on which violation continues shall constitute a separate offense. SECTION 4. - If any part or section of this Ordinance shall, for any reason be invalid it shall not invalidate any other part thereof. SECTION 5. - That Ordinance Number 3017 of the Ordinances of said City is hereby repealed. SECTION 6. - This Ordinance shall be in full force and effect from and after its passffge, approval and p lication, as provided by law.
