G Clerk Mayor RESOLUTION NO.: ) ?96— i 1 A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND AUTHORIZING THE EXECUTION OF AN AGREEMENT FOR HAZARDOUS MATERIAL INCIDENT RESPONSE SERVICES BETWEEN THE CITY OF SOUTH BEND AND THE INDIANA DEPARTMENT OF TRANSPORTATION WHEREAS, the Common Council of the City of South Bend recognizes the existence of the South Bend Fire Department Hazardous Materials Incident Response Team consisting of trained personnel and equipment for response to hazardous materials incidents; and WHEREAS, because of continued increase in vehicular traffic transporting hazardous materials on the Toll Road, the Indiana Department of Transportation wishes to continue to receive the services of the South Bend Fire Department Hazardous Materials Incident Response Team for response, assessment and control of hazardous materials incidents occurring within its jurisdiction; and WHEREAS, I.C. 36 -1 -7 -1 et seq. permits governmental entities to exercise powers jointly by entering into a written agreement; and WHEREAS, on June 26, 1991, the Board of Public Safety reviewed this request of the Indiana Department of Transportation, and recommends that the Common Council approve the renewal of an Agreement for Hazardous Materials Incident Response Services with the Indiana Department of Transportation, Toll Road Division. NOW, THEREFORE, BE IT RESOLVED, by the Common Council of the City of South Bend, Indiana, as follows: SECTION I. That the Common Council of the City of South Bend renew the Agreement with the Indiana Department of Transportation for Hazardous Materials Incident Response Services and the Mayor be authorized to execute the appropriate Agreement necessary to carry out the request of the Indiana Department of Transportation and intent of this resolution. SECTION II. This Resolution shall be in full force and effect from and after its adoption by the Common Council and approval by the Mayor.
