HomeMy WebLinkAbout04/15/2015 Board of Public Safety MeetingAGENDA REVIEW SESSION APRIL 15, 2015 33 The Board of Public Safety met in the Public Agenda Session at 8:10 a.m. on Wednesday, April 15, 2015 in the 13fh Floor Boardroom, County-City Building, 227 West Jefferson Blvd., South Bend, Indiana, with Board President John Collins and Board Members Eddie Miller, and Luther Taylor present. Board Member Daniel Jones was absent. Also present was Police Chief Ronald Teachman, Assistant Fire Chief James Lopez, and Board Legal Counsel Tasha Outlaw. Board members discussed the following agenda items: Set Hearing of Disciplinary Charges No. 2015 -01 —Michael Brown Attorney Stephanie Steele stated the proposed date for the above hearing is May 26, 2015. - Permanent Promotions from Special Assignment Assistant Chief James Lopez stated both candidates, Brian Koloszar and Jay Riba have completed their one (1) year probationary period and exceeded every expectation. He noted they were evaluated every three (3) months. - Approve Promotion Ranking List for Captaincy Assistant Chief Lopez stated these candidates have gone through extensive testing, both physical and mental. He noted everybody that passes the cut goes on to the promotion list and is ranked. He noted this is the final ranking list and it is good for two (2) years or until everyone is promoted, at which time the process starts over - Set Hearing of Disciplinary Charges No. 2015 -02 — Theodore Robert Attorney Stephanie Steele stated she has received potential dates from the City's attorney, but not from Mr. Robert's attorney yet. - Approve Duty manual General Order Policy Police Chief Ronald Teachman stated he submitted a draft of the Irecord policy to the Board previously for their review. He noted he has not heard back any changes, and is therefore asking for the Board to approve the policy in final form. Chief Teachman stated this system will replace the current antiquated system. Ile explained the current system has had numerous failures, and the Irecord system is the flick of a switch on the wall and doesn't require any dvd's or ed's. Employee of the Month Chief Teachman stated Sgt. Joe Leszezynski and Pfc. Michael Tutino were selected for their work on a murder in February. He noted the officers tracked footprints in the snow and came across a trash truck. The driver indicated he had seen someone in the area and saw them dispose of something in the trash he collected. The officers tracked the suspect to a vacant house, made contact with the assailant and convinced him to surrender. They then were able to track the murder weapon in the trash. - Officers of Year — Kelly Waite and Greg Howard. Chief Teachman stated that every month Greg Howard's name comes up as a candidate for Employee of the Month. Officer Kelly Waite stepped up and became the lead of the burglary division and took the lead on "leads on line" used for tracking stolen items. - Monthly Statistical Analysis Chief Teachman noted the alarming 20% increase in Part 1 Crimes and stilted it is due in large part to the increase in larceny, which is bigger than all categories. He noted the decrease in rape, but an increase in all other categories. Chi efTeachman stated persons shot is showing a 3 8 -3 9% reduction since the last call -in (third), but the FBI doesn't require them to track those statistics. - Grievance Appeals - Eric Downey and David Beaty Attorney Tasha Outlaw noted a correction to the section of the working agreement referenced on the agenda. She stated for Officer Downey's 2014 Grievance, the reference should be Article 7, Section 1, Step 4 of the 201.3 -2014 Working Agreement. For Officer Beaty, the reference should be to Article 7, Section 1, Step 4 of the 2013 -2014 Working Agreement. Board President John Collins and Board Members Eddie Miller and LuthcT Taylor were present. Board Member Daniel Jones was absent. Also present was Legal CounseLfasha Outlaw. Board members did not discuss any subject matter other than the subject matter as specified in the Public Notice. Martin, Clerk REGULAR MEETING APRIL 15.2015 The Board of Public Safety met in the Regular Meeting at 9:15 a.m. on Wednesday, April 15, 2015, with Board President .John Collins and Board Members Eddie Miller and Luther Taylor present. Board Member Daniel Jones was absent, Also present were Police Chief Ronald Teachman, Assistant Fire Chief James Lopez, Legal Counsel Tasha Outlaw, and Attorney Stephanie Steele. The meeting was held in the 13' Floor Boardroom, County-City Building, 227 West Jefferson Blvd., South Bend, Indiana. APPROVE MINUTES OF PREVIOUS MEETINGS Upon a motion by Mr. Miller, seconded by Mr. Taylor and carried, the Board approved the Minutes of the Public Agenda Session, Executive Session, and Regular Meetings of March 18, 2015, as presented. TABLE APPROVAL OF BOARD OF SAFETY GRIEVANCE PROCEDURES Upon a motion by Mr. Taylor, seconded by Mr. Miller and carried, the Board tabled the approval of the Grievance Procedures. FIRE DEPARTMENT SET HEARING OF DISCIPJ,NARY CHARGES NO 2015-01 MICHAEL BROWN Upon a motion by Mr. Taylor, seconded by Mr. Miller and carried, the Board set the hearing of REGULAR MEETING APRIL 15.2015 35 Charges No. 2015 -01., Michael Brown, for May 26, 2015. APPROVE PERMANENT PROMOTION TO THE RANK OF CAPTAIN —BRIAN KOLOSZAR In a letter to the Board, Fire Chief Stephen Cox stated that on April 16, 2014, Firefighter Brian Koloszar was placed in the position of Captain in Special Assignment. The assignment required several evaluations in order to determine his abilities in a leadership position. Assistant Chief James Lopez stated that Firefighter Koloszar has completed all requirements of the position he has occupied in outstanding fashion and he is therefore recommending that he be permanently promoted to the rank of Captain, no longer in Special Assignment, effective April 15, 2015. Therefore, upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the recommendation for promotion was accepted and approved. APPROVE PERMANENT PROMOTION TO THE RANK OF CAPTAIN JAY RIBA In a letter to the Board, Fire Chief Stephen Cox stated that on April 16, 2014, Firefighter Jay Riba was placed in the position of Captain in Special Assignment. The assignment required several evaluations in order to determine his abilities in a leadership position. Assistant Fire Chief James Lopez stated that Firefighter Riba has completed all requirements of the position he has occupied in outstanding fashion and he is therefore recommending that he be permanently promoted to the rank of Captain, no longer in Special Assignment, effective April 15, 2015. Therefore, upon a motion made by Mr. Taylor, seconded by Mr. Miller and carried, the recommendation for promotion was accepted and approved. ACCEPT AND APPROVE PROMOTION LIST FOR CAPTAINCY - Brent Van Bruaene - Nathan Giszewski - Dan Luther - Mat Willoughby - Steve Pritz - Steve Downey - Mike Szucs In a letter to the Board, Fire Chief Stephen Cox recommended the above listed individuals be approved for the list of candidates eligible for promotion to the rank of Captain. Chief Cox noted the listed individuals have completed and received the top scores during the recently completed South Bend Fire Department Captain's Promotion Process. He stated if, during the next year, all seven (7) of these individuals are promoted, additional testing will be completed in order to present the Board with a new list of Firefighters for promotion to Captain. Upon a motion made by Mr. Taylor, seconded by Mr. Miller and carried, the above list of candidates eligible for promotion to Captain was accepted and approved. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT MARCH 2015 Fire Chief Stephen Cox submitted to the Board the monthly report for March 2015 compiled by the Prevention/Inspection Bureau of the Fire Department. Mr. Collins stated if there were no objections, the Board would accept the report for filing as presented. The report summarizes travel and training expenditures for the South Bend Fire Department personnel during this quarterly period. In his letter, Chief Cox stated that training is essential to all aspects of fire service and it is necessary to remain abreast of the most current firefighting technologies and -- emergency medical services. Assistant Chief James Lopez noted the training is up substantially this quarter, but the Fire Department recognized the need for continual training for their Captains and Chiefs. There being no questions concerning this report, the Quarterly Report for Travel and Training Expenditures was accepted and filed POLICE DEPARTMENT SET HEARING OF DISCIPLINARY CHARGES NO. 2015 -02 — THEODORE. ROBERT Upon a motion by Mr. Miller, seconded by Mr. Taylor and carried, the Board approved the setting of the hearing of Charges No. 2015 -02 for Theodore Robert for May 11, 2015. DENY REQUEST FOR HEARING OF DISCIPLINARY CHARGES — SUZANNE DIETER In a letter to the Board, Chief Teachman informed the Board that Patrolwoman Suzy Dieter was advised of a three day suspension without pay due to violations of Police Department Duty Manual, Section 302.00(A)(31) entitled Rules of Conduct. Subsequently, Patrolwoman Dieter submitted a letter to the Board in which she requested the Board give her an opportunity for a hearing on the discipline. President Collins stated the Board discussed this request in their Executive Session and concluded that based on State Statute, it is under the Chief of Police's authority to impose a suspension under five (5) days. He noted the discipline did not include a demotion or exceed five (5) days, therefore they agreed the Chief was acting under his authority. Upon a motion by Mr. Taylor, seconded by Mr. Miller and carried, the request for a hearing was denied. APPROVE CHANGES TO DUTY MANUAL GENERAL ORDERS IRECORD Chief Teachman stated he submitted a draft of the B2ecord policy to the Board at a previous meeting and he is now asking the Board for their final approval of the new General Order policy. Upon a motion by Mr. Taylor, seconded by Mr. Miller and carried, the change to the Duty Manual in the form of a General Order was approved. ACCEPT AND APPROVE DECLARATION OF RETIREMENT DAVID GNOTH In a letter to the Board, Police Chief Ronald Teachman submitted the Application and Declaration for Retirement for Patrolman David Gnoth effective May 11, 2015. Chief Teachman noted that he is retiring after serving the Department for thirty -six (36) years, five (5) months, and fourteen (14) days. Upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the retirement was accepted and approved. ACCEPT AND APPROVE RESIGNATION — DEVON JOHNSON In a letter to the Board, Police Chief Ronald Teachman advised he is in receipt of a letter of resignation from Patrolman Devon Johnson in which he tenders his resignation from the South Bend Police Department, effective April 6, 2015. Chief Teachman stated in his letter, that Patrolman Johnson was sworn on the South Bend Police Department on March 10, 2010. Upon a motion made by Mr. Miller, seconded by Mr. Taylor and carried, the resignation was accepted and approved. APPROVAL OF SPECIAL POLICE COMMISSION SEAN KILLIAN Police Chief Ronald Teachman recommended that a Special Police Commission for a Security Officer for Indiana University South Bend be issued until revoked, for the above referred to individual. This Commission is issued for the purpose of issuing citations for parking violations where such violations have fines set by Ordinance and State Law. Chief Teachman stated in his letter all of these officers are sworn and certified through the State of Indiana by the Indiana Law Enforcement Academy Training Board. This commission has the same authority as a sworn police officer in which they have the authority to carry a weapon and the powers of arrest. Upon a motion made by Mr. Taylor, seconded by Mr. Miller and carried, the Special Police Commission was approved. REGULAR MEETING APRIL 15.2015 37 APPROVE RECOMMENDATION FOREMPLOYEESOF THE MONTH — FEBRUARY 2015 In a letter to the Board, Police Chief Ronald Teachman stated that Sergeant Joe Leszezynski and Patrolman First Class Michael Torino were selected as Employees of the Month for February 2015. The award is to recognize officers, civilian employees, on the South Bend Police Department who have demonstrated actions noted by supervisors or citizens from both a professional law enforcement position and in support of the community policing efforts with citizens of South Bend. Chief Teachman stated that the officers were instrumental in the apprehension of a murder suspect and the murder weapon due to their diligence and commitment to duty. Be noted they tracked the suspect and took him into custody without incident and found the murder weapon, all within four (4) hours during a bitterly cold snow storm. There being no further discussion, the Board accepted the recommendation of Employees of the Month as outlined above. OFFICERS OF THE YEAR 2014 — KELLY WAITE AND GREG HOWARD In a letter to the Board, Police Chief Ronald Teachman stated that investigator Kelly Waite and Patrolman Greg Howard were selected as Officers of the year for 2014. The award is to recognize officers, civilian employees, on the South. Bend Police Department who have demonstrated actions noted by supervisors or citizens from both a professional law enforcement position and in support of the community policing efforts with citizens of South Bend. Chief Teachman stated the award is given every year and is a peer review award. He stated the candidates are submitted and the peer review team votes on the winners. Chief Teachman noted Officer Howard was selected as Employee of the Month last year and is consistently nominated for Employee of the Month. Kelly Waite assumed the lead in the burglary unit and the category is in the fifth year of a decline. Chief Teachman added she also took the lead in the "leads on line" program and went above and beyond to attend community meetings to explain the program to the community. There being no further discussion, the Board accepted the recommendation of Officers of the Year as outlined above. FILING OF MONTHLY STATISTICAL ANALYSIS REPORT MARCH 2015 President Collins stated that unless there were questions or objections by members of the Board, the statistical analysis report for the month of March 2015, as submitted by the Police Department, would be accepted for filing. PRIVILEGE OF THE FLOOR Dan Demler, President of the FOP, stated he wanted to thank the Board for hearing the grievances today and noted in twenty -three (23) years, it is the first time he could think of that one made it this far. He noted it speaks well for the relationship with the City. ADJOURNMENT There being no further business to come before the Board, upon a motion by Mr. Taylor, seconded by Mr. Miller and carried, the meeting adjourned at 11:00 am.
