(c) Milk or cream for the purpose of pasteurization
kept at a temperature higher than sixty- five (65 degrees)
Fahrenheit.
(d) Milk or cream produced from cows during the period
of fifteen (15) days preceding parturition, or within such
time thereafter as the milk is abnormal.
(e) Milk or cream which has been produced, stored,
handled, or transported in any unclean or 'insanitary manner
or has been ordered excluded from the City of South Bend by
the Board of Health.
(f) Yi.lk or cream which is placed in containers not
properly washed and sterilized.
(g) Milk containing more than 500,000 bacteria per
cubic centimeter, as shown by the standard method of milk
analysis of the American Public Health 'Association.
(h) Grade "Ae Pasteurized milk or cream and any and
every dairy product such as cheese or butter which does not
come from herds having been found to be free from tuberculosis
and free from all other diseases.
(i) Milk which has had the cream line increased by an
artificial means.
(k) Pasteurized milk or cream which has not been pro-
perly pasteurized.
(1) Milk, skimmed milk or cream which has been pas-
teurized a second time.
(m) Bottled milk, skimmed milk and cream which has
not been bottled at the pasteurization plant
Section ?. That Section 24 of Ordinance 2682 be amended
to read as follows:

Section 56 That Section 28 of Ordinance 2682 be amended
to read as follows:
"(a) The use of unclean, rusty or open seamed cans, or
cans with loose fittings or punctured covers is forbidden.
(b) No person shall place or permit to be placed in
any bottle, can, utensil, vessel or other receptacle used in the
production and distribution of milk or in any vehicle used in
the delivery of milk, any offal, swill, oil, garbage or other
offensive material.
(c) No person shall return any milk can or bottle which
has contained any offal, swill, oil garbage, or other offen-
sive material or is in any unclean or offensive condition.
(d) Yi.lk cans and milk bottles, either empty or filled,
being delivered to, or to be picked up from, bakeries, delica-
tessen stores, restaurants, groceries, milk depots or other
similar places, shall not be allowed to stand upon the side-
walk or street."
Section 6. That Section 42 of Ordinance 2682 be amended
to read as follows: "The Board of Health shall appoint quali-
fied persons as milk inspectors who shall hold office at their
pleasure. They shall receive such compensation as may be fixed
by the Board ofHealth, the same to be paid out of the annual
Board of Health appropriation. They shall be the Board of
Health's representatives in all matters pertaining to milk
and dairy inspection and they shall perform such duties and
shall have such powers and authority in making of inspections
under this ordinance as may from time to time be prescribed
by the Board of Health."
Section 7. If any section or provision of this ordinance
shall be construed or held as void, it shall not affect the

validity of any other provision or section which, standing
alone, shall be valid.
Section 9. That this ordinance shall be in full force
and effect from and after its passage and legal publication
thereof.
