RESOLUTION NO. /9/ -YA
A RESOLUTION OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND,
INDIANA, ADDRESSING THE AMERICANS WITH DISABILITIES ACT
WHEREAS, there are approximately 43 million persons with physical or mental
disabilities living in the United States; and
WHEREAS, approximately ten percent of persons between the ages of 18 and 64
are disabled with sixty -seven percent of those individuals being unemployed; and
WHEREAS, the first phase of the Americans With Disabilities Act will take effect
on January 26, 1992; and
WHEREAS, the City of South Bend has appointed an Americans With Disabilities
Act Committee to represent all of the major departments, bureaus, and other agencies of the
City to assist with the administration of the ADA; and
WHEREAS, the Common Council acknowledges that Title II of the ADA requires
that the City designate at least one (1) responsible employee to coordinate compliance with
the Americans With Disabilities Act; and
WHEREAS, the City acknowledges that this new federal law provides
comprehensive civil rights protections to individuals with disabilities in the areas of
employment, public services, public accommodations, and services operated by private
entities and telecommunications.
NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE
CITY OF SOUTH BEND, INDIANA, as follows:
SECTION I. The Common Council and the Mayor of the City of South Bend,
Indiana pursuant to the Americans With Disabilities Act hereby commit the City to do all
that is reasonably necessary to meet the compliance requirements of the Americans With
Disabilities Act (ADA).
SECTION 1I. The City hereby designates and makes available to the public the
name, office address, and office telephone of the "responsible employee" who will
coordinate compliance with the Americans With Disabilities Act for the City of South Bend:

SECTION III. The City wishes to acknowledge publicly the pro bono assistance
provided by the Law Firm of Barnes & Thornburg through it's attorney Adam A. Milani,
who has assisted Don Fozo,the Building Commissioner for the City of South Bend and St.
Joseph County, and John Embrickson, the "responsible employee" for ADA compliance
for St. Joseph County; as we work together to meet all of those compliance requirements of
the Americans With Disabilities Act.
SECTION IV. This Resolution shall be in full force and effect from and after its
adoption by the Common Council and approval by the Mayor.
