HomeMy WebLinkAboutAmending Ordinance No. 1808 with Reference to a Plumbing CodeAN ORDINANCE AMENDING ORDINANCE #1808 ADOPTED NOVEMBER 8, 1915, WITH REFERENCE TO A PLUMBING CODE FOR THE CITY OF SOUTH BEND PROVIDING FOR ALL MATTERS CONCERNING PLUMBING, BUILDING DRAINAGE AND BUILDING VENTILATING AND WATER SUPPLY AND GAS PIPING IN- SOFAR AS THEY EFFECT THE PLUMBING AND BUILDING DRAIN- AGE AND SANITATION IN ALL BUILDINGS ERECTED OR TO BE ERECTED IN THE CITY OF SOUTH BEND, INDIANA, AND ESTABLISHING AN EXAMINING BOARD, A CHIEF PLUMBING INSPECTOR AND DEPUTIES, AND PLAC- ING ALL UNDER THE JURISDICTION OF THE BOARD OF PUBLIC HEALTH OF THE CITY OF SOUTH BEND, INDIANA Be it.ordained by the Common Council of the City of South Bend, Indiana: Section I. That Ordinance #1808 adopted by the Common Council of the City of South Bend on November 8, 1915, be amended to read as hereinafter set forth and to provide that it shall be unlawful for any person, persons, firm or cor- poration to do, cause or permit to be done any plumbing or building drainage or the repairing of any fixtures or traps, or the connection of any domestic hot water heaters or boilers or gas water heaters of any kind or the installation or re- pairing of any water, waste or vent pipes, drains, water softeners, refrigeration or air conditioning equipment or any other plumbing or drainage work not herein mentioned that is or will be connected to any Water service, sewer, cesspool or septic tank except according to and in compliance with the following rules and regulations: Section II. Scope of ordinance. The provisions and requirements of this ordinance shall apply to all exten- sions, alterations, changes or additions, or other work to -2- be made or done in plumbing and building drainage in all buildings except as otherwise provided herein, and to the execution of all classes of work usually performed by plumbers and drain layers. Section III. The term building as herein used shall be any dwelling house, hotel, factory, office building, school theatre, church, hall, opera house and each store, flat or separate apartment of any store, apartment or flat building or any public building, restaurant, inn or barroom, and any other enclosed structure. Section IV. The term person, wherever used in this ordinance, shall mean any individual, persons, firm, partnership, corporation, or any legal entity. Section V. License required to do plumbing: It shall be unlawful for any person to install or repair any plumbing or drainage system or any part thereof within the City of South Bend, Indiana, until such person shall have procured a license as Journeyman or Master Plumber as hereinafter provided in accordance with the requirements of this Ordi- nance. Section VI. It shall be unlawful for any person or Journeyman plumber to engage in the business of plumbing contractor until such person shall have first secured a license therefor in accordance with the provisions of this Ordinance. Section VII. Term "Journeyman Plumber' defined: A Journeyman Plumber within the meaning of this Ordinance shall be any persons who shall have worked at the trade of practical plumbing for a period of at least five (5) years and shall have passed the examination hereinafter provided for. Section VIII. Any person desiring to secure a license as a plumbing contractor, commonly known as a master plumber, shall make application therefor upon a form to be provided -3- by the Board of Health, provided, however, that in case of a firm, partnership or corporation such application must be made by a duly authorized and designated agent of such firm, partnership or corporation. At the time of making such application said applicant shall pay to the Board of Health the sum of Fifteen ($15.00) Dollars as a fee for the examina- tion. Thereafter at a time and place designated by the Board of Health said applicant shall submit himself before the examining board hereinafter provided for, and answer such questions as may be asked of him by said board or any member thereof relative to the knowledge required by a plumbing contractor. If said applicant properly answers sufficient questions and performs such practical tests to qualify him in the judgment of said examining board to be a plumbing contractor, then said board shall report their findings in writing to the Board of Health. The examina- tion shall be held in the City Hall at South Bend, Indiana. Section IX. An applicant who has failed. to pass a satisfactory examination may re -apply for another examination after the expiration of sixty (60) days by filing another application and paying the prescribed fee. Section X. Examination fees and licenses; Any person desiring to work as a Journeyman Plumber or at plumbing in this city shall be required to submit to an examination before the Board of Examiners herein provided for as to his experience and qualifications in such trade; provided, how- ever, that any person now engaged in the plumbing trade as Journeyman Plumber in this city who has been so engaged for a period of five (5) years or more shall, upon satisfactory proof made therefor, and byfiling a verified statement showing his name, address and length of time he has actually served as a Journeyman Plumber, and upon the payment of Two ($2.00) Dollars to the City Comptroller, upon recommendation by the -4- Board of Health, be entitled to receive from the City Com- ptroller a Journeymants license without further examination. Section XI. Application for license. A Journeyman Plumber desiring a license authorizing him to engage in the trade as Journeyman Plumber shallmake application with the Board of Examiners on forms to be furnished by the Board and shall pay with the filing of the application a fee in the sum of Fifteen ($15.00) Dollars. Subsequent to the filing of this application and at the next meeting of the Board of Examiners the applicant shall submit himself to an examination, either oral or written or both, and also shall perform such practical plumbing work as the Board shall direct. If the applicant shall, in the opinion of the Board, have satisfactorily passed the examination said applicant shall be entitled to a license as Journeyman Plumber and the Board shall cause proper notice to issue to the Board of Health, which said last mentioned Board shall notify the Comptroller to issue a Journeyman's license to the applicant upon the payment of a fee in the sum of Two ($2.00) Dollars, Section XII. Fees for license and bond: Every appli- cant for a plumbing contractor's license having passed a satisfactory examination hereunder shall receive from the Board of Health a certificate of recommendation to the Comptroller of said City for the issuance to said applicant of an. original annual license upon the payment of the sum of Fifty ($50.00) Dollars and an annual renewal license upon the payment of Fifteen (815.00) Dollars to said City but before such license is issued the applicant shall furnish a bond with surety to the approval of the Comptroller of said City in the penal sum of Two Thousand ($2,000.00) Dollars, conditional to reimburse said City of South Bend for all the damages caused by any act or omission of said plumbing -5- contractor or any of his agents, to any property which the city may own or for which it may be responsible, and to hold said City of South Bend free apdharmless from all claims, for damages on account of the negligence or misfeasance of the plumber and from all cost and expense growing out of the defense of such claims. Said bond is to be in force from the date of its acceptance and the issuance of license by said Comptroller for a term of one (1) year, and both license and bond must be renewed annually, and no other bond shall be required of such plumber by any other department of the City except for making excavation inthe street. Section XIII. Exemption of existing plumbers; The provisions of this Ordinance that refer to examination do not apply to any plumbing contractors, commonly known as master plumbers or journeyman now duly registered and qualified under the provisions of any ordinance or plumbing code heretofore in effect. Section XIV. Appointment of a board. The Board of Health of said City of South Bend is hereby authorized and empowered to appoint an examining board consisting of one duly licensed plumbing contractor, one qualified and Com- petent licensed journeyman plumber and the plumbing in- spector of said city. Said Board shallmeet at least once each thirty days or oftener if in the judgment of the Secretary of the Board of Health it is deemed advisable. Said Examining Board shall hold office during the pleasure of the Board of Health and until its successor is appointed and qualified. Section XV. Master Plumber defined is; A Master Plumber as used in the Ordinance is any person who is engaged in the plumbing business as a contractor doing a general plumbing or drainage business for the general public and who maintains a plumbing shop or store and who may employ journeyman plumbers. -6- Section XVI. Fees for services. That the plumbing contractor, and the journeyman plumber, composing with the plumbing inspector, the Examining Board herein created, shall such receive as compensation for services rendered in connection with examination of applications in the plumbing trade either as Master Plumbers or Journeyman Plumbers, each the sum of Five ($5.00) Dollars from each applicant. This fee shall be payable as other contractual obligations of the city are now payable. The fee of Fifteen ($15.00) Dollars paid by the applicant at the time of the filing the application for examination shall be deposited by the Board of Health the same as other receipts by said Board are now deposited with the City Comptroller. Section XVII. License non - transferable. Any license secured by any Journeyman or Master Plumber under said ordinance is non - transferable and it shall be unlaw- ful to loan or transfer such a plumbing license or to allow any one to work under a plumbing license held by another. Section XVIII. Certification of name. The Board of Examiners, shall upon any applicant having passed an examination given b y said Board certify to the Board of Health the name of the applicant and state therein that said applicant is entitled to a license as either a Journeyman or Master Plumber, whereupon the Board of Health shall direct the City Comptroller to issue the applicant a license upon receipt Of the fee as herein specified. Section XIX. Necessity of permit. It shall be un- lawful to perform or do any plumbing or drainage within the City of South Bend until application for a -permit to do said work has been filed with the Plumbing Inspector and a permit has been issued therefor, except, however, -7- that the following work may be done under the supervision of a licensed master plumber in which case a permit need not be obtained; any repairs not effecting sanitation such as mending leaks in soil, waste or vent pipes; faucets, valves or water pipes, mending or replacing broken fixtures, closet bowls, tanks, kitchen boilers, or removing stoppage or releasing frozen pipes, and it shall be unlawful for any person to do, cause, suffer or permit to be done any work other than that herein specified without permit. Section XX. Fee for permit. A fee shall be charged for each permit issued. This fee shall be a minimum of One ($1.50) Dollar and fifty cents and shall be paid into the office of the Plumbing Inspector. This minimum fee shall cover four (4) trap or vented fixtures, in excess of four (4) the Plumbing Inspector shall make a charge of fifty (50�) cents. In determining the amount to be paid the following shall count as one fixture: water closet, bath tub, wash basin, sink, urinal, set of laundry trays, slop sink, refrigerator, soda fountain, drinking fountain, shower bath, bar fixture, dental cuspidor, gas water heater, floor drain and any trap except area drain; also any opening into a soil or waste pipe roughed in for the future installa- tion of any of the aforegoing named fixtures shall be counted as a fixture. Section XXI. Permit necessary. The master plumber shall, before starting any work contemplated under this ordinance, obtain a permit, which said permit shall be placed in a conspicuous place on the building where the plumbing work is being performed and which said permit shall be properly signed and filled out by the master plumber in whose name the permit was issued.. Section XXII. Plumbing Inspector appointment and duties. -g- The Plumbing Inspector shall be appointed by the Board of Health and shall hold office at the will of the appointing board, or until his successor is appointed and qualified. He shall be a practical plumber who has had at least ten (10) years actual experience either as a plumber or as an inspector of plumbing and shall also be a resident of the City of South Bend. The present encumbent of such office shall hold the same under the provisions of this ordinance. Section XXIII. Salary of Plumbing Inspector. The annual salary of the Plumbing Inspector shall be Two Thousand Four Hundred ($2,400.00) Dollars per year, payable from the City Treasurer as other salaries are paid. Section XXIV. Necessity of bond. The Plumbing Inspect- or shall execute a bond in the penal sum of Two Thousand ($2,000.00) Dollars, which said bond shall be approved by the City Comptroller for the faithful performance of his duty and shall be executed by some surety company approved by the City Comptroller. Section XXV& wherever the word "Inspector" or "Plumbing Inspector" is used in this Ordinance it shall be construed to mean the Plumbing inspector of the City of South Bend. Section XXVI. Fees. All fees collected by the Inspect- or shall, at the end of each month, be paid to the County Treasurer, acting as City Treausrer, and he shall at the same time file with the City Comptroller a report showing the number of permits issued, and the fees received therefor, together with the Treasurerts receipt for the same. He shall also at the end of each year, or sooner if requested make a report and review of his work to the Board of Health. Section XXVII. Duty. The Plumbing Inspector is hereby directed to prepare forms for all applications, permits, notices or other statements required by this ordinance and to -9- furnish same to any person entitled thereto on request. a Section XXVIII. It shall be the duty of the Plumbing Inspector of the City of South Bend to do all things re- quired of him to be done as set forth in the various sections of this Ordinance. Section XXIX. All plumbing or drainage work for which a permit is issued by the Plumbing Inspector must be inspected by him. Section XXX. The Inspector must be notified by the master plumber in charge of the work when the work is ready for inspection. All work must be left uncovered and convenient for examination until inspected and approved. No notice shall be sent for any inspection until the work is entirely ready for thorough inspection. The Journeyman Plumber making the installation must be on the premises at the time this inspection is made by the Plumbing Inspect- or. Section XXXI. All notices herein required to be given to the plumbing inspector shall be in writing on blank forms to be prepared and furnished by such inspector at his office. Such Inspector shall number same in the order received, and shall make inspection of the work herein referred to in the order in which such notices are received as nearly as may be practicable and as soon as possible. Wherever in this Ordinance it is provided any act may be done, or material used, with the consent of said Inspect- or, or wherever such Inspectorts approval is required, such consent or approval shall be in writing. Section XXXII. Power to condemn. The Plumbing Inspect- or is hereby authorized and empowered to inspect and, subject to the approval of the Board of Health, condemn and remove or order the removal of any plumbing or house drainage work, including cesspools or private sewers, now in or about any -10- dwelling house, hotel, apartment house, tenement house, factory, store or any other building, if he shall find the same is unsanitary and detrimental to public health. Said inspector shall notify in writing the owner or occupant of the premises whereon such work is situated, that same has been condemned or ordered removed, and it shall be unlawful for any person thereafter to use or suffer or permit same to be used. Section XXXIII. Said Inspector of plumbing is hereby directed and authorized and empowered to inspect plumbing and house drainage in all buildings in said city, both public and private, erected after the passage and legal publication of this Ordinance, and in all buildings both public and private, erected prior thereto wherein changes in or addition to the plumbing or drainage are made or are hereafter to be made and condemn same, if not in accordance with the provisions hereof. And he shall have the power to enter any building in the performance of his duties, and it shall be unlawful for any person to deny or refuse him admission. Section XXXIV. The plumbing inspector is hereby also authorized and directed to promptly condemn poor work- manship and to order the removal of or to remove any defective material or any work done other than in accordance with the Provisions of this Ordinance, and, thereafter, it shall be unlawful for any person or persons to use said material until such material or work is reconstructed in accordance with the provisions of this Ordinance. Such Inspector shall i mnediately after such condemnation, notify the plumber doing such work and the owner of the property that such work has been condemned, and state briefly the grounds of such condemnation. Such notices may be mailed to such person or persons or delivered in person; provided, -11- however, the giving of such notice or the failure to give such notice shall in no way affect or alter the liability of such person or persons, or any other person or persons to a fine or penalty for any violation of any of the provisions of this Ordinance. The authority, power and duties imposed on such Inspect- or and the provision of this Ordinance shall extend to and include any plumbing or house drainage, private sewer, or cesspool work about to be done or being constructed on any premises, and the same for the purposes of this Ordinance, shall extend over all premises and to the curb line of the public ways. Section XXXV. The Chief Plumbing Inspector and any of his authorized and dzly appointed, deputies are hereby empowered, between sunrise and sunset, to enter any building where there is good and sufficient reason to believe that the sanitary condition of such premises is such as to endanger the public health for the purpose of making such inspection as may be necessary to ascertain the condition of same upon showing their authority. Section XXXVI. Enforcement. It shall be the duty of the Chief Plumbing Inspector, on receipt of knowledge that any part of this Ordinance has been violated, to go before any Justice of the Peace or before the City Judge of the City of South Bend and cause the arrest and prosecution of all persons whom he has reason to believe are guilty of such violation. Section XXXVII. Jurisdiction placed with Board of Health. All matters concerning plumbing and building drain- age, water supply and gas piping in connection therewith and concerning the appointment of a Plumbing Inspector and deputy inspectors and the appointment of an Examining Board is hereby placed under the jurisdiction of the Board of -12- Public Health of the City of South Bend. Section XXXVIII. The Board of Health of the City of South Bend are hereby empowered to revoke the license of any employing plumber or journeyman plumber where the provisions of this Ordinance have been violated upon charges brought by the Chief Plumbing Inspector. Section XXXIX. Extra Inspectors and their compensation. The Board of Public Health of the City of South Bend, Indiana, are hereby authorized and empowered to appoint one or more deputy Plumbing Inspectors who shall work under the direction of the Chief Plumbing Inspector and who shall receive a salary of One Thousand Eight Hundred ($1,800.00) Dollars per year, payable as other city employees are now paid. Section XL. No licensed employing plumber or journey- man plumber shall act as agent for an employing plumber or journeyman plumber who has not obtained a license from the Examining Board of Plumbers. Section XLI. Hot and cold water required.. All bars and fountains and other places where food and drink, or either, are served generally to the public shall have a constant supply of both hot and cold water during all business hours. This supply shall be run through all bar fixtures, soda fountains or any other places in said business concerns where dishes or glass ware or cooking utensils are cleaned. Section XLII. Definitions of Terms; In this Ordinance the term "main soil pipe" is applied to any pipe above the basement floor connection to the house drain receiving the discharge of one or more water- closets, with or without other fixtures, and extending through and above the roof. The term "branch soil pipe" is applied to any pipe receiving the discharge from one or more water - closets and -13- with or without other fixtures and leading towards and connect- ing with the main soil pipe, but not necessarily extending through the roof. The term "waste pipe" is applied to any pipe receiving the discharge from anyfixture or fixtures other than water closets. The term "house drain" is applied to the pipe within any building buried in the ground or below the basement floor which receives the total discharge from any fixture or set of fixtures, and may or may not include rainwater leader which conducts or carries same to the house sewer. The term "House sewer" is applied to the extra heavy cast iron sewer, which shall not be less than five inches internal diameter, and which begins outside of the wall of a building and connects the house drain with the public sewer in the street. The terra "main vent" is applied to the vertical line of air pipe running through two or more floors to which the vent or revent pipes from the various floors are connected. The term "vent pipe" is applied to any pipe provided to ventilate a system of piping, and to which the revents are connected. The term " revent pipe" is applied to any pipe used to prevent siphonage and back pressure. The term "soil vent" or "waste vent" is applied to that part of the main soil pipe or waste pipe which is above the highest installed fixture waste connection and extends through the roof. When sizes of pipes are specified the internal diameter of the pipes are meant. Section XLIII. General requirements. All material used in the installation of any plumbing and drainage system,or -14- part thereof, shall be of good quality and free from defects, and all labor on installation shall be performed in a thorough and workmanlike manner. Section XLIV. Where available, every building shall have an independent connection with the street sewer at the point designated by the Plumbing Inspector, except as is hereinafter provided in case of small residences having not more than four fixtures. A conductor, soil, waste or house sewer from one building shall not be connected to a conductor, soil, waste or house sewer from another building; except; Where one building is in the rear of another, and a sewer is not available for the rear building, the house sewer from the front building may be extended to the rear building and the whole be considered as one drain, but a permit for such connection must be secured from the Plumbing Inspector. Section XLV. All piping shall be run as direct as practicable and so arranged that it may be readily repaired, but no part of a plumbing or drainage system shall be needlessly exposed to damage. Section XLVI. All horizontal piping shall.be run in Practical alignment and at a uniform grade of one -half (2) inch per foot when possible, but in no case shall the grade be less than one - quarter (4) of an inch to one foot (1) for soil or waste pipe and house drains suspended by iron hangers upon piers or posts or wall ledges; and not less than one - eighth (1/8) of an inch per foot for vent or ventilating pipes, house sewers and underground drains. Section XLVII. All drainage and plumbing pipes shall be rigidly secured or properly supported to keep their alignment and grade, and all changes of direction, either horizontal or vertical, shall be made with the appropriate use of "Ys ", half "ys ", sanitary "TYS", long sweep quarter, -15- sixth, eighth,; or sixteenth bonds, with short nipples where screw joints are used. Increase or reduction in size shall be made by the use of a proper fitting. Section XLVIII. No double hub, or doubt T, shall be used on horizontal runs, nor shall sanitary T branches be used to change the direction of flow in or to horizontal runs, nor shall double hubs or straight crosses be used on the soil or waste pipe, saddle hubs and bands are in all cases prohibited. Section XLIX. Offset in the mains of all stacks shall be avoided if possible, but when unavoidable they shall be made with forty -five (45) degrees fittings. Section L. All excavations required to be made for the installation of a building drainage system, or any part thereof, within the walls of a building, shall be open trench work. All such trenches shall be kept open until the piping has been inspected. Section LI. All free standing stacks shall be thoroughly supported on concrete or masonry piers at their base, and those forty (40) feet or morein height shall also be provided with foot rests at their base and also with floor rests or supports at every ten (10) feet intervals. The pipe supports according to their location shall be made with either heavy iron posts, hangers, wall brackets or steel fittings concrete or masonry piers; provided that no brick pier shall be less than eight (8) inches square. The use of pipe hooks shall be prohibited for larger than one and one -half (12) inch pipe. No elbow or quarter (4) bend shall be used on any soil stack or waste line when the change in direction of flow is from vertical to horizontal. Section LII. When computing the size of house drains, -16- soil and waste stacks, mains and branches, fifty (50) square feet of roof or yard area in horizontal projection shall count as one fixture. Three feet of urinal trough or wash sink shall count as one fixture. One bath, basin or sink or smaller fixture shall count as one fixture. One water closet shall count as four fixtures. Section LIII. Special requirements. When the rain- water drain connects inside of the building, it shall be of the same material as a soil drain, and when passing up to roof within a building it shall be tested the same as the soil system with the water test, in which case the rainwater trap may be omitted. Section LIV. The number of fixtures in a building shall determine the size of the house drain and the combined area of the soil or waste.stacks shall in no case be less than that the area of the house drain. Section LIII. Special requirements. When the rain- water drain connects inside of the building, it shall be of the same material as a soil drain, and when passing up to roof within a building it shall be tested the same as the soil system with the water test, in which case the rainwater trap may be omitted. Section LIV. If rainwater drain connects to the main -17- house drain, the connection shall be made with a "Y" branch, and trap shall be provided if said conductor opens or terminates within 12 feet of a window measuring in horizontal direction. When a rainwater leader connects to the house drain said drain shall he not less than 6 inches in diameter. Section LV. When outside conductors. or downspouts of sheet metal are on driveways, streets or alleys and are connected with the house drain they shall be so connected by the use of not less than one length of extra heavy cast iron pipe extending vertically at least four (4) feet above the grade line, except where an overflow out out is installed in which case same may extend not less than one foot above grade. Section LVI. All building drains in all cases where new buildings are erected and constructed in the City of South Bend, Indiana, shall be of extra heavy cast iron soil pipe, as it is known in commerce, The soil stacks from immediately above the basement floor may be extra heavy cast iron pipes, galvanized wrought iron pipes, or galvanized mild steel pipes. The drain shall extend from the curb to a point immediately above the base- ment floor. Section LVII. If the length of a branch or main vent pipe is to exceed the given maximum, above diameter must be increased to the tabulated size opposite the length required, irrespective of the number of traps vented, but in no case shall the main vent be less than one -half the diameter of the adjoining soil pipe. Section LIX. All cast iron pipe and fitting shall be sound, cylindrical and smooth, free from cracks, sand holes and other defects, of a uniform thickness and not lighter than the commercial grade known as "extra heavy." Section LX. All wrought iron or mild steel pipe used for soil, waste or vent pipes shall be thoroughly galvanized inside and outside, and not lighter than the commercial grade known as "Full weight." The fittings and couplings for wrought iron or mild steel waste, soil or refrigerator waste shall be threaded cast iron or brass recessed drainage fitting3 with smooth interior waterway and threads tapped out of solid metal, so as to give a uniform grade to branches of not less that 4" per foot. Threaded fittings for vent pipe or revent pipes shall be brass galvanized malleable iron or cast iron fittings of the drainage type. All pipes used for soil or waste pipes under basement floors must be extra heavy cast iron soil pipe. Section LXI. All pipe used for branch soil, waste, vent or flush pipes shall be of the best quality of drawn lead pipe, cast iron, copper, brass or galvanized iron and of not less weight per lineal foot than showirg in the following table: Lead Branch soil, waste, vent or flush pipes including bends Endtraps. The thickness of the tapped ends to be one and one -half (12) times the thickness of the corresponding pipe. Section LXIII. Glazed tile sewer pipe may be used in connection with repairing of any glazed tile sewer now in use in the City of South Bend but must not be less than 6 inches in diameter. The entire drain shall have a solid support for the hub ends of crocks. Section LXIV. Joints between the hub and spigot shall be well filled with mortar made of one (1) part clean sharp sand to one (1) part cement. Each joint shall be carefully banked, wiped and cleaned, Underground joints between earthenware and iron pipe shall be made the same as above required for earthenware pipe. All joints shall be left with a smooth interior surface. Section LXV. Yards and areas shall be properly graded and drained. When the drain from said yeard or area is connected with the house drain it shall be effectually trapped. Section LXVI. All main and branch soil, waste and vent and revent pipes shall be of iron, lead, brass or copper. Section LXVII. Every building in which water closets are installed shall have at least one four (4) inch soil Pipe stack extending through the roof, with increaser as herein specified. Section LXVIII. All soil and waste pipes into which the various fixtures discharge shall be extended not less than one foot above the roof of the building at the high side of -21- the stack terminating with open end for ventilation, and at least five feet when such roof is used for other purposes than weather covering the building.. All such pipes shall be increased at least one inch in size before passing through roof. In no case shall a vent pipe passing through the roof be less than two inches in diameter, except that.all 1 -4 and 1 -2 inch pipe shall be increased to two inches. Change in diameter shall be made by long increaser, at least six inches below roof. When roughing is done, the vent pipe necessary for the fixture intended to be used must be installed. Section LXIX. Measurements of all sewer taps from the main must be made and reported to the Engineer's Office by all Master Plumberswhen connection thereto is made by them. All sewer connections from the curb or main must not be less than 5 inch extra heavy cast iron soil pipe, which said connection diall run from the curb or main to the house drain as herein defined. All cast iron sewers must be caulked with lead. Section LXX. The roof terminals of all vent pipes shall be at least three feet above any door, window, scuttle or air shaft when located at distances less than twelve feet from such terminal. Section LXXI. Where a single basement or first floor closet is placed more than five feet from the point of connection to the inside house drain or soil stack, in addition to the 4 inch main soil stack, a vent stack not less than 2 inches in diameter must be provided and extended through the roof, provided, however, that not more than one such fixture shall be so connected. Section LXXII. Where there are a series of closets one above the other the lower closets must be protected by -22- venting. Section LXXIII. All main vents shall be run undiminished and connected full size at their base to the main waste or soil pipe at or below the lowest fixture branch and shall be extended above the roof. They may be connected with the adjoining soil or waste vent one foot above the highest fixture. Section LXXIV. Every branch soil or waste pipe to which a group of two and not more than eight water closets or pedestal urinals only are connected, may be vented by a circuit or loop vent, provided each horizontal branch does not exceed twenty -five (25) feet in length. Connection from such branch shall be taken from Y to TY branches. The vent shall be taken off in front of the last fixture connection, and must rise one foot above the top of the highest fixture before offsetting horizontally or connecting to the branch, main, waste or soil vent. Where other fixtures discharge into said waste line, each fixture must be separately revented. Section LXXV. Where the vent or revent pipes are continuous and traps are ventilated through the waste fitting, the center of the outlet of such fitting shall not be set below the water seal of the trap, and the traps shall not be more than 3 feet from vent stack. Section LXXVI. Horizontal revents below the water line of any fixture shall be offset to vertical as near to the fixture as possible. Solderir4g- unions or nipples usedfor vent or waste connections shall not be wiped direct to lead bend, drum trap or lead waste but said vent pipe connection shall be made of lead to a point of at least six inches above the floor. Section LXXVII. Every fixture trap shall be protected from siphonage and back pressure and air circulation assured -23- by means of a vent or revent pipe. Traps may not be less than 17 gauge. Buildings more than three stories in height shall be provided with an approved method of relief vents when in the opinion of the Plumbing Inspector the same are necessary., Section LXXVIII. The back vent of any fixture shall be as close to the traps as practicable, consistent with its location and effectiveness. Section LXXIX. where two water closets located on the same floor, discharge into a double sanitary T or TY in a soil or waste stack they need not be revented if such fixtures do not exceed the three foot limit without other fixtures above them. When two fixtures other than water closets discharge into a double sanitary T or TY, and there are no other fixtures discharging above them said fixtures may be revented through a common vent or revent pipe. The waste of a bath tub, basin, or sink may be connected to a Y or TY fitting between the closet bend and the stack or wiped to the lead bend, without reventing the closet bend providing there are no other fixtures discharging above. Section LXXX. The material used for bar waste pipes shall be lead, galvanized wrought iron pipe, galvanized mild steel, brass, copper pipe or extra heavy cast iron pipe, the main waste to be not less than two inches and the arrangement of all the plumbing in connection with all saloon bars shall be subject to the approval of the Plumbing Inspector. The waste of different bar drains may empty through a single trap if the same is properly revented. Section LXXXI. No soil, waste or vent pipe extension of any new or existing building shall be run or placed on the outside of a wall, but shall be carried up in the inside of the roof. In the event that a new building is built higher than an -24- existing building, the owner of the new building shall not locate windows within twelve (12) feet of any existing vent stack in the lower building, unless the owner of such new building shall himself make such alteration to conform to this Code. Section LXXXII. Conductors shall be constructed of extra heavy cast iron or galvanized wrought iron pipe when placed within the walls of any house or building and shall be tested by the water test, as hereinafter provided for soil stacks. Section LXXXIII. Conductor pipes shall not be used as soil, waste, venting, back vent pipes. Section LXXXIV. When an existing sheet metal conductor Pipe within the walls of any building becomes defective, such conductor shall be replaced by one which conforms to this Code. Section LXXXV. Each single fixture shall be separately trapped by a water seal trap, placed as close to the fixture as possible. Each cellar or are drain shall be provided with a deep J seal trap, i.e. the trap must contain at least a 4 -inch water seal and be constructed on the continuous pipe trap principle; the trap seal is indicated by the height of the water column measured between the overflow and the tip separating the inlet and outlet arms of the trap. Such drain shall in no case be placed within five feet of the base of the soil stack to which a rain water drain connects, unless a said floor drain is properly revented. A set of not more than three wash trays or washstands or a set of one or two wash trays with sink combined, may connect with a single trap, provided the trap is placed central and the branches connect into the house side of the traps. Section LXXXVI. Every trap shall be self cleaning. No form of trap which depends upon the action of movable parts -25- for its seal shall be used. No trap which depends upon concealed interior partition that, in case of defect, would allow the passage of sewer air, shall be used. Each urinal must be separately trapped immediately under the fixture except when batteries of urinals of a type having continuous flow of water are used, when a single trap will suffice. Section LXXXVII. Each trap except floor drains shall have a water seal of not less than two inches. Traps placed between the floor shall have a brass trap screw for cleaning in plain view or flush with the floor, or readily accessible from or under the floor. All traps shall be rigidly supported and set true with respect to their water level, and shall be so located as to Protect their seals. Section LXXXVIII. Cleanouts shall be the same size as the pipe up to four (4) inches in diameter and not less than four (4) inches for larger pipe or traps. Cleanouts shall be provided as follows; At the foot of all vertical lines of soil pipe, and at the end of each horizontal line. The distance between the cleanouts shall not exceed fifty (50) feet. All traps and cleanouts shall be located so as to be easily accessible for cleaning. Section LXXXIX. Each single fixture shall be separately trapped by a 4" water seal trap, placed as close to the fixtures as possible. No cellar or area drain shall be placed within 5 feet Of a house drain or soil stack to which a rainwater drain connects unless said floor drain is properly revented. All floor drains in toilet rooms and beneath urinals shall be revented as herein provided for other fixtures. A set of not more than three wash trays or wash stands or a set of one or two wash trays with sink combined, may connect with a single trap, provided the trap is placed -26- central and the branches connect into the house side of the traps. Section XC. Traps for bath tubs, basins, sinks, or other similar fixtures shall be made of lest} brass or galvanized cast iron. Drum traps shall be used for the foot seat or bath tubs and shall not be less than four inches in diameter. Galvanized or cast iron traps shall be extra heavy full bore throughout, and have a smooth interior water way and threads tapped out of solid metal. Iron drum traps shall be made of extra heavy cast or malleable iron, or galvanized, and the drum shall not exceed four (4) inches in diameter. Drum traps shall have a water seal of not more than seven (7) inches nor less than two inches. Section XCI. There shall be no trap at the foot of soil or waste pipe stacks upon the house drain or house sewer. Bell traps or traps having covers over handholes on the sewer side of the trap which are held in place by bolts or lugs, are prohibited. In no case shall the waste from the bath tub or other fixture be connected witha water closet trap. In no case shall a waste pipe from any other fixture be connected to the house side, or in the seal of the water closet trap, or be wiped into the heel of a lead bend. Such connections shall be made so that the discharge of water shall not disturb the seal of the water closet trap. Overflow pipes from fixtures shall in each case be connected on the inlet side of the trap. Section XCII. No steam, exhaust, blowoff, drip or return pipe from any steam trap shall connect with the sewer or with any house drain, soil, or waste pipe or rainwater drain pipe, without being properly trapped. The water or steam -27- of condensation from such pipes entering any sewer or drain, shall not be over 100 degrees Fahrenheit. All steam con- densation discharge into any sewer shall be properly trapped with a check valve, inspected, and a permit shall be required therefor. Section XCIII. All direct connected hydraulic elevators, lifts or pressure machines shall be provided with an inter- mediate tank of sufficient capacity as to discharge its waste without pressure into any sewer, drain, soil or waste pipe, Such tanks shall be trapped. Section XCIv. The waste pipe from a refrigerator, ice box or ice tray, or any receptacle in which provisions are stored, shall not connect directly to any drain, soil or waste pipes, and such waste pipes shall be arranged so that they may be properly flushed, The discharge of same shall run into an open fixture properly trapped and with a water supply brought to same to maintain the seal in trap when the refrigerator is not iced or in use. Where two or more refrigerator waste pipes lead into a common discharge pipe, said discharge pipe shall be continued full size up through the roof and terminate with an open end for ventilation. Section XCV. The overflow pipe from a tank shall not be directly connected with any drain, soil or waste pipe. Such pipe shall discharge into an open fixture or in a roof gutter. Section XCVI. Waste pipes from safe wastes placed under- neath fixtures shall not be directly connected with any drain, soil or waste pipe. Such pipes shall discharge into an open fixture or upon the cellar floor. All arrangements shall be subject to the approval of the Plumbing Inspector. Section XCVII. The waste pipes and traps for acid tanks, sinks and other receptacles receiving the discharge of acids in chemical laboratories, electrotyping, lithographing and other similar establishments must be made of Duriron, extra -28- heavy lead pipe, or lead -lines pipe of adequate durability. The waste pipes may be of vitrified clay when placed outside the building. Section XCVIII. Waste pipes from milk vats, sterilizers, etc., shall be of the same size and material as wastes from sinks, etc. Such wastes may discharge on a watertight floor having a catch basin, or they may discharge into a properly constructed sink. When connected to a drain, soil or waste pipe, such waste pipes shall be separately trapped and revented. Section XCIX. Waste pipes for wash trays, washing machines and other like fixtures in public laundries, or dye, houses, etc., located in rooms having watertight floors and a properly constructed floor wash trap, may discharge on said floor. Section C. Kitchen or other greasy wastes from botels, restaurants, club houses, public institutions or other establishments in which cooking is done or greasy wastes obtain, shall be intercepted by an approved catch basin or a grease trap, and then cond}bted to the house sewer. Section CI. Any change in the location of a plumbing fixture shall be governed by the same rules as herein provided for new work, and shall be subject to the inspection and approval of the Plumbing Inspector. Section CII. All receptacles used for water closets, urinals or otherwise for the disposal of human excrets, shall be either vitrified earthenware, hard natural stone or cast ironwhite porcelain enameled on inside. If cast Iron is used, it shall be enameled, or painted on the outside with at least three (3) coats of non - absorbent and non- corrosive paint. Section CIII. The bowls and traps for water closets shall be made in one piece and of such shape and form as to hold sufficient quantity of water when filled up to the -29- trap overflow so as to completely submerge any matter deposited in them and properly flush and scout the soil pipe when the contents of the bowl are discharged. Section CIV. All water closets or pedestal urinals shall be provided with flushing rims, constructed so as to flush the entire interior surface of the bowl thereof with water as prescribed in a subsequent section of this Ordinance. Section CV. Water closets with low down tanks shall be of syphon pattern provided with refilling devices. Section CVI. Outside water closets shall not be connected direct to the city water but must be flushed through an approved tank. Section CVII. That outside closets or Frost -proof closets may be placed in a room adjoining any dwelling providing the door to same must not open into said dwelling proper; but must have an entrance to it from the outside only. Section CVIII. In lodging houses and hotels or inns and all places where people are employed, hereafter erected or altered there shall be provided two water closets for every twenty -five males or less and one additional closet eae' a ie}rft-1 least for each additional tenmales or fraction thereof, and two water closets for every twenty females or less and one additional closet for each additional ten females or fraction thereof. The number of water closets required shall be determined by the number of lodging quarters provided or from the number of persons employed. There shall be at least one closet on each floor, except that no general water closet accomodations of any lodging house shall be placed In the basement. Section CIX. Separate water closets shall be provided for male and female persons in all places within the City of -30- South Bend wherein food and drink, or either or both, are served to the public generally. Section OX. In all buildings used jointly for residence and business purposes separate and sufficient water - closets shall be provided for the use of families and for the use of employees and patrons of the place. In tenement houses or apartments a separate closet, bath tub, or shower, lavatory and sink must be provided for each family. Section CXI. No water closet or urinal bowl or trough, excepting anti - freezing closets, shall be supplied directly from the water supply pipes. Every water closet or urinal bowl or trough shall either be flushed by an improved flushometer valve or indirectly flushed through a flushing tank of at least five (5) gallons capacity for each eater closet and two (2) gallons for each urinal. Section CXII. A group of urinals, on the same floor, subject to constant use as in schools and factories may be supplied from one (1) tank, if provided with an automatic simultaneous flush provided that each individual urinal shall receive not less than one (1) gallon of water at each flushing and the discharge is of such force as to cleanse such individual bowl at each flush. All public urinals in saloons, hotels, comfort stations, and similar locations shall be equipped with automatic flush tanks. Section CXIII. No plumbing fixtures shall be located in any room or apartment vaiich does not contain a window placed in an external wall of the building or is not provided with a system of ventilation. Compartments containing not more than four (4) closets or their equivalent shall be located in an apartment con- taining windows not less than 12 sq. ft. in area and pro- vided with a gravity or mechanical system of ventilation which will change the air at normal temperature not less 0 -31- than six (6) times per hour, or may be placed in a compartment without windows in the external wall of the building, providing a mechanical system of ventilation is installed which will change the air at normal temperature not less than six (6) times per hour. Section CXIV. All rooms containing a public lavatory shall have ventilation to the outer air by an air shaft or duct sufficient to provide the necessary ventilation of the room. Ventilation from toilet rooms shall be separate and distinct and have no connection whatever with the other ventilating ducts in the building. When water closets or urinals are not placed in a separate and properly ventilated room the partitions around the same shall be extended to the ceiling or shall be ceiled over not less than seven (7) feet above the floor, and the space so enclosed shall be ventilated in an approved manner. Section CXV. In all buildings the outside partitions of any water closet or urinal apartment shall be solid and extend to the ceiling or be independently ceiled over not less than 7 feet above the floor. When necessary to light such apartments the upper part of the partitions may be provided with translucent, not clear glass. The interior partitions of such apartments shall be dwarf partitions of not less than 61 0" high. Section CXVI. Where water closets or other plumbing fixtures are placed under a sidewalk, street, alley or other like place, adjoining and opening into the basement of any building, each and every fixture 'so placed shall be ventilated in the same manner as is provided for other plumbing fixtures in this ordinance, and the water closet compartments shall be adequately lighted and ventilated, and the bowls of such -32- closets must be caulked to the soil pipe or securely bolted to a cast iron flange, or provided with an approved screw connection. . Section CXVII. All joints and connections prescribed under this ordinance shall be made gas and watertight, and all wrought iron or mild steel waste pipes shall be properly reamed on the inside. Section CXVIII. Joints in cast iron pipes shall be made with oakum and molten lead, caulked and smoothly faced. Joints in wrought iron pipes shall be 'made up" with screw threads having white or red lead or mineral paint applied to the male part of the thread, and shall be screwed up to the shoulder of the fitting. Lead pipes shall be jointed by wiped joints. Joints in lead pipe or between lead pipes and pipes of brass or copper shall have an exposed surface of the solder to each side of the joint of at least three- quarters of an inch. Connections of lead and iron pipes shall be made by means of a cast lead combination or standard brass ferrule, brass, brass soldering nipple or soldering union and wiped joint. The use of cup or drive ferrule is hereby prohibited. Section CXVIX. Every building used for residence, commercial, industrial or public purposes when served with city water must have its own distinct water service pipe not smaller in internal diameter than shown by the schedule or pipe sizes and all pipe used for conducting water under pressure must be of either strong lead, galvanized wrought iron pipe, or cast iron covered with a coating of asphaltum varnish in accordance with the specifications of the American water works Association. Section CXX. Where different sizes of pipe or pipes and fittings are to be connected, proper size increasers -33- or reducers shall be used. Section CXXI. All work as herein described shall be performed under the entire supervision of an employing master plumber, properly licensed as herein provided, except, however, that no plumbing work of any kind may be done, or any addition to any plumbing including repairs may be done unless the original plumbing meets all the requirenents set forth in the various sections of this ordinance. In the event that an addition to any plumbing is required and the original plumbing job does not conform to this ordinance, a test of the entire plumbing job must be made by the master plumber before making any addition thereto or alteration thereon. If this test shows that the plumbing installed does not meet with the requirements of this ordinance the master plumber shall notify the plumbing inspector of this fact and the plumbing inspector shall proceed under this ordinance. In all cases of additional plumbing to any plumbing job that has been installed in accordance with this ordinance a test shall be made of the additional plumbing work only. Section CXXII. When any building as defined in section three of this ordinance becomes vacant where water service is available the plumbing inspector must before the building is occupied inspect all plumbing and any defective plumbing or plumbing that does not conform to this ordinance shall be reported to the Board of Public Health by said plumbing inspector. This report shall be in writing and shall specifically state wherein the plumbing is defective or wherein it does not comply with this ordinance and the use of said plumbing shall be prohibited by the Board of Health until it is repaired or altered and meets with the re- quirements of this ordinance. Section CXXIII. Brass ferrules shall be best quality brass, not less than 42 inches long and 22f 32 and 42 inches in diameter, and not less than the standard weight. -34- Section CXXIV. Soldering nipples shall be of cast brass, or of brass pipe iron pipe size. When cast, they shall be full bore and not less than standard weight. Section CXXV. Screw caps for cleanouts shall be of extra heavy brash not less than 1/8 of an inch thick. The screw cap shall have asolid square or hexagonal nut not less than one inch high. Cleanout is to be standard make having full bore. Section CXXVI. Connection or hangers, pipe supporters, or fixtures, setting with masonry or stone backing shall be made with expansion bolts without the use of wood plugs. Section CXXVII. Cellars and basements shall be kept free from ground or surface water, and where the same are too low to be drained into the sewer, the water therefrom shall be lifted by a cellar drainer or ejector or other device, approved by the Plumbing Inspector, and discharged into the sewer. Section CXXVIII. Overflow pipes from cisterns shall not connect directly with any house sewer, but drain pipes from bottom of cistern may connect with the sewer if properly valved. Section MIX. The connection with the roof sump must be made with brass ferrule caulked to cast iron or screwed into wrought iron pipe and shall be connected water and air tight to ferrule with an extension joint. Roof sumps shall be constructed of sheet lead not less than 4 lbs. to the square foot. Section CXXX. Sheet lead for roof flashing shall not weigh less than three pounds per square foot, shall be new unused material, shall extend not less than six inches from the pipe and the joint shall be made watertight. All roof flashing around pipes shall be made of lead which shall extend up and be flashed down into said vent pipe. -35- Section CXXXI. It shall be unlawful for any person or persons to turn on or cause to be turned on, the water supply in and service pipe leading from the city water system and conducting water to any premises or building without a written order from the Plumbing Inspector approving the plumbing and drainage of said buildings; provided, however, that the water may be turned on for the purpose of testing the plumbing and drainage systems, and it is hereby made the duty of the person or persons causing said water to be turned on to see that same is turned off immediately after such tests have been made, provided, further, however, that water may be turned on for use during building con- struction if the proper permit has been obtained from the City Water Works Department, and it shall be the duty of the person or persons desiring use of said water to so notify the said Department. Section CXXXII. Nothing in this ordinance shall be construed to apply to any connections with the water system Of this city which are made by the department for the operation of its plant. Section CXXXIII. No service pipe shall be installed to or into any building or property smaller than 3/4" internal diameter. Section CXXXIV. No fixture shall be supplied with water trough pipe having a smaller internal diameter than that specified in the following table and in no case shall more than the one fixture be supplied for the pipe of the size specified for each fixture. All water piping to fixture must be that specified for service piping except that pickle plated brass piping of equal strength may be used for fixture connections. Section CXXXV. The plumbing inspector is further directed and authorized to make the inspection of the water service connections in all buildings erected after the passage of this ordinance and in all buildings erected prior to its passage whenever change or alterations are made and if contrary to the provisions of this ordinance condemn and remove or cause to be removed all such work. Section CXXXVI. The plumbing inspector shall make a report of each inspection of water service connection to the City Water Department and the City Water Department must not start service through any connection until said inspectors approval has been filed. Section CXXXVII. The word "Fixture or Fixtures" as used in this ordinance shall mean and include bath tubs, lavatories, commodes, flush tanks, kitchen sinks, hot water tanks, water heaters, boilers and any other part Of plumbing that is both trapped and vented,although not particularly named or described herein. Section CXXXVIII. It shall be unlawful for any person to sell, exchange, keep for sale, or offer for sale, within the City of South Bend, or the police jurisdiction thereof any fixture .as hereinabove defined whether new or second- hand, unless the same has securely attached thereto a label or sticker containing thereon the name of City of South Bend, a serial number and signature of the Plumbing Inspector of the City of South Bend or a facsimile of such signature engraved thereon. -37- Section CXXXIX. It shall be unlawful for any person to detach and remove any of said fixtures from any building in which the same is installed or to install any of said fixtures, unless such fixtures have securely attached thereto a label or sticker as described in section one hundred thirty - eight. Section CXL. Any person desiring to secure labels herein- above described shall make written application to the Plumbing Inspector of the City of South Bend upon blanks to be furnished by the City of South Bend, which application shall show, (a) the rame and address of the applicant; (b) the number and kind of new and second -hand fixtures to be labeled; (c) That the applicant has a good title to said fixtures or a right to remove or install the same; (d) Such other information as the Plumbing Inspector may require. When the Plumbing Inspector is satisfied that the applicant is entitled thereto such label shall be attached to such fixtures of the applicant by the Plumbing Inspector, or one of his assistants. It shall be the duty of the Plumbing Inspector to keep a record of all labels affixed by him or his assistants to any such fixture. Section CXLI. It shall be unlawful for any person to purchase or receive thru exchange or otherwise, within the City of South Bend or the police jurisdiction thereof, any of the above named fixtures, whether new or second -hand except direct from the manufacturers thereof, unless such fixtures bear a label as hereinabove described. The possession of any detached second -hand fixture: above described not bearing a label as hereinbefore described shall be prima - facie evidence that such possession is unlawful and a violation of this ordinance and the burden of proof shall be upon the possessor to show that his or its possession is lawful. -38- Section CXLII. It shall be the duty of every person to make a weekly written report to the Plumbing Inspector upon the blanks furnished by the Plumbing Inspector showing all such fixtures sold by him during the next preceeding week; to whom such fixtures were so34 whether such fixtures were new or second.-hand., where such fixates were installed and the serial number of the label attached to such fixture. It shall be unlawful for any person to fail, neglect or refuse to file such report weekly with said Plumbing Inspector. Section CXLIII. All plumbing fixtures shall be installed or set free and open from all enclosing work. Section CXLIV. Any change in the location of a plumbing fixture shall be governed by the same rules as herein p?ovided for new work, and shall be subject to the inspection and approval of the Plumbing Inspector. Section CXLV. The use of pan, plunger, offset, with or without flush tank trough, Latrine or Smead system closets are prohibited. Section CXLVI. Long oval or straight back hoppers are prohibited except for anti -frost closets. All such now in use when out of repair or condemned by the Plumbing Inspect- or shall be removed. Section CXLVII. No urinal shall be placed over or in close proximity to wood. Some non - absorbent material shall be used, such as slate, hard marble, or Portland cement smoothly troweled. Urinal floors shall be directly connected to a drain soil or waste pipe; a deep seal or drum trap shall be used and arrangements for flushing the same in all cases. The use of galvanized iron urinal trough is hereby prohibited. Section CXLVIII. Fixed wooden wash trays or sinks are Prohibited in any building or part of building designed -39- or used for human habitation. Section CXLIX. Where water closets or other plumbing fixtures are placed under a sidewalk, street, alley or otherlike place, adjoining and opening into the basement of any building, each and every fixture so placed shall be ventilated in the same manner as is provided for other plumbing fixtures in this ordinance, and the water closet compartments shall be adequately lighted and ventilated, and the bowls of such closets must be caulked to the soil pipe or securely bolted to a cast iron flange, or provided with an approved. screw connection. Section CL. When bath room or toilet room fixtures or sinks are replaced by modern fixtures, the waste connections under the floor trapping and vent pipes shall conform to these Rules and Regulations, the same as in a new building. Section CLI. Copper lined wooden bath tubs shall not be installed, nor shall any old fixture of this class be reconnected. Section CLII. Air supply for beer pumps shall be taken from the outside of the building. Section CLIII. Overflow pipes from cisterns shall not connect directly with any house sewer, but drain pipes from bottom of cistern may connect with the sewer if properly valved. Section CLIV. Every dwelling house, hotel, factory, store, or other building in which plumbing or house drainage work or arrangements are to be placed shall be connected with the .public sewer and with the public water mains, which are or may become accessible, and such Connections shall be deemed to be accessible, when such public sewer or public water mains:�are within:. a distance of one hundred (100) feet of any outside line of the lot upon-which said building -40- may be situated. Section CLV. When the public sewer is not accessible as herein provided the said building or buildings may be connected with a cesspool located not less than twenty -five (25) feet away from any building used for human habitation, or within 50 feet of any watertight cistern or within 100 feet of any source of any water supply, and same must be built under permit from the Plumbing Inspector. The cesspool shall be built to receive a cast iron or steel cover of not less than fifteen (15) inches in diameter. No cesspool or privy vault or similar means of sewerage disposal shall be used in connection with any apartment house or tenement, but every such house shall have its plumbing system directly connected with the public sewer. When cesspools are built they shall be constructed or erected under a permit granted by the Plumbing Inspector, in accordance with the provisions of this ordinance, and with reference to permits issued for plumbing or house drainage work, so far as same may be applicable. Brick or other material equally as good, shall be used in the construction of all cesspools; provided, such other material shall not be used unless specially authorized by the Inspector in a special permit therefor, issued in the same manner as herein provided for the regular permit for cesspools. Provided, that the person signing and filing said statement shall deposit the sum of One ($150) Dollar and fifty cents for each cesspool described in said statement. Section CLVI. In any case any cesspool is allowed, because of inability to connect with a public sewer, then, or as soon thereafter as it becomes possible to make such sewer connections, such cesspool shall be cleaned out, and filled with fresh earth and the sewer connection made. All cesspools shall be left open for inspection as herein pro- -41- vided. Within forty -eight (48) hoursafter the completion of any cesspool, notice thereof shall be given the Plumbing Inspector in the same manner and by the person or persons as herein provided with reference to notices for final inspection of plumbing and house drainage. Said inspector shall file such notice, and make such inspection under the same regulationsherein provided with reference to final inspecting of plumbing and house drainage as far as same may be applicable. If the same be approved by him, he shall issue a certificate of approval therefor to the proper person. It shall be unlawful for any person or persons to use such cesspool until such inspector has approved same. Section CLVII. It shall be unlawful for any person or persons to turn on or cause to be turned on, the water supply in and service pipe leading from the city water system and conducting water to any premises or building without a written order from the Plumbing Inspector approving the plumbing and drainage of said buildings.; provided, however, that the water may be turned on for the Purpose of testing the plumbing and drainage systems, and it is hereby made the duty of the person or persons causing said water to be turne on to see that same is turned off immediately after such tests have been made, provided, further, however, that water may be turned on for use during building construction if the proper permit has been obtained from the City Water Works Department, and it shall be the duty of the person or persons desiring use of said water to so notify the said Department. Section CLVIII. When the installation of the water service in any building or premises is completed the plumber -42- doing such work shall sign and execute a written report of such work giving:.name, street and number of the premises where such work was done and performed, the size and location of the tap, location of service pipe and service box, between the main and consumer's property, the number and kind of fixture, if fixtures are installed for the use of more than one family or tenant, the number of such persons. Such Plumber shall file said written report with the inspector of plumbing, who shall examine same, and if he finds it to be correct, shall approve it and file the same with the Superintendent of Water Department, and it shall be a viola- tion of this ordinance for any person to file a false state- ment or report as to the number and kind of fixtures or the size and location of tap or service boxes. Section CLIX. Nothing in this ordinance shall be con- strued to apply to any connections with the water system of this city which are made by the department for the opera- tion of its plant. Section CLX. No service pipe shall be installed to or into any building or property smaller than 3/4" internal diameter. Section CLXI. That hereafter all water heaters burning gas or other combustible material installed shall be pro- vided with a vent pipe connected to a flue that has a Positive updraft which will remove dangerous products of combustion. Section CLXII. All gas supply valved to water heaters must be provided with a controlling device to prevent ex- plosions of range or domestic boilers and which will prevent a back flow of hot water through cold water supply. The said controlling device shall be approved by the Plumbing` Inspector. Section CLXIII. Slip joints shall not be permitted -43- on the sewer side of any trap. All other joints shall be caulked, screwed, or wiped. Soldering nipples, brass unions, galvanized box unions with sheet lead gaskets, made without other gaskets or packing, or with long threaded unions are permitted. No union shall be used under floors on waste or vent pipes. Section CLXIV. Slip joints shall not be permitted within any part of the water supply system. Section CLXV. That all persons doing any work within the terms of this ordinance shall also abide by any rules established by the Board of Public works regulating the Water Department, which are not in conflict with this ordinance. Section CLXVI. All plumbing and house drainage shall be inspected by said Inspector as follows: When the soil waste pipe or vent stack are completed throughout the building, and before any joint in such soil waste pipe or vent stack or fittings are covered, and whin all openings are made for the proper connection of all fixtures all soil waste pipes or vent stacks shall be filled with water to the highest .point or to the highest point above the vents. This shall be the first test made by the Plumbing Inspector and he shall be notified that the work is ready for inspection by written notice filed with him by the employing plumber. Final inspecton shall be made when all fixtures are attached and the work is completed and the water turned on and all traps filled. If this last mentioned test meets with the approval of the Plumbing Inspector and with the various sections of this Ordinance,, then the Inspector shall issue his certificate of approval to the proper per- sons, which said certificate shall properly identify the work and shall be issued before the water meter is set. -44- If the Plumbing Inspector, for any reason, ma,, not certify the final inspection of any plumbing or drainage work as meeting with the requirements of this Ordinance he shall notify the owner of the property and the Employing plumber in writing of his decision and he shall also notify the Board of Health and he shall specifically set forth wherein the work or material does not conform to this Ordinance. Section CLXVII. Any person dissatisfied with the decision of the Plumbing Inspector may appeal to the Board of Health and said Board shall set a time for a hearing. This hearing shall be conducted by the Board of Health as other hearings are now conducted before it and its decision shall be final except that the losing party may appeal to the St. Joseph Circuit or Superior Court. Section CLXVIII. If any section or part thereof of this Ordinance is held unconstitutional the remaining sections or provisions shall be given full force and effect as completely as if the part held unconstitutional had not been included herein. Section CLXIX. Any person who shall come under this Ordinance refusing, failing or neglecting to comply with any of the provisions of this Ordinance shall be deemed guilty of a misdemeanor and upon conviction shall be subject to a finefbr not less than Ten ($1000) Dollars or more than Three Hundred ($300.00) Dollars or imprisoned for not less than ten (10) days nor more than thirty (30) days, or both. Section CLXX. No person shall be imprisoned under this Ordinance for the first offense and the prosecution shall always be as and for the first offense unless the -45- affidavit upon which the prosecution is instituted contains an allegation that the offense is a second or repeated offense. Section CLXXI. This ordinance shall be in full force and effect from and after its passage, legal publication, and approval by the Mayor.
